OIC Text: The Governor in Council on the report and recommendation of the Minister of Finance and the Minister of Natural Resources dated August 14, 2001, and pursuant to Sections 2 and 17 of
Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, is pleased to: (
a) designate as a special fund within the meaning of the Provincial Finance Act, the Crown Land Silviculture Fund, the purpose of which is to provide for silviculture on Crown lands; (
b) authorize to be paid into the Crown Land Silviculture Fund (
i) the silviculture fee portion of stumpage payable by those with agreements to harvest wood on Crown lands; (ii) income accruing to the Fund; and (
c) authorize payments out of the Crown Land Silviculture Fund in such sums as the Minister of Natural Resources deems appropriate for the following purposes: (
i) to reimburse those who have paid stumpage for wood cut on Crown lands and who have, in the opinion of the Minister of Natural Resources, satisfactorily completed an approved silviculture program on Crown lands; (ii) to pay the costs associated with conducting a silviculture program on Crown lands where those who have paid stumpage have declined or have, in the opinion of the Minister of Natural Resources, failed to satisfactorily complete an approved silviculture program on Crown lands; and (iii) for such other purposes as may be reasonably associated with those specified in paragraph c (
i) and (ii) herein.
