EXPLANATORY NOTE NOTE EXPLICATIVE The Municipal Councils and School Boards Elections Act is amended to enable adult residents of a reserve to participate in electing school trustees. Residents of a reserve in southern Manitoba will vote in the neighbouring school division or school district. If a reserve neighbours more than one school division or school district, the residents will vote in the school division or school district specified in the regulations, as requested by the band.

If a reserve includes reserve lands in an urban municipality, residents of that reserve land will vote in a school division or school district that includes the urban municipality. For the northern school division, The Public Schools Act is amended to enable a reserve to be included in an area or ward of that division. Residents of the reserve will then be eligible to participate in the election of a local school committee. Amendments are also made to enable a resident of a reserve to be a candidate in an election of school trustees.

The existing provisions that enable a reserve to be established as a separate ward of a school division are not affected by these amendments. La

WHEREAS a strong public school system is a fundamental element of a democratic society; AND

WHEREAS democratic local school divisions and districts play an important role in providing public education that is responsive to local needs and conditions; AND

WHEREAS parents have a right and a responsibility to be knowledgeable about and participate in the education of their children; AND

WHEREAS residents of reserve lands have generally been excluded from voting in school board elections even though students who live on reserve have been essential members of the school community; AND

Northern school division excluded 21.1(4) Subsection (3) does not apply to the residents of a reserve that is entirely bounded by the northern school division as established under

section 14 of The Public Schools Act, and the northern school division is not to be included when determining which school divisions bound the territory of a reserve. Regulations 21.1(7) For the purpose of rule 4 of subsection (3) and clause (6)(b), the minister responsible for the administration of The Public Schools Act may make regulations prescribing the applicable school division or school district for a reserve or reserve lands within an urban municipality. i) an actual resident of the reserve, or (ii) in the case of a resident of a reserve under subsection 21.1(6) of The Municipal Councils and School Boards Elections Act, an actual resident of the reserve lands within the urban municipality, and will have been so for a period of at least six months at the date of the election; and (

d) is not disqualified under any other provision of this Act or under any other Act, and is not otherwise by law prohibited, from being a trustee or from voting at elections in the school division or school district. section 21.1 of The Municipal Councils and School Boards Elections Act, the school division or school district or the reserve. 9

PART 3 TRANSITIONAL AND COMING INTO FORCE

section 2 of this Act, such an amendment is required to ensure that each ward represents approximately the same number of eligible voters.
