B.C. Reg. 69/2012 , deposited March 30, 2012, pursuant to the PUBLIC HEALTH ACT [sections 111 (1) (

b) and (

f) and 115 (

a) and (b)]. Order in Council 189/2012, approved and ordered March 29, 2012.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective March 31, 2012,

(

a) section 5 of the Public Health Act Transitional Regulation, B.C. Reg. 51/2009, is repealed,

(

b) the Food Premises Regulation, B.C. Reg. 210/99, is amended as set out in

Schedule 1, and

(

c) the Health Act Fees Regulation, B.C. Reg. 274/92, is amended as set out in

Schedule 2.

Schedule 1

Section 1 of the Food Premises Regulation, B.C. Reg. 210/99, is amended by repealing the definition of "health official" .

2 The following

section is added to

Part 1:

Prescribed health hazards and regulated activities

2.1

(1) The following are prescribed as health hazards:

(

a) conditions that may cause food to be contaminated;

(

b) potentially hazardous food.

(2) The operation of food premises is prescribed as a regulated activity.

3 Sections 3, 7, 8 (2) to (4), 10 (1) and 25 (2) (

c) are amended by striking out " health official " wherever it appears and substituting " health officer ".

Section 3 (3) is amended by striking out " may approve " and substituting " may approve, by issuing a permit to the applicant, ".

Section 6 is amended

(

a) in subsection (1) (

b) by striking out " that approval. " and substituting " the permit issued under that section. ", and

(

b) by repealing subsections (2) and (3).

Section 8 (2) (

a) is amended by striking out " on a form provided by the minister ".

Schedule 2

Section 1 of the Health Act Fees Regulation, B.C. Reg. 274/92, is amended

(

a) in the definition of "mobile food service unit" by striking out " as defined in

section 1 of B.C. Reg. 148/74, the Sanitation and Operation of Food Premises Regulations ",

(

b) by repealing the

definitions of "operating permit" , "proprietor" and "restaurant" and substituting the following:

"operating permit" means an operating permit issued under

section 8 of the Food Premises Regulation, B.C. Reg. 210/99;

"proprietor" means an operator of a food service establishment;

"restaurant" means a food service establishment. , and

(

c) by adding the following definition:

"food service establishment" means a food service establishment within the meaning of the Food Premises Regulation, B.C. Reg. 210/99; .
