An Act to Amend the Metallic Minerals Tax Act Loi modifiant la Loi de la taxe sur les minéraux métalliques Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et du consentement de l’Assem- blée législative du Nouveau-Brunswick, décrète : 1 Subsection 1 (1) of the Metallic Minerals Tax Act,

chapter M-11.01 of the Revised Statutes, 1973, is amended 1 Le paragraphe 1(1) de la Loi de la taxe sur les mi- néraux métalliques,

chapitre M-11.01 des Lois révisées de 1973, est modifié (

a) by repealing the definition “date of commence- ment of production” and substituting the following:

a) par l’abrogation de la définition « date du début de la production » et son remplacement par ce qui suit : “date of commencement of production” means the day determined by the mine assessor, from information pro- vided by the Minister of Natural Resources under the Mining Act , as the first day of the three month period throughout which the mine operates, during each month of the three-month period, at sixty per cent or more of its planned capacity; « date du début de la production » désigne le jour fixé par le répartiteur minier, à partir des renseignements com- muniqués par le ministre des Ressources naturelles en vertu de la

Loi sur les mines, comme étant le premier jour de la période de trois mois pendant lesquels la mine est exploitée à soixante pour cent ou plus de sa capacité pla- nifiée et ce, durant chacun des mois de ce trimestre; (

b) by repealing the definition “Minister” and sub- stituting the following:

b) par l’abrogation de la définition « Ministre » et son remplacement par ce qui suit : “Minister” means the Minister of Finance; « Ministre » désigne le ministre des Finances; 2 Subsection 3(1) of the Act is amended by striking out “of Finance”. 2 Le paragraphe 3(1) de la Loi est modifié par la sup- pression de « ministre des Finances » et son remplace- ment par « Ministre ». 3

Section 10 of the Act is amended by adding after subsection (3) the following: 3 L’article 10 de la Loi est modifié après le paragra- phe (3) par l’adjonction de ce qui suit : 1

10(4) The Minister of Natural Resources may provide any information submitted or delivered to the Minister of Natural Resources under the Mining Act to the mine as- sessor in order for the mine assessor to determine the date of commencement of production. 10(4) Le ministre des Ressources naturelles peut com- muniquer au répartiteur minier tout renseignement qui lui a été présenté ou remis sous le régime de la

Loi sur les mines de façon à ce que le répartiteur minier puisse déter- miner la date du début de la production. 4

Section 1

Article 1 (

a) The existing provision is as follows:

a) Texte de la disposition actuelle : “date of commencement of production” means the day determined by the mine assessor, from information supplied to the Minister under the Mining Act, as the first day of the three month period throughout which the mine operates, during each month of the three-month period, at sixty per cent or more of its planned capacity; « date du début de la production » désigne le jour fixé par le répar- titeur minier, à partir des renseignements fournis au Ministre en vertu de la

Loi sur les mines , comme étant le premier jour de la période de trois mois pendant lesquels la mine est exploitée à soixante pour cent de sa capacité ou plus planifiée, durant chacun des mois de ce trimestre; (
