Traffic Safety Act

OPERATOR LICENSING AND VEHICLE CONTROL

AMENDMENT REGULATION

section 100(

c) of the Traffic Safety Act.

1 The Operator Licensing and Vehicle Control Regulation

(AR 320/2002) is amended by this Regulation.

2 The following is added after

section 43:

24 hour notice of disqualification

43.1(1) Where a peace officer requires a driver to surrender the

driver's operator's licence under

section 89 of the Act, the peace

officer shall

(

a) serve a notice of disqualification on the driver, and

(

b) notify the Registrar of the service by

(

i) sending a copy of the notice to the Registrar,

(ii) transmitting the information in the notice to the

Registrar by electronic means, or

(iii) a method of notification satisfactory to the Registrar.

(2) A notice referred to in subsection (1) must be in the appropriate

form in

Schedule 1.

IMPORTANT INFORMATION

DISQUALIFICATION OF DRIVING PRIVILEGES

Your privilege to operate a motor vehicle in the Province of Alberta

has been disqualified pursuant to

section 89 of the Traffic Safety Act.

This action has been taken because a peace officer reasonably

suspected that you had consumed alcohol or otherwise introduced into

your body any alcohol, drug or other related substance that may have

affected your physical or mental ability to safely operate a motor

vehicle.

A peace officer has required that you surrender your operator's licence.

Refusal or failure to surrender your operator's licence does not prevent

the disqualification from driving from taking effect.

RETURN OF OPERATOR'S LICENCE AFTER 24 HOUR

DISQUALIFICATION

The law enforcement agency responsible for the issuance of this 24

hour operator licence disqualification is responsible for the return of

your operator's licence, if surrendered.

RECORD OF DISQUALIFICATION

This information is collected under the authority of the Traffic Safety

Act to administer the 24-hour Driver Disqualification Program, and

will be provided to the Registrar of Motor Vehicles and added to your

driving record. This information may also be used by the Alberta

Transportation Safety Board in relation to any review conducted by

that Board.

4 This Regulation comes into force on June 1, 2011.

3 The Canmore Undermining Review Regulation

(AR 114/97) is amended in

Schedule 2 by striking out "the

Land Status Automated System (LSAS) maintained by the Minister of

Sustainable Resource Development" and substituting "either the

Alberta Mineral Information system maintained by the Minister of

Energy or the Geographic Land Information Management and

Planning System maintained by the Minister of Sustainable Resource

Development".

AMENDMENT REGULATION

1 The Child and Family Services Authorities

Responsibilities Regulation (AR 188/2004) is amended by

this Regulation.

Section 3 is amended by adding the following after

subsection (3):

(4) Where the director under the Child Care Licensing Act delegates

to the chief executive officer the authority to enter into family day

home agreements under

section 25 of that Act, the chief executive

officer is responsible for the approving, monitoring and enforcement

of those agreements, and may not delegate the authority to sign those

agreements.
