OIC Text: The Governor in Council on the report and recommendation of the Minister of Education dated March 25, 2003, and pursuant to

Section 88 of

Chapter 1 of the Acts of 1995-96, the Education Act, is pleased, effective June 13, 2002, to: (

a) approve the necessary renovations to complete stage one of the remediation of the environmental and building deficiencies at Sir John A. MacDonald High School, Halifax Regional School Board, at a total cost not to exceed $4.88 million, on the terms and conditions set out in

Schedule "B" and

Schedule "C" attached to and forming part of the report and recommendation; (

b) authorize the allocation of funding in the amount of $4.88 million to cover the costs of this project to be expended in this fiscal year (2002-03); (

c) authorize the Minister of Transportation and Public Works to do whatever is necessary to acquire the land for the remediation of the school referred to in clause (

a) in the name of Her Majesty the Queen in Right of the Province of Nova Scotia, and authorize the Minister of Transportation and Public Works to tender for the necessary work to remediate the building and acquire the equipment necessary for the school as approved; (

d) authorize the Minister of Transportation and Public Works to hold the building, equipment and land for the construction of the school in clause (

a) in the name of Her Majesty the Queen in Right of the Province of Nova Scotia while the project is in progress; (

e) upon completion of the project to remediate the school referred to in clause (

a) to the satisfaction of the Minister of Transportation and Public Works and the Minister of Education, the buildings, equipment and land for the school shall be conveyed by Her Majesty the Queen in Right of the Province of Nova Scotia, as represented by the Minister of Transportation and Public Works, to the school board referred to in clause (a); (

f) authorize the Minister of Education and the Minister of Transportation and Public Works to execute such instruments as may be necessary for the purpose of this Order and authorize both or either of them to enter into an agreement with the school board referred to in clause (

a) to attain the purposes of this Order; and (

g) authorize the Minister of Education to develop an addition/alteration plan for the Sir John A. MacDonald High School and report to Executive Council concerning the timelines and funding requirements for the plan for consideration.
