An Act to Amend the New Brunswick Income Tax Act Loi modifiant la Loi de l’impôt sur le revenu du Nouveau-Brunswick Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et avec le consentement de l’As- semblée législative du Nouveau-Brunswick, édicte : 1

Section of the New Brunswick Income Tax Act,

chapter N-6.001 of the Acts of New Brunswick, 2000, is amended L’article de la Loi de l’impôt sur le revenu du Nouveau-Brunswick,

chapitre N- 6.001 des Lois du Nouveau-Brunswick de 2000, est modifié (

a) by repealing subsection (3) and substituting the following:

a) par l’abrogation du paragraphe (3) et son rem- placement par ce qui suit : 60(3) Where an eligible corporation that produces an eligible project in New Brunswick files with its return of income for a taxation year, a New Brunswick film tax credit certificate issued in accordance with the regulations, the corporation is eligible for a refundable film tax credit for the taxation year which shall be determined by adding the following amounts: 60(3) La corporation admissible qui produit un projet admissible au Nouveau-Brunswick et qui dépose avec sa déclaration de revenu pour une année d’imposition donnée un certificat de crédit d’impôt pour production cinémato- graphique du Nouveau-Brunswick délivré conformément aux règlements est admissible à un crédit d’impôt pour production cinématographique remboursable pour l’année d’imposition qui correspond à la somme de ce qui suit : (

a) an amount determined by multiplying the pre- scribed rate by the amount of eligible salaries paid in the taxation year; and

a) le montant qui résulte de la multiplication du taux prescrit par le montant des traitements admissibles ver- sés au cours de l’année d’imposition; (

b) in the case of a regional project, an amount deter- mined by multiplying the prescribed rate by the amount of eligible salaries paid in the taxation year and incurred after December 31, 2009.
