WHEREAS the N.B. Podiatry Assoc. Inc. prays that it be enacted as hereinafter set forth; Attendu que l’Association de podiatrie du N.-B. Section 2 of

An Act Respecting Podiatry,

chapter 101 of the Acts of New Brunswick, 1983, is amended 1 L’article 2 de la Loi concernant la podiatrie, chapi- tre 101 des Lois du Nouveau-Brunswick de 1983, est modifié (

a) in subsection (1) by adding the following defi- nitions in alphabetical order:

a) au paragraphe (1), par l’adjonction des défini- tions qui suivent selon l’ordre alphabétique : “administer” means the direct application of a sub- stance to the body of a patient by ingestion, application, inhalation, injection, or any other means; (administrer) “drug” includes any substance or mixture of substan- ces manufactured, compounded, sold or represented for use in: (

a) the diagnosis, treatment, mitigation or preven- tion of a disease, disorder or abnormal physical state, or its symptoms, in human beings or animals; or (

b) restoring, correcting or modifying organic func- tions in human beings or animals; but is limited to those substances enumerated in the by- laws, rules or regulations; (médicaments) « administrer » signifie l’application directe d’une substance sur le corps d’un patient par ingestion, appli- cation, inhalation, injection ou par tout autre moyen; (administer) « médicaments » s’entend de toute substance ou mé- lange de substances fabriqués, composés, vendus ou pré- sentés comme pouvant être utilisés :

“Minister” means the Minister of Health and includes any person designated by the Minister to act on the Min- ister’s behalf; (ministre) “podiatry” means the practice of podiatry and in- cludes that field of medicine which strives to improve the overall health and well-being of patients by focusing on preventing, diagnosing and treating conditions associ- ated with the foot and ankle by practising on the lower extremities using modalities which may include medical, biomechanical and surgical means; (podiatrie) mais se limite aux substances énumérées dans les règle- ments administratifs, les règles ou les règlements; (drug) « ministre » désigne le ministre de la Santé du Nouveau-Brunswick, et s’entend également de toute per- sonne qu’il désigne pour le représenter; (Minister) « podiatrie » désigne l’exercice de la podiatrie et s’en- tend également du domaine de la médecine qui vise à améliorer la santé et le bien-être des patients en mettant l’accent sur la prévention, le diagnostic et le traitement des affections du pied et de la cheville en assujettissant les membres inférieurs à des modalités qui peuvent com- prendre des moyens médicaux, biomécaniques et chirur- gicaux; (podiatry) (

b) by adding after subsection (2) the following:

a) prescribing drugs designated in the by-laws, rules or regulations;

Section 6 of the Act is amended 2 L’article 6 de la Loi est modifié (

a) by repealing subsection (1) and substituting the following:

e) designating the substances that may be adminis- tered by injection or inhalation by members of the as- sociation;

f) regulating and governing the administration of substances by injection or inhalation by members of the association and ancillary matters, including, with- out limiting the generality of the foregoing:

i) setting requirements respecting the adminis- tration of substances, (

g) designating the drugs that may be prescribed by members of the association in the course of engaging in the practice of podiatry;

h) setting requirements for prescribing drugs and governing the purposes for which, or the circumstan- ces under which, drugs may be prescribed;

i) requiring any member of the association to have as a condition of membership professional liability in- surance and prescribing the amount of such insurance;

j) respecting the term of office and conditions for appointment of the member of the council appointed pursuant to subsection 6(1.1); and

k) respecting all other matters reasonably neces- sary for carrying out this Act, for the conduct of the affairs of the association and for the guidance, gov- ernment and discipline of the members of the associa- tion, including rules of professional ethics.

13(3) Subject to the approval of the membership ob- tained pursuant to the by-laws, rules, or regulations, and the Minister obtained pursuant to subsection (4), council may make, amend or repeal by-laws, rules or regulations relating to matters respecting the prescribing of drugs, the administering of substances, education, scope of practice, entry to practice, curriculum and continuing ed- ucation. 13(3)

summary of the by-laws, rules or regulations made, amended, or repealed in the preceding year. 13(6) Le conseil transmet annuellement au ministre un résumé des règlements administratifs, règles ou règle- ments établis, modifiés, ou abrogés au cours de l’année précédente. 13(7) Notwithstanding the enactment of subsections (3) and (4), any by-laws, rules, or regulations of the as- sociation relating to matters enumerated in subsection (3) that were in existence immediately before the enact- ment of subsections (3) and (4) shall, to the extent that they are not inconsistent with the provisions of this Act, continue in force and effect until, and to the extent they are, superseded by by-laws, rules, or regulations made in accordance with the procedure set out in subsections (3) and (4). 13(7)
