Section 1 of the Community Planning Act,

chapter C-12 of the Revised Statutes, 1973, is amended by adding the following definition in alphabetical order: 1 L’article 1 de la

chapitre C-12 des Lois révisées de 1973, est modifié par l’adjonction de la définition suivante selon l’ordre alphabétique : “provincial planning policy” means the provincial plan- ning policy established by the Lieutenant-Governor in Council under subsection 4.1(1); « politique provinciale d’urbanisme » désigne la poli- tique provinciale d’urbanisme établie par le lieutenant- gouverneur en conseil en vertu du paragraphe 4.1(1); 2

section 4 the fol- lowing: 3 La Loi est modifiée par l’adjonction, après l’article 4, de ce qui suit : PROVINCIAL PLANNING POLICY POLITIQUE PROVINCIALE D’URBANISME 4.1(1) On the recommendation of the Minister, the Lieutenant-Governor in Council shall by regulation estab- lish a provincial planning policy, which shall include the following: 4.1(1) Sur la recommandation du Ministre, le lieutenant-gouverneur en conseil doit, par règlement, éta- blir une politique provinciale d’urbanisme qui doit com- prendre ce qui suit : (

a) the principles upon which community planning and development in the Province are to be based;

a) les principes sur lesquels sont fondés l’urbanisme et l’aménagement dans la Province; 1

(

b) the provincial goals and priorities for community planning and development in the Province or areas of the Province;

b) les buts et les priorités provinciaux relatifs à l’ur- banisme et à l’aménagement dans la Province ou dans des secteurs de la Province; (

c) policy statements on matters related to community planning and development that are of provincial interest such as water quality and quantity, air quality, natural resources or any other matter related to the social, eco- nomic or environmental welfare of the Province; and

d) any other matter that the Minister considers nec- essary for the implementation of the policies, goals and priorities set out in the regulation.

d) toute autre question que le Ministre juge nécessaire pour mettre en oeuvre les politiques, buts et priorités énoncés dans le règlement. 4.1(2) Before making a recommendation to establish or amend the provincial planning policy, the Minister shall consult with such persons and public bodies as the Minister considers appropriate. 4.1(2) Avant de faire une recommandation pour établir ou modifier une politique provinciale d’urbanisme, le Mi- nistre doit consulter les personnes et organismes publics qu’il juge indiqués. 4.1(3) A regional plan, municipal plan, rural plan, basic planning statement or a by-law or regulation under this Act that is enacted or adopted after the coming into force of the provincial planning policy shall conform with the pro- vincial planning policy, and in the case of a conflict, the provincial planning policy prevails. 4.1(3) Un plan régional, un plan municipal, un plan ru- ral, une déclaration des perspectives ou un arrêté, ou un règlement établi en vertu de la présente loi qui est édicté ou adopté après l’entrée en vigueur de la politique provin- ciale d’urbanisme doit être conforme à celle-ci, et la poli- tique provinciale d’urbanisme prévaut en cas de conflit. 4.1(4) An amendment, modification or addition made to a regional plan, municipal plan, rural plan, basic planning statement or a by-law or regulation under this Act after the coming into force of the provincial planning policy shall conform with the provincial planning policy, and in the case of a conflict, the provincial planning policy prevails. 4.1(4) Une modification ou un ajout à un plan régional, un plan municipal, un plan rural, une déclaration des pers- pectives ou un arrêté, ou un règlement établi en vertu de la présente loi après l’entrée en vigueur de la politique provinciale d’urbanisme doit être conforme à celle-ci, et la politique provinciale d’urbanisme prévaut en cas de conflit. 4

Section 22 of the Act is amended by striking out “paragraph 77 (1)(h.1)” and substituting “paragraph 77(1)(h.1) or a regulation establishing a provincial plan- ning policy”. 4 L’article 22 de la Loi est modifié par la suppression de « l’alinéa 77(1)h.1) » et son remplacement par « l’ali- néa 77(1)h.1) ou un règlement qui établit une politique provinciale d’urbanisme ». 5 Subsection 77(3.2) of the Act is amended by striking out “or regulation under this Act” and substituting “or regulation under this Act, except a regulation establishing a provincial planning policy”. 5 Le paragraphe 77 (3.2) de la Loi est modifié par la suppression de « ou un règlement établi en vertu de la présente loi » et son remplacement par « ou un règlement établi en vertu de la présente loi, autre qu’un règlement qui établit une politique provinciale d’urbanisme ».
