LOI SUR L’ÉVALUATION FONCIÈRE The Assessment Act currently provides an exemption fro m taxation for large non-profit th eatres. An amendment to p ara- graph 27 of subsection 3 (1) of the Act provides that the exemp- tion applies during the period when such a theatre is being built. La

Currently, subsection 14 (1) of the Act specifies the infor- mation that m ust be includ ed i n the as sessment roll for ea ch municipality. An amendment to th at subsectio n provides that the assessment roll m ust include such add itional information as may be prescribed by regulation.

À l’heure actuelle, le paragraphe 14 (1) de la Loi précise les renseignements qui doivent fig urer dans le rôle d’évaluation pour chaque municipalité. Subsection 19.0.1 (1) of the Act governs the determinatio n of the assessed value of gener ating station build ings and struc- tures and tr ansformer station b uildings and str uctures and cer- tain o ther buildings and struct ures.

An amend ment provides that the Minister may, by regulation, specify the assessed value of particular buildings and structures.

Currently, subsection 19.1 (1) of the Act provides that, until 2005, land is assessed at its current value for a particular taxa- tion year; that, for 2005, it is assessed as the average of its cur- rent value for 2 004 and 2005; and that, for subsequent years, it is assessed as the average of its current value for the particular taxation year and the two preceding years. An amendment to that subsection deletes the ref erences to 2005 and authorizes the Minister, b y re gulation, to spe cify the year to be used.

The regulation is void if it is filed less than 18 mo nths before the beginning of that specified year. LOI SUR LES SOCIÉTÉS PAR ACTIONS Subsection 241 (1) of the Business Corporation s Ac t au- thorizes the Director to dissolve a corporation that is in d efault of its obligations under the Corporations Tax Act in the circum- stances des cribed in that s ubsection. An amendment provides that a corporation can also b e dissolved if i t is in default of its obligations under other specified tax statutes. Le paragraphe 241 (1) de la

section 59.2 of the Commodity Futures Act pro- hibits th e makin g of misleading or untrue statements that sig- nificantly affect or would reasonably be expected to have a sig- nificant effect on the market pr ice or a value of a commodity or contract. The

section is amended so that it prohibits the making of misleading or untrue statem ents that would reasonably b e expected to have a significant effect on the market price or value of a commodity or contract. À l’heure actuelle, l’article 59.2 de la

Subsection 60 ( 2.1) of the Act provides th at, in specif ied circumstances, a person is not e ntitled to p articipate in a pro- ceeding in whic h an order m ay be made under paragraph 10 o f subsection 60 ( 1) against ano ther person to disgorge amounts obtained as a r esult of non-complian ce. An amendment pro- vides that , in the s pecified c ircumstances, a p erson is als o not entitled to participate in a proc eeding in which an order may be made under paragraph 9 of su bsection 60 (1) against anothe r person to pay an administrative penalty.

section 16 .1 of the Community Smal l Business Investment Funds Act changes the annual d ate o n which a labour sponsored investment fund that is a research oriented investment fund measur es its compliance with the pro- gram’s pacing requirements. The date is changed from Decem- ber 31 to e ither August 31 or Decem ber 31, whichever is o f most benefit to the research oriented investment fund. La modification apportée à l’article 16.1 de la

Loi sur le s fonds communautaires d’investisse ment dans les petites ent re- prises modifie la date annu elle à laquelle un fonds d’investisse- ment des travailleurs qui est un fonds d’investissement axé sur la recherche évalue dans quelle mesure il s e conforme aux ex i- gences du progr amme relatives au rythme des investissements. Sections 18 and 20 of the Act are amended to permit labou r sponsored investment funds to control eligible investments.

Section 18.1 of the Act is amended to permit labour sponsored investment fund s to incre ase th eir investm ent in listed compa- nies. It is also amended to in crease the maximum asset size of an el igible busi ness for the pur poses of the sm all busin ess in- vestment requirement from $5 million to $6 million. Les articles 18 et 20 de la Loi sont modifiés pour autorise r les fonds d’investissement des tr availleurs à contrôler les inves- tissements a dmissibles e t l’a rticle 18.1 de la Loi est modifié pour les au toriser à accro ître leurs investissements dans des so- ciétés cotées.

section 18.5 of the Act extends the dead- line for registering a community small business investment fund from December 31, 2003 to December 31, 2004. Consequential amendments are made to sections 24.1 and 25 of the Act. Une modification apportée à l’article 18.5 de la Loi reporte du 31 décembre 2003 au 31 décembre 2004 la d ate limite pour inscrire un fond s communautaire d’investissement dans les pe- tites ent reprises. Section 18.5 of the Act is al so amended to eliminate the requirement th at, in order for a com munity sm all business in- vestment fund to qualify under the Act, a financial institution or labour sponsored investment fund invest in it. L’article 18.5 de la Loi est également modifié pour éliminer l’exigence voulant qu’une institution finan cière ou un fonds d’investissement des trav ailleurs investisse d ans un fonds com- munautaire d’in vestissement dans les petites e ntreprises pou r que ce dernier puisse être inscrit en vertu de la Loi.

An am endment to s ection 24.1 of the Act reduces the amount invested in a community small business investment fund by a labour sponsored investment fund that the labour sponsored investment fund is permitted to apply against its own investment pacing requirements. Une modification apportée à l’article 24.1 de la Loi réduit le montant inv esti par un fonds d’ investissement d es trav ailleurs dans un fonds communautaire d ’investissement dans les petites entreprises qu’il peut inclure da ns les investissements qu’il doit faire.

Sections 25 and 28.1 of the Act are amended to increase the incentives available to individu al investors and certain corpora- tions for investing in a comm unity small business investment fund. The in centives are increased from a maximum of 15 per cent to a maximum of 30 per cent. Les articles 25 et 28.1 de la Loi sont modifiés pour augmen- ter le montan t des stimulants dont peuvent se pr évaloir les in- vestisseurs qui sont de s

LOI SUR L’IMPOSITION DES CORPORATIONS The new sectio n 13.7 of the Corporations Tax Act es tab- lishes a tax incentive for corporations with qualifying facilities for self-generated electricity. S ection 13.8 is also enacted and complementary amendments are m ade to sectio ns 1, 13.6 , 14 and 35 of the Act. Le nouvel

section 43.9 of the Act respecting the Ont ario busi ness-research institute tax cr edit. An amend- ment allows a c orporation to claim the tax credit for the per iod during a taxation year that the corporation is not connected to an eligible r esearch institut e. Subsect ion 43.9 (26) provides tha t wages paid under a research contract to a related employee are not perm anently dis qualified from the tax credi t. Thes e amendments are made r etroactive to May 7 , 1 997.

The new subsection 43.9 (25.1) provides that interest is no t payable on a corporation’s tax savings from these amendments for t axation years ending before March 28, 2003. Des modifications sont apportées à l’article 43.9 de la Loi à l’égard du créd it d’impôt de l’Ontario pour les entreprises par- rainant les instituts de recherche. Une modification autorise une corporation à d emander le créd it pour la p ériode d’une année d’imposition pendant laquelle elle n’est pas ra ttachée à un insti- tut de recherche admissible.

Le paragraphe 43.9 (26) prévoit que le s alaire vers é à un em ployé li é aux termes d’ un contrat d e recherche n’ est pas exclu du cr édit d’im pôt de façon perm a- nente. Ces mod ifications sont rétroactiv es au 7 mai 1997. Le nouveau p aragraphe 43.9 (25.1 ) prévoit qu’ aucun intérêt n’est payable sur les impôts qu’économise une corporation , par suite de ces modifications, pour les années d’imposition qui se term i- nent avant le 28 mars 2003. per cent for businesses with pay rolls of $400,000 or less) on the wages and salar ies paid after March 27, 2003 b y a corporation or partnership in respect of an apprentice employed in a qualify- ing apprenticeship. The m aximum tax credit ava ilable for eac h apprentice is $ 6,000 over a 24-month emplo yment p eriod.

Complementary am endments are made to sections 43.4, 44.1 , 76, 78 and 80 of the Act. de 10 pour cent (15 pour cent pour les entreprises dont la masse salariale est de 400 000 $ ou moins) sur les salaires et les traite- ments qu’une corporation ou u ne société de p ersonnes verse après le 27 mars 2003 à l’égard d’un apprenti employé dans le cadre d’un apprentissage admissible. Des modifications complémentaires sont apportées aux articles 43.4, 44.1, 76, 78 et 80 de la Loi. Amendments to sections 66, 66.1 and 69 of the Act reduce the capital tax rate on a corporat ion’s taxable paid-up capital or its taxable paid-up capital employed in Canada by 10 p er cent on and after January 1, 2004. Des modifications apportées aux articles 66, 66.1 et 69 de la Loi réduisent de 10 pour cent à partir du 1er janvier 2004 le taux de l’impôt qu’u ne corporation doit pa yer s ur s on capi tal v ersé imposable ou son capital versé imposable utilisé au Canada.

An amendment to subsection 66.1 (4.5) of the Act extends the dead line for investing in a community sm all business in- vestment fund from December 31, 2003 to December 31, 2004. Une modificatio n apportée au p aragraphe 66.1 (4.5) de la Loi reporte du 3 1 décembre 2003 au 31 déc embre 2004 la d ate limite pour investir dans un fon ds communautaire d’investisse- ment dans les petites entreprises. Technical amendments are m ade to the Act. The new s ub-

section 11 (12.1) of the Act relates to the deductibility of foreign non-business income tax paid by a corporation. Amendments to clause 62 (1) (

c) rela te to the d etermination of the inv estment allowance for capital tax purposes. Des modificatio ns de forme so nt apportées à la Loi. Technical amendments are also made to the recurring defi- nitions of “Ontario allocation factor” throughout the Act. SCHEDULE F AMENDMENTS TO THE ELECTRICITY ACT, 1998

ANNEXE F MODIFICATION DE LA LOI DE 1998 SUR L’ÉLECTRICITÉ Currently, sectio n 92 of the Electricity Act , 1998 requires Hydro One Inc., Ontario Power Generation Inc., their subsidiar- ies and ever y municipal electricity utility to make payments in lieu of property taxes to the Financial Corporation for land con- taining generating station buildings or structur es or tr ansformer station bu ildings or structur es. An amendment to

section 92 provides that, if the land is ex empt from taxation under

section 3.1 of the Assessment Act, no pay ment in lieu of property taxes is required under

section 92. À l’heure actuelle, l’article 92 de la Loi de 1998 sur l’élec- tricité exige qu e H ydro One I nc., Ontar io Po wer Gener ation Inc., leurs filiales et les services municipaux d’électricité versent à la S ociété financière des paiements tenant lieu d’impôts fon- ciers à l’ég ard de biens-fonds sur lesquels sont s itués des b âti- ments ou des co nstructions qui abritent une centrale électrique ou un poste de transformation. Une modification apportée à l’article 92 prévoit qu’aucun paie ment tenant lieu d’impôts fon- ciers n’a besoin d’être versé en application de cet

article si les biens-fonds sont exemptés d’ impôt en application de l’article 3.1 de la

Loi sur l’évaluation foncière.

SCHEDULE G AMENDMENTS TO THE INCOME TAX ACT

ANNEXE G MODIFICATION DE LA LOI DE L’IMPÔT SUR LE REVENU Amendments are m ade to subsection 3 (1) of the Income Tax Act to increase the threshold at which Ontario taxpayers are required to pay the provincial surtax. Effective January 1, 2004, the s urtax wil l become pa yable when Ontar io income tax ex- ceeds $4,727, as adjusted for inflation. Th is threshold will b e increased to $5 ,240 as of Januar y 1 , 2005. Consequential amendments are made to

section 4.0.2 of the Act with respect to indexing. Des modifications sont apport ées au paragr aphe 3 (1) de l a Loi de l’ impôt sur le rev enu p our relever le seuil auquel les contribuables ontariens sont te nus de pay er l’impôt supplémen- taire provincial. À compter du 1 er janvier 2004, l’impôt supplé- mentaire dev iendra exigibl e lo rsque l’impôt su r le revenu de l’Ontario dépasse 4 727 $, rajusté en fonction de l’inflation. C e seuil sera porté à 5 240 $ le 1 er janvier 2005. Des modifications corrélatives sont apportées à l’ar ticle 4.0.2 de la Loi en ce qui concerne l’indexation.

Sections 4 and 4.0.1 of the Act are amend ed, effective January 1, 2003, to increase the amount available to indiv iduals under th e disability credit, the caregiv er cr edit, the inf irm de- pendant credit and the disability credit supplement for ch ildren with severe disa bilities.

Am endments to sectio ns 4 and 4.0.1 also extend the caregiver credit and the infirm dependant credit to include spouses or common-law partn ers who are depend ent on an individual by reason of a mental or physical infirmity and to provide more support to caregivers living apart from spouses, common-law partners, children or grandchildr en who are de - pendent. Consequential amend ments are als o m ade to s ection 4.0.2 of the Act with respect to indexing.

Les articles 4 et 4.0.1 de la Loi sont modifiés pour augmen- ter, à compter du 1er janvier 20 03, le montan t que peuvent dé- duire les parti culiers au titr e du crédi t pour personnes handica- pées, du crédit pour aidants naturels, du crédit pour personnes à charge atteintes d’incapacité et du crédit s upplémentaire pou r personnes handicapées à l’égard des enfants qui ont un handicap grave.

Des modifications corrélatives s ont également apportées à l’ar- ticle 4.0.2 de la Loi en ce qui concerne l’indexation. iii

An am endment to s ubsection 7 (2.4) of the Act increas es the amount of the Ontario basic reduction for 2 004 and subse- quent years to $197, as adjusted for inflation. Section 8 of the Act is amended and a new

section 8.4.5 is enacted to prov ide an appr enticeship tax cred it t o eligib le em - ployers in re spect of sa lary and wages paid to apprentices em- ployed in qualif ying appr enticeships. The tax c redit is 10 p er cent (15 p er cent for busin esses with pay rolls of $400,000 o r less) of the wages and salaries p aid after March 27, 2003 by an eligible employer in respect of a qualifying apprenticeship. The maximum tax credit available for each apprentice is $6,000 over a 24-month employment period. L’article 8 de la Loi est modifié et le nouvel

article 8.4.5 est édicté pour offr ir un crédit d’ impôt pour l’ apprentissage aux employeurs admissibles à l’égard des traitements et des salaires qu’ils versent aux apprentis employés dans le cadre d’apprentis- sages admissibles. An am endment to s ubsection 8. 5 (5) of the Act increas es the threshold at which an individual’s entitlement to the Ontario Child Care Supplement for Working Fam ilies is reduced. Be- ginning in July 2003, this threshold is increased from $20,000 to $20,750 of family net income.

Currently, th e Schedul e lists th e special limitation periods i n specified provisions of the Securities A ct th at p revail over the general limitatio n periods estab lished by the Limitations A ct, 2002. The am endment adds to that list the speci al lim itation period specified in

section 138 .14 of the Securities Act for ac- tions commenced under

section 138.3 (liability for secondar y market disclosure) of the Act. L’annexe de la Loi de 2002 sur la prescription des actions est modifiée en ce qui concerne les délais de prescription prévus par la

section 308 .1 o f the Municipal Act, 2001 authorize m unicipalities to establish a tax ratio below 0.25 fo r the managed forests property class. LOI SUR LA TAXE DE VENTE AU DÉTAIL Currently, subsection 18 (3) of the Retail Sales Tax Ac t permits the Min ister of Finan ce to assess a person for tax pay - able under the Act, but only within four years after the tax be- comes payable. Under the cu rrent Ac t, an e xception to this four-year period is made where there has been neglect, careless- ness, wilful def ault or fraud . Amendments to

section 18 of th e Act cre ate another exc eption. The am endments perm it a tax- payer to waive the four-year period by filing a waiver with the Minister. Once filed , the waiv er may be r evoked b y the tax - payer, but it continues to have effect for one year. À l’heure actuelle, le paragraphe 18 (3) de la

Loi sur la taxe de vente au détail permet au ministre des Finances d’établir une cotisation à l’égard de la taxe payable par quiconque aux termes de la Loi, mais uniquement dans les quatre an s de la date où cette taxe devient payable. Subsection 127 (3.1) of the Act provides that, in specifie d circumstances, a person is not e ntitled to p articipate in a pro- ceeding in whic h an order m ay be made under paragraph 10 o f subsection 127 ( 1) against anoth er person to disgorge amounts obtained as a r esult of non-complian ce. An amendment pro- vides that , in the s pecified c ircumstances, a p erson is als o not entitled to participate in a proc eeding in which an order may be made under par agraph 9 of subsection 127 (1) against ano ther person to pay an administrative penalty.
