OIC Text: The Governor in Council on the report and recommendation of the Minister of Energy dated March 12, 2008, and pursuant to
Section 6 of
Chapter 376 of the Revised Statutes of Nova Scotia, 1989, the Public Service Act, and
Section 59C of
Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, is pleased to: (1) approve an agreement between Her Majesty the Queen in Right of the Province of Nova Scotia as represented by the Minister of Energy and the panel appointed to consider Crown Share Adjustment Payments, being Lorne O. Clarke, Q.C.; Dara L. Gordon, Q.C. and Dr. Brian Lee Crowley (the "Panel"), with respect to the payment or reimbursement of Panel operating costs in a form substantially as provided in
Schedule "A" attached to and forming part of the Report and Recommendation; (2) approve a cost share agreement between Canada and Nova Scotia with respect to the sharing of costs related to the Panel operations in the form substantially as provided in
Schedule "B" attached to and forming part of the Report and Recommendation; (3) approve an amendment to a contract for services between Nova Scotia and Dara L. Gordon, Q.C. to amend an indemnity to cover claims related to breaches of confidentiality declarations which amendment is to be substantially in the form provided in
Schedule "C" attached to and forming part of the Report and Recommendation; (4) approve an indemnity agreement between Canada, Nova Scotia and Lorne O. Clarke, Q.C. and William Lahey providing an indemnity to Lorne O. Clarke, Q.C., chair of the Panel, and William Lahey, legal counsel to the Panel, with respect to claims related to breaches of confidentiality declarations in substantially the form provided in
Schedule "D" attached to and forming part of the Report and Recommendation; (5) authorize the Minister of Energy or the Deputy Minister of Energy to execute any or all of the agreements referenced in paragraphs 1 to 4; and (6) ratify and confirm any of the agreements referenced in paragraphs 1 to 4 executed in advance of the issue of this Order.
