OIC Text: The Governor in Council on the report and recommendation of the Minister of Transportation and Infrastructure Renewal, dated October 31, 2017, and pursuant to
Section 18 of
Chapter 371 of the Revised Statutes of Nova Scotia, 1989 the Public Highways Act , and pursuant to
Section 80 of
Chapter 156 of the Revised Statutes of Nova Scotia, 1989, the Expropriation Act , is pleased to: (
a) extinguish the right of the public to use that portion of the public highway, identified as Parcel “A”, containing an area of 871.7 square metres, more or less, located at or near Beech Hill, Antigonish County, more particularly described in
Schedule “A” and shown on
Schedule “B” attached to and forming part of the Report and Recommendation; (
b) authorize the conveyance of the parcel of surplus land to 3041249 Nova Scotia Limited, for the nominal consideration of $1.00, in exchange for a full and final release for all claims against the Province in relation to the 2009 expropriation of the lands from PID 10033579, in such form as the Minister determines; (
c) authorize the Minister of Transportation and Infrastructure Renewal to make and execute a Deed of Conveyance in such form as the Minister determines to effect the conveyance of the lands herein above described; and (
d) authorize the Minister of Transportation and Infrastructure Renewal to execute such documents as may be necessary to achieve the purpose of this Order.
