An Act to Amend

An Act Respecting Podiatry

WHEREAS the New Brunswick Podiatry Association Inc. prays that it be enacted as hereinafter set forth; THEREFORE, Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brun- swick, enacts as follows: 1

Section 2 of

An Act Respecting Podiatry,

chapter 101 of the Acts of New Brunswick, 1983, is amended (

a) in subsection (1) by repealing the definition “po- diatrist” and substituting the following: “podiatrist” means a person who holds a current certif- icate of membership in the association and is certified to practice podiatry, acupuncture of the foot and massage in connection therewith and includes a chiropodist. (

b) by repealing subsection (2) and substituting the following: 2(2) The practice of podiatry does not include amputa- tion of, or treatment of, or injuries to, or infection of the hands or fingers. chapitre 101 des Lois du Nouveau-Brunswick de 1983, est modi- fié :

a) au paragraphe (1), par l’abrogation de la défini- tion « podiatre » et son remplacement par ce qui suit : « podiatre » désigne une personne qui détient un certi- ficat valide de membre de l’association et qui est attestée comme pouvant exercer la podiatrie, l’acuponcture du pied et tout massage connexe et désigne aussi un podolo- gue.

b) par l’abrogation du paragraphe (2) et son rem- placement par ce qui suit : 2(2) L’exercice de la profession de podiatre ne com- prend pas l’amputation des mains ou des doigts ni le trai- tement des blessures ou des infections de ces membres.

2 Projet de loi 52 Loi modifiant la Loi concernant la podiatrie 2 Subsection 15(1) of the Act is amended (

a) by striking out the word “shall” and substituting the word “may”; (

b) by striking out the words “, in each year,”; and (

c) by striking out the words “one regular examina- tion, and such supplemental examinations” and sub- stituting the words “regular examinations and supple- mental examinations”. 3 Subsection 15(2) of the Act is amended by striking out the words “The examinations” and substituting the words “Any New Brunswick examinations”. 4 Subsection 15(3) of the Act is repealed and the fol- lowing is substituted: 15(3) The fee for a regular examination is five hundred dollars and the fee for a supplemental examination is one hundred dollars and these fees shall be paid in advance to the association. 15(4) The association will set the fees for regular and supplemental examinations by resolution at the annual general meeting. 5

Section 16 of the Act is amended by striking out the words “, in order to be admitted to the regular examina- tion,”. 6 Subsection 17(2) of the Act is amended by striking out the word “examination”. 7 Subsection 18(1) of the Act is amended by striking out the word “shall” and substituting the word “may”. 8

Section 20 of the Act is repealed and the following is substituted: 20 Subject to payment of the registration fee, the regis- trar shall enter in the register the required particulars re- specting each applicant who has been certified by the reg- istrar as having satisfactorily passed the New Brunswick or a Canadian provincial examination considered equiva- lent by the council and who has produced satisfactory ev- idence of his or her identity as being a person so certified, as well as evidence that he or her is at least twenty-one years of age and of good moral standing. 2 Le paragraphe 15(1) de la Loi est modifié :

a) par la suppression de « doit » et son remplace- ment par «p e u t»;

b) par la suppression de « , chaque année, »;

c) par la suppression de « un séance d’examen ordi- naire et d’examens de reprise » et son remplacement par « des séances d’examens ordinaires et d’examens de reprise ». 3 Le paragraphe 15(2) de la Loi est modifiée par la suppression de « examens » et son remplacement par « examens du Nouveau-Brunswick ». 4 Le paragraphe 15(3) de la Loi est abrogé et remplacé par ce qui suit : 15(3) Les droits d’examen, payables d’avance à l’asso- ciation, sont de cinq cents dollars pour un examen ordi- naire et de cent dollars pour un examen de reprise. 15(4) L’association fixe les droits d’examen pour les examens ordinaires et les examens de reprise par voie de résolution à l’assemblée générale annuelle. 5 L’article 16 de la Loi est modifié par la suppression de « Pour être admis à l’examen ordinaire, chaque » et son remplacement par « Chaque ». 6 Le paragraphe 17(2) de la Loi est modifié par la sup- pression de « d’examen ». 7 Le paragraphe 18(1) de la Loi est modifié par la sup- pression de « doit » et son remplacement par «p e u t». 8 L’article 20 de la Loi est abrogé et remplacé par ce qui suit : 20

Sous réserve du versement du droit d’inscription, le secrétaire-général inscrit au registre les renseignements requis relatifs à chaque candidat qui, sur l’attestation du secrétaire-général, a réussi l’examen de podiatrie du Nouveau-Brunswick ou un examen d’une autre province du Canada que le conseil considère équivalent et qui a fourni une preuve satisfaisante de son identité à

titre de personne ayant fait l’objet de l’attestation ainsi que la preuve de bonne moralité et celle attestant qu’il est âgé de vingt et un ans ou plus.

Section 28 of the Act is repealed and the following is substituted: 28 The initial registration fee for an applicant for a membership in the association is eight hundred dollars and seven hundred dollars per annum for an annual mem- bership fee for each and every year thereafter. 28.1 The association will set the initial registration fee and the annual membership fee by resolution at the annual general meeting. 9 L’article 28 de la Loi est abrogé et remplacé par ce qui suit : 28 Le droit d’inscription initial pour un candidat qui de- mande à être membre de l’association est de huit cent dol- lars et par la suite la cotisation annuelle de membre est de sept cent dollars pour chaque année suivante. 28.1 L’association fixe le droit d’inscription initial et la cotisation annuelle de membre par voie de résolution adoptée à l’assemblée générale annuelle.
