Loi sur les ventes de tabac Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et du consentement de l’Assem- blée législative du Nouveau-Brunswick, décrète : 1

Section 6.2 of the Tobacco Sales Act,

chapter T- 6.1 of the Acts of New Brunswick, 1993, is repealed. 1 L’article 6.2 de la

Section 6.21 of the Act is repealed. 2 L’article 6.21 de la Loi est abrogé. 3 The Act is amended by adding after

section 6.3 the following: 3 La Loi est modifiée par l’adjonction après l’arti- cle 6.3 de ce qui suit : 6.4(1) In this section, “tobacco” includes the package in which tobacco is sold. 6.4(1) Au présent article, « tabac » s’entend également du paquet dans lequel le tabac est vendu. 6.4(2) No person shall display or permit the display of tobacco in any place or premises in which tobacco is sold or offered for sale at retail 6.4(2) Il est interdit, dans un endroit ou un local où du tabac est vendu ou mis en vente au détail de le mettre en montre ou de permettre qu’il soit mis en montre comme décrit aux alinéas suivants : (

a) by any means or in any manner, including the use of a countertop or wall display, that permits a consumer in the place or premises to view tobacco before pur- chasing it, or

a) par tout moyen ou d’une manière, que ce soit avec des présentoirs sur comptoir ou sur étalage mural, qui permet au consommateur se trouvant dans le local ou dans l’endroit de voir le tabac avant de l’acheter; (

b) by any means or in any manner that makes to- bacco visible to the public from the outside of the place or premises.

6.5(1) No person shall advertise or promote the sale or use of tobacco in any place or premises in which tobacco is sold or offered for sale at retail. 6.5(1) Il est interdit de faire la publicité du tabac ou d’en faire la promotion pour la vente ou la consommation dans un local ou endroit où du tabac est vendu ou mis en vente au détail. 6.5(2) No person shall advertise or promote the sale or use of tobacco by means of an advertisement or promo- tional material in any place or premises in which tobacco is sold or offered for sale if the advertisement or promo- tional material is placed so that it is visible from the outside of the place or premises. 6.5(2) Il est interdit, dans un endroit ou un local où du tabac est vendu ou mis en vente, de faire la publicité du tabac ou d’en faire la promotion pour la vente ou la con- sommation avec du matériel publicitaire de façon à ce que cette publicité ou le matériel publicitaire puisse être vu de l’extérieur. 6.5(3) Notwithstanding subsection (1), a person may in any place or premises in which tobacco is sold or offered for sale at retail 6.5(3) Nonobstant le paragraphe (1), une personne peut dans tout endroit ou local où du tabac est vendu ou mis en vente au détail, faire ce qui suit : (

a) display a sign that lists the types of tobacco for sale and their prices, if the sign complies with and is displayed in the manner, place, form and size prescribed by regulation, or

a) afficher les listes des types de tabac en vente ainsi que leurs prix si l’affichage répond aux prescriptions des règlements, (

b) display a magazine or other publication that is of- fered for sale and that contains tobacco advertising if the magazine or publication

b) mettre en montre un magazine ou autre publication mise en vente et qui contient de la publicité sur le tabac si elle répond aux critères suivants : (

i) is displayed in such a way that the tobacco ad- vertisement is not visible to a consumer unless he or she is reading the magazine or publication, and (

i) elle est mise en montre d’une manière que la publicité ne puisse être vue par le consommateur à moins qu’il ne feuillette le magazine ou la publica- tion, (ii) meets the requirements set out in the Tobacco Act (Canada) or the regulations made under that Act. EXPLANATORY NOTES NOTES EXPLICATIVES

Section 1 The existing provision is as follows:

Article 1 Texte de la disposition actuelle : 6.2 No person shall sell or offer for sale tobacco in a retail store by means of a display that permits a person to handle the tobacco before paying for it. 6.2 Nul ne doit vendre ou offrir à la vente du tabac dans un magasin de vente au détail en exposant le tabac de façon que les personnes puis- sent le prendre avant de le payer.
