An Act to Amend the Municipalities Act Loi modifiant la

Loi sur les municipalités Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et avec le consentement de l’As- semblée législative du Nouveau-Brunswick, édicte : 1

Section 190.01 of the Municipalities Act,

chapter M-22 of the Revised Statutes, 1973, is amended 1 L’article 190.01 de la

Loi sur les municipalités, cha- pitre M-22 des Lois révisées de 1973, est modifié (

a) in subsection (1) of the French version in the portion preceding paragraph a) by striking out “qu’il possède” and substituting “qui lui appartiennent”;

a) au paragraphe (1) de la version française, au passage qui précède l’alinéa a), par la suppression de « qu’il possède » et son remplacement par « qui lui appartiennent »; (

b) by adding after subsection (1) the following:

b) par l’adjonction de ce qui suit après le paragra- phe (1) : 190.01(1.1) No person shall permit a building or struc- ture owned or occupied by him or her to become a hazard to the safety of the public by reason of being vacant or unoccupied. 190.01(1.1) Nul ne doit tolérer qu’un bâtiment ou une construction dont il est propriétaire ou qu’il occupe de- vienne dangereux pour la sécurité du public du fait de son inhabitation ou de son inoccupation. (

c) in subsection (2) of the French version by strik- ing out “qu’il possède ou occupe” and substituting “qui lui appartiennent ou qu’il occupe”;

Section 190.021 of the Act is amended 2 L’article 190.021 de la Loi est modifié (

a) by adding after subsection (3) the following:

section 190.011 arising out of a condition mentioned in subsection 190.01(1.1), the municipality that gave the no- tice shall have the burden of proving that the building or structure has become a hazard to the safety of the public by reason of being vacant or unoccupied. 190.021(3.1) Sur appel concernant l’avis que prévoit l’article 190.011 découlant d’une situation mentionnée au paragraphe 190.01(1.1), il incombe à la municipalité d’où émane l’avis de prouver que le bâtiment ou la construction en question est devenu dangereux pour la sécurité du pu- blic du fait de son inhabitation ou de son inoccupation. b) in subsection (6)

Section 190.04 of the Act is amended 3 L’article 190.04 de la Loi est modifié (
