Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et du consentement de l’Assem- blée législative du Nouveau-Brunswick, décrète :

Definitions Définitions 1 The following

definitions apply in this Act. 1 Les définitions qui suivent s’appliquent à la présente loi. “Appeal Board” means the Designation Appeal Board established under

section 4. (Comité d’appel) “designated educational institution” means an educa- tional institution within or outside New Brunswick that offers courses at a post-secondary level and that is desig- nated by the Minister under

section 2 as a designated educational institution. ( établissement d’enseignement agréé) “direct loan” means a debt obligation incurred by a qualifying student on entering into an agreement with the Minister under subsection 15(1) and which is owed to Her Majesty in right of the Province, as represented by the Minister. (prêt direct) “family income” means the aggregate income of a per- son who has obtained a direct loan and the spouse or common-law partner of the person, including income from employment, social programs, investments and monetary gifts. (revenu familial) “financial assistance” means (

a) a direct loan, or (

b) a bursary awarded by the Minister to a qualifying student under

section 17. (aide financière) “financial assistance program” means a program re- specting direct loans, bursaries awarded by the Minister under

section 17 and, as the case may be, financial aid provided under the Canada Student Financial Assistance Act (Canada). (programme d’aide financière) “financial institution” means (

a) a bank listed in

Schedule I, II or III of the Bank Act (Canada), (

b) a credit union as defined in the Credit Unions Act, or « aide financière » S’entend :

a) d’un prêt direct;

b) d’une bourse accordée à un étudiant admissible par le ministre en vertu de l’article 17. ( financial assis- tance) « Comité d’appel » Le Comité d’appel de désignation établi en vertu de l’article 4. (Appeal Board) « Commission de révision » La Commission de révision de l’aide financière aux étudiants du postsecondaire éta- blie en vertu de l’article 25. (Review Board) « établissement d’enseignement agréé » Établissement d’enseignement situé au Nouveau-Brunswick ou ailleurs qui offre des cours de niveau postsecondaire et qui est agréé par le ministre aux termes de l’article 2. (designated educational institution) « étudiant admissible » Une personne qui satisfait les critères suivants :

a) est un citoyen canadien, un résident permanent au sens du paragraphe 2(1) de la

Loi sur l’Immigration et la protection des réfugiés (Canada) ou une personne protégée au sens du paragraphe 95(2) de la

Loi sur l’Im- migration et la protection des réfugiés (Canada);

b) est un résident du Nouveau-Brunswick;

c) est un étudiant à charge ou un étudiant indépen- dant;

d) une personne qui remplit les conditions d’inscrip- tion ou est inscrite à un programme d’études auprès d’un établissement d’enseignement agréé et entend sui- vre ou suit un programme d’études qui équivaut à 60 % au moins de la charge régulière de cours à plein temps pendant la période pour laquelle le certificat d’admis- sibilité est requis. (qualifying student) « fournisseur de services » S’entend : Post-Secondary Student Financial Assistance Act Bill 81 3

c) a loan company or trust company licensed under the Loan and Trust Companies Act . (institution finan- cière) “lender” means a financial institution with whom the Minister of Education entered into an agreement under the Youth Assistance Act before the commencement of this Act. (prêteur) “Minister” means the Minister of Post-Secondary Ed- ucation, Training and Labour and includes any person designated by the Minister to act on the Minister’s be- half. (ministre) “permanent disability” means a functional limitation caused by a physical or mental impairment that restricts the ability of a person to perform the daily activities nec- essary to participate in studies at a post-secondary level or the labour force and is expected to remain throughout the person’s life. (invalidité permanente) “qualifying student” means a person who (

a) is a Canadian citizen, a permanent resident within the meaning of subsection 2(1) of the Immigration and Refugee Protection Act (Canada) or a protected person within the meaning of subsection 95 (2) of the Immi- gration and Refugee Protection Act (Canada), (

b) is a resident of New Brunswick, (

c) is a dependent student or an independent student, and (

d) is qualified for enrolment or is enrolled at a des- ignated educational institution in a program of studies and who intends to take or is taking not less than 60% of the normal full-time course load for the period for which a certificate of eligibility is requested. (étudiant admissible) “Review Board” means the Post-Secondary Student Fi- nancial Assistance Review Board established under sec- tion 25. (Commission de révision) “service provider” means (

a) a financial institution, or (

b) any corporation incorporated under the laws of Canada or a province or territory of Canada and carry- ing on business in Canada with whom the Government of Canada has an agreement under

section 6.2 of

a) d’une institution financière;

Loi sur les compagnies de prêt et de fiducie. (financial institution) « invalidité permanente » Limitation fonctionnelle cau- sée par un état d’incapacité physique ou mentale qui réduit la capacité d’une personne d’exercer les activités quoti- diennes nécessaires pour participer à des études de niveau postsecondaire ou au marché du travail et dont la durée prévue est la durée de vie probable de celle-ci. (permanent disability) « ministre » Le ministre de l’Éducation postsecondaire, de la Formation et du Travail et s’entend également de toute personne qu’il désigne pour le représenter. (Minis- ter) « prêt direct »

(family income) DESIGNATION OF EDUCATIONAL INSTITUTIONS DÉSIGNATION D’ÉTABLISSEMENTS D’ENSEIGNEMENT Designation of educational institutions Désignation d'établissements d’enseignement 2(1) Subject to subsection (2), the Minister may, on ap- plication in accordance with the regulations and on pay- ment of the fee prescribed by regulation and in accordance with the policies and procedures established by the Min- ister, designate an educational institution, either particu- larly or as a member of a class, as a designated educational institution for the purposes of this Act and the Canada Student Financial Assistance Act (Canada). 2(1)

titre de membre d’une catégorie, aux fins de la présente loi et de la Loi fédérale sur l’aide aux étudiants (Canada). 2(2) Any designation by the Lieutenant-Governor in Council of a specified educational institution under the Youth Assistance Act that is valid and of full force and effect before the commencement of this Act is deemed to be a designation of a designated educational institution by the Minister for the purposes of this Act and the Canada Student Financial Assistance Act (Canada). 2(2) Toute désignation d’institution d’enseignement dé- signée par le lieutenant-gouverneur en conseil aux termes de la

Loi sur l’aide à la jeunesse qui était en vigueur, était valide et avait plein effet immédiatement avant l’entrée en vigueur de la présente loi est réputée être une désignation d’un établissement d’enseignement agréé par le ministre aux fins de la présente loi et de la Loi fédérale sur l’aide financière aux étudiants (Canada). 2(3) The Minister may revoke a designation or place a designated educational institution on probation if, in the opinion of the Minister, the designated educational insti- tution no longer meets or is unwilling to meet the require- ments for designation set out in the policies and procedures established by the Minister. 2(3) Le ministre peut révoquer une désignation ou pla- cer un établissement d’enseignement agréé en probation si, à son avis, l’établissement d’enseignement agréé ne remplit plus ou ne veut plus remplir les critères de la dé- signation prévus dans les politiques et procédure établies par le ministre. 2(4) The Regulations Act does not apply to the policies and procedures established by the Minister for the pur- poses of subsections (1) and (3). 2(4) La

Agreement by Minister with designated educational institution Entente conclue entre le ministre et un établissement d’enseignement agréé 3 The Minister may enter into and amend from time to time an agreement with a designated educational institu- tion setting out the terms and conditions of the designation of the educational institution. 3 Le ministre peut conclure une entente, qu’il peut mo- difier à l’occasion, avec un établissement d’enseignement agréé précisant les modalités et conditions de la désigna- tion de l’établissement d’enseignement.

APPEAL BOARD COMITÉ D’APPEL Establishment of Appeal Board Établissement d’un Comité d’appel 4 There is established an appeal board to be known as the Designation Appeal Board. 4 Est établi un comité d’appel appelé le Comité d’appel de désignation. Composition of Appeal Board Composition du Comité d’appel 5 The Lieutenant-Governor in Council may appoint a maximum of 11 members to the Appeal Board. 5 Le lieutenant-gouverneur en conseil peut nommer au Comité d’appel un maximum de onze membres. Chair Président 6 The members of the Appeal Board present at an appeal shall choose one among them to be the Chair. 6 Les membres du Comité d’appel présents à un appel choisissent un président en leur sein.

Term of office and revocation of appointments Mandat et révocation d’une nomination 7(1) All members of the Appeal Board shall be ap- pointed for a term not exceeding 3 years and are eligible for reappointment. 7(1) Le mandat des membres du Comité d’appel est de trois ans au plus et est renouvelable. 7(2) Any appointment to the Appeal Board may be re- voked by the Lieutenant-Governor in Council for cause. 7(2) Le lieutenant-gouverneur en conseil peut révoquer, pour motif valable, toute nomination au Comité d’appel. 7(3) Notwithstanding subsection (1) and subject to sub- section (2), a member of the Appeal Board shall remain in office until the member resigns or is reappointed or re- placed. 7(3)

Malgré le paragraphe (1) et sous réserve du para- graphe (2), un membre du Comité d’appel demeure en fonction jusqu’à ce qu’il démissionne ou qu’il soit nommé à nouveau ou remplacé. Remuneration and expenses Rémunération et frais 9(1) The Lieutenant-Governor in Council shall deter- mine the remuneration to be paid to the members of the Appeal Board. 9(1) Le lieutenant-gouverneur en conseil fixe la rému- nération des membres du Comité d’appel. 9(2) Each member of the Appeal Board is entitled to be reimbursed in accordance with the regulations for the trav- elling and living expenses incurred by the member in the performance of his or her duties. 9(2) Les membres du Comité d’appel ont le droit de se faire rembourser les frais de déplacement et de séjour qu’ils ont engagés dans l’exercice de leurs fonctions con- formément aux règlements.

Appeal Appel 10(1) An educational institution may appeal a decision of the Minister by serving a notice of appeal on the Min- ister in accordance with the regulations. 10(1) Un établissement d’enseignement peut interjeter appel de la décision du ministre en signifiant un avis d’ap- pel au ministre conformément aux règlements. 10(2) The Minister shall refer an appeal under subsec- tion (1) to the Appeal Board who shall, in accordance with the regulations, hear the appeal. 10(2) Le ministre défère tout appel interjeté aux termes du paragraphe (1) au Comité d’appel qui doit, conformé- ment aux règlements, entendre l’appel. 10(3) The conclusions and recommendations of the ma- jority of the members of the Appeal Board who hear an appeal are the conclusions and recommendations of the Appeal Board but if there is no majority, the conclusions and recommendations of the Chair are the conclusions and recommendations of the Appeal Board. 10(3) Les conclusions et recommandations de la majo- rité des membres du Comité d’appel qui entendent un appel constituent les conclusions et recommandations du Comité d’appel, mais, s’il n’y a pas de majorité, les con- clusions et recommandations du président constituent celles du Comité d’appel.

10(4) The Appeal Board shall, in accordance with the regulations, transmit to the Minister in writing its conclu- sions and recommendations. 10(4) Le Comité d’appel transmet au ministre, par écrit et conformément aux règlements, ses conclusions et re- commandations. 10(5) The Minister is not bound by a conclusion or rec- ommendation of the Appeal Board. 10(5) Le ministre n’est pas lié par les conclusions et re- commandations du Comité d’appel. 10(6) The decision of the Minister under this

section is final and shall not be questioned or reviewed in any court. 10(6) La décision du ministre en vertu du présent

INSPECTIONS INSPECTIONS Appointment of inspectors Nominations des inspecteurs 11 The Minister may appoint one or more persons as inspectors for the purpose of ensuring compliance with this Act and the regulations. 11 Le ministre peut nommer une ou plusieurs personnes à

Inspections Inspections 12(1) An inspector may, at any reasonable time and upon presentation of proof of identification provided by the Minister, enter the premises of a designated educa- tional institution, or any other premises in which the inspector has reason to believe there might be relevant in- formation, and make an inspection for the purpose of ensuring compliance with this Act and the regulations. 12(1) Un inspecteur peut, à toute heure raisonnable et sur présentation de pièces d’identité fournie par le minis- tre, pénétrer dans les locaux d’un établissement d’ensei- gnement agréé, ou dans tout autre endroit lorsque l’inspecteur a des motifs raisonnables de croire qu’il s’y trouve des renseignements pertinents et il peut procéder à une inspection afin d’assurer le respect de la présente loi et des règlements. 12(2) An inspector may, for the purpose of ensuring compliance with this Act and the regulations, inspect and make copies or extracts of the records, books of account, bank accounts, vouchers, correspondence or other docu- ments of a designated educational institution. 12(2) Un inspecteur peut, afin d’assurer le respect de la présente loi et des règlements, examiner et faire des copies ou prendre des extraits des registres, dossiers, livres comp- tables, comptes bancaires, reçus, correspondance ou autres documents d’un établissement d’enseignement agréé. 12(3) An inspector shall not enter a private dwelling un- der subsection (1) unless the inspector 12(3) Un inspecteur ne peut pénétrer dans une habitation privée en vertu du paragraphe (1) que dans les cas sui- vants : (

Removal of documents Retrait de documents 13(1) An inspector may, for the purpose of ensuring compliance with this Act and the regulations, remove re- cords, books of account, bank accounts, vouchers, corre- spondence or other documents from premises referred to in subsection 12(1) and may make a copy or extract of them or any part of them and shall give a receipt to the occupier for the records, books of account, bank accounts, vouchers, correspondence or other documents so removed. 13(1) Un inspecteur peut, afin d’assurer le respect de la présente loi et des règlements, retirer des registres, dos- siers, livres comptables, comptes bancaires, reçus, corres- pondance ou autres documents des locaux visés au paragraphe 12(1) et peut faire des copies ou prendre des extraits de la totalité ou de toute
