Bartlett’s Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 76-842 (July 13, 1976), N.S. Reg. 133/76

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 29th day of June, A.D., 1976, and pursuant to

Section 5(1) of

Chapter 6 of the

Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act , is pleased to

designate as a beach an area of land lying landward from the mean high water mark of Bartlett’s

Beach, in the County of Digby, Province of Nova Scotia, as shown outlined in red on the copy

of Crown Land Records Office Plan No. E-5-55, marked

Schedule “B”, and described in

Schedule “A”, both attached to and forming part of the report and recommendation.

Schedule “A”

All that certain area of land lying landward from the mean high water mark of Bartlett’s Beach,

in the County of Digby, Province of Nova Scotia as shown outlined in red on a copy of Plan

No. E-5-55 attached hereto, filed in the Crown Land Records Office, Halifax and being more

particularly described as follows:

Beginning at an enheat iron post marked “No. 2” situate twenty feet above the mean high water

mark of the Atlantic Ocean;

From thence (by astronomic bearings) south seventy-four degrees eighteen minutes east nine

hundred seventy-four decimal zero feet to an enheat iron post marked “No. 3”;

Thence south twenty-five degrees two minutes east a distance of two thousand one hundred

twenty-nine feet to an enheat iron post marked “No. 4” situate on the southerly boundary of

Bartlett Inlet;

Thence westerly following the several courses of the southerly boundary of Bartlett Inlet to a

point situate at the northeast corner of a breakwater, said point being north eighty-eight degrees

forty-two minutes west a distance of seven hundred thirty decimal four feet from

beforementioned enheat iron post marked “No. 4”;

Thence south forty degrees ten minutes west four hundred forty-one decimal nine feet to a

theoretical point “B” situate in the waters of the Atlantic Ocean as shown on said Plan No.

E-5-55;

Thence north twenty-four degrees forty-five minutes west two thousand eight hundred

eighty-seven feet to a theoretical point “C” situate in the waters of the Atlantic Ocean as shown

on said Plan No. E-5-55;

Thence south seventy-four degrees eighteen minutes east a distance of four hundred feet to the

place of beginning.

Excepting and reserving from the above described area of land all the portion thereof lying

seaward from the mean high water mark.
