Order in Council 1273/2018

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas the Association of Ontario Judges and Treasury Board Secretariat presented a joint submission to the Ninth and Tenth Provincial Judges Remuneration Commission (the “Commission”); and

Whereas the Commission accepted the joint submission and provided its report to the Government on April 18, 2018 (the “ PJRC Report”); and

Whereas the PJRC Report contains binding recommendations that require changes to judicial salaries and benefits; and

Whereas the Report of the Eighth Provincial Judges Remuneration Commission (attached hereto as

Schedule

C) includes a

Schedule A to the Report, which sets out a list and description of administrative judges appointed prior to the date of the Report (November 12, 2013) and their beneficiaries; and

Whereas Order in Council O.C. 225/2016 sets out the salaries, benefits and expense allowances for provincial judges; and

Whereas revoking and replacing Order in Council O.C. 225/2016, rather than making an additional amending order in council, will maintain all of the salary, benefits and expense allowance provisions for provincial judges in one consolidated order in council;

And

Whereas maintaining one consolidated order in council promotes greater transparency for provincial judges and improves the ease of administration for government;

Now therefore, pursuant to

Section 27 of the

Schedule to the Courts of Justice Act , R.S.O. 1990, C.43, effective the date this Order is made,

The base salaries set out in

Schedule A to this Order and the benefits and expense allowances set out in

Schedule B to this Order are established for provincial judges; and

Order in Council O.C. 225/2016 dated February 10, 2016 is revoked.
