i EXPLANATORY NOTE NOTE EXPLICATIVE The Bill would repeal the Employment Standards Act , which establishes minimum terms and conditions of employment, and replace it with the Employment Standards Act, 2000. It would also repeal certain related employment law statutes.

Most of t he existing employment standards that are found in the Employment Standards Act will also be contained in the Employment Standards Act, 2000 . However, almost all of the provisions have been reworded in an attempt to make the new legislation easier to read and understand. Numerous admini s- trative and housekeeping changes have also been made.

In a few cases, there are significant differences between what the existing Act provides for and what the new Act will pr o- vide for. Those changes are as follows: Dans quelques cas, il existe des différences importantes entre ce que prévoient la loi existante et la nouvelle loi.

Les modif i- cations en question sont les suivantes : Employers would be required to post material prepared by the Ministry that describes the rights and responsibilities of e m- ployees and employers. Employers would be allowed to pay wages by direct deposit. The Act would also now provide that an otherwise proper d e- duction would be invalid if it were required to be remitted to a third person and this was not done.

The amount of wages that would have priority over the claims of all other unsecured creditors of an employer would be increased from $2,000 to $10,000.

The proposed Act would allow employees to refuse daily and weekly hours of work in excess of eight hours (or the e mploy- ee’s regular day if more than 8 hours) and 48 hours, r espec- tively. The Act would all ow revocable agreements in writing for employees to work further hours up to a maximum of 60 hours per week. The Act would continue to require a 30 - minute meal break, but allow this to be broken into shorter periods if the employee agreed and he or she sti ll received a total of 30 minutes for eating.

Employers would be required to allow employees daily and weekly rest periods. Both the limits on hours of work and the requirement to provide a free period would be subject to an emergency exception. Employers and employees would be able to agree to average overtime over a period of up to four weeks.

They would also be able to agree that the overtime pay be taken as time off in lieu. Qualifying conditions would be eliminated for public holidays, with two exceptions. First, an employee would have to work the scheduled shifts before and after the holiday in order to be entitled to pay for the public holiday.

Second, an employee would not be entitled to be paid for the public holiday if he or she had agreed to work it and then failed to do so. Neither exception would apply where the employee had reasonable cause for not working. Under the new Act, vacation ti me could be taken in single days off at a time if the employee requested it in writing.

Parental leave would be increased from the current 18 weeks to 35 weeks, if the employee took pregnancy leave, and 37 weeks if the employee did not.

The new Act would also pr o- vide for up to 10 days’ emergency leave a year for employees whose employers regularly employ 50 or more employees; the leave could be taken because of personal medical reasons or the death or illness of a child, spouse, same -sex partner and certain other specified relatives.

The wording in the notice of termination and severance pay provisions of the current Act has been revised to improve clari- Le libellé des dispositions de la loi actuelle concernant le pr éa- vis de licenciement et l’indemnité de cessation d’emploi a été

ii ty. An employee who is on temporar y lay-off could no longer be considered to have had his or her employment terminated merely because he or she was not provided with a recall date at the time of lay-off. révisé pour le rendre plus clair.

The new Act would provide for a new general anti -reprisal provision which can be enforced by an order for reinstatement or compensation of an employment standards officer. (Prev i- ously, the prohibition against reprisals could only be en forced through prosecution.) Officers could also issue a notice of contravention against an employer where a violation was found; the notice would impose a monetary penalty on an e m- ployer if the employer did not apply for review by the Ontario Labour Rela tions Board or if the notice was reviewed and upheld.

The maximum fine under the Act for an individual would r e- main at $50,000; however, corporations would be subject to a maximum $100,000 fine for a first offence, and would be su b- ject to increasing fines for subsequent offences. The max i- mum jail term that could be imposed by the court on an ind i- vidual would be increased from six to 12 months. Failure to comply with a reinstatement order made by a court would be subject to a fine of $2,000 a day for each day during which the employer failed to comply or if the employer is a corporation, $4,000 a day.
