Cape Jack Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 76-970 (August 17, 1976), N.S. Reg. 139/76

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 27th day of July, A. D., 1976, pursuant to

Chapter 6 of the Statutes of Nova

Scotia, 1975, the Beaches Preservation and Protection Act ,

Section 5(1), is pleased to designate

as a beach an area of land lying landward from the mean high watermark of Cape Jack Beach in

the County of Antigonish, Province of Nova Scotia, as shown outlined in red on the copy of

Crown Land Records Office Plan No. E-7-68, marked

Schedule “B” and described in

Schedule

“A” both attached to and forming part of the report and recommendation.

Schedule “A”

All that certain area of land lying landward from the mean high watermark of Cape Jack Beach,

in the County of Antigonish, Province of Nova Scotia as shown outlined in red on the copy of

Crown Land Records Office Plan No. E-7-68, attached hereto and marked

Schedule “B” and

being more particularly described as follows:

Beginning at a point situate between the shoreline of Beach Pond and the road leading to the

wharf at Cape Jack, said point shown as Point “A” on said Plan No. E-7-68 and having

co-ordinates (N 16, 600, 688.616, E 981, 186.177) based on the Nova Scotia Three Degree

Transverse Mercator Projection, Zone 4, Central Meridian 61° 30' West Longitude);

From Thence (by grid bearings) south fifty-eight degrees fifty-nine minutes forty-seven

seconds west, three thousand seven hundred twenty-nine decimal seventy-two feet to a point shown as Point “B” on said plan and having co-ordinates (N 16, 598, 767.472, E 977, 989.305);

Thence north twenty-nine degrees thirteen minutes eighteen seconds west one thousand seven

hundred forty-one decimal eighty-one feet to a point situate in the waters of St. George’s Bay,

said point shown as Point “C” on said plan and having co-ordinates (N 16, 600, 287.614, E 977, 138.975);

Thence north fifty-four degrees thirty-three minutes twenty-seven seconds east four thousand

seven hundred eight decimal ninety-six feet to a point situate in the waters of St. George’s Bay,

said point shown as Point “D” on said plan and having co-ordinates (N 16, 603, 018.270, E 980, 975.356);

Thence south five degrees ten minutes fifteen seconds east two thousand three hundred

thirty-nine decimal seventeen feet to the place of beginning.

Excepting and reserving from the above described area of land all the portion thereof lying

seaward from the mean high watermark.
