Extension Regulation (AR 47/2020), is amended by striking

out "September 30, 2020" and substituting "September 30, 2021".

HATCHING EGGS AMENDMENT REGULATION

For information only: Made by the Alberta Hatching Egg Producers on October 13,

2020 and approved by the Alberta Agricultural Products Marketing Council on

October 22, 2020 pursuant to sections 26 and 27 of the Marketing of Agricultural

Products Act.

1 The Hatching Eggs Regulation (AR 280/97) is amended

by this Regulation.

Section 1(1) is amended

(

a) by repealing clause (

a) and substituting the

following:

(a) "Alberta pricing order period" means an 8-week period

in respect of which the minimum price per saleable

chick is set by the Board;

(a.01) "Animal Care Program" means the program known as

the Animal Care Program as approved or varied from

time to time by the national agency;

(a.02) "assurance of production policy" means the Board's

policy relating to ensuring the production of hatching

eggs from all quota units held in Alberta, as amended

from time to time;

(a.03) "breeder quota" means the total number of breeder hens

and pullets that a producer is authorized by the Board to

place in a one-year period;

(a.04) "Canadian Hatching Egg Quality Program" means the

program known as the Canadian Hatching Egg Quality

Program as approved or varied from time to time by the

national agency;

(

b) by adding the following after clause (a.1):

(a.2) "cycle" means the replacement interval, measured in

weeks, in which a producer places and replaces day-old

broiler breeder chicks;

(

c) by adding the following after clause (d):

(d.1) "growth policy" means the Board's policy relating to

the distribution by the national agency of increased

allocation of quota to Alberta for production, as

amended from time to time;

(

d) by repealing clause (

g) and substituting the

following:

(g) "marketing allocation" means the number of production

units a producer may produce or market, as determined

in accordance with the assurance of production policy;

(

e) in clause (h.01)

(

i) by striking out "quota" and substituting "breeder

quota";

(ii) by striking out "Board's";

(

f) by adding the following after clause (h.01):

(h.02) "new entrants policy" means the Board's policy relating

to the distribution of increased provincial allocation of

quota to new entrants;

(

g) by repealing clause (h.1);

(

h) by adding the following after clause (h.2):

(h.3) "placement number" means the number of day-old

broiler breeder chicks required to ensure the production

of quota units allocated to each producer;

(h.4) "production unit" means quota unit multiplied by the

utilization factor set by the Board;

(

i) by adding the following after clause (i):

(i.1) "quota unit" means the unit of measurement of breeder

quota, expressed in breeder hens and pullets that may be

allocated or reallocated by the Board;

(

j) in clause (

j) by striking out "quota" and substituting

"breeder quota";

(

k) by adding the following after clause (k):

(k.1) "saleable chick" means a broiler chick that is suitable

for sale by a hatchery for chicken production within the

meaning of the Alberta Chicken Producers' Plan

Regulation (AR 70/93);

Section 4(1)(f.1) is amended by striking out "the On-Farm

Food Safety Assurance Program" and substituting "the Animal

Care Program and Canadian Hatching Egg Quality Program".

Section 5 is amended

(

a) in subsection (2) by adding "(2.1)," after "subsections";

(

b) by adding the following after subsection (2):

(2.1) Before renewing a licence that is issued under subsection

(1), the Board may require the holder of the licence to make an

application for a renewed licence in accordance with

section 4

and the Board shall, unless the applicant is refused a licence

under subsection (3) or (4), renew the licence.

(

c) in subsection (3)(

c) by striking out "the On-Farm Food

Safety Assurance Program" and substituting "the Animal

Care Program or Canadian Hatching Egg Quality Program";

(

d) in subsections (3.1) and (3.2)(

b) by striking out "the

On-Farm Food Safety Assurance Program" and

substituting "the Animal Care Program and Canadian

Hatching Egg Quality Program";

(

e) in subsection (3.3)

(

i) by striking out "the On-Farm Food Safety Assurance

Program" and substituting "the Animal Care

Program or Canadian Hatching Egg Quality Program";

(ii) in clause (

b) by striking out "quota" wherever it

occurs and substituting "breeder quota";

(

f) by repealing subsection (5).

Section 6 is amended

(

a) in subsection (1)(

c) by striking out "the On-Farm Food

Safety Assurance Program" and substituting "the Animal

Care Program or Canadian Hatching Egg Quality Program";

(

b) in subsection (3.1)

(

i) by striking out "the On-Farm Food Safety Assurance

Program" wherever it occurs and substituting

"the Animal Care Program or Canadian Hatching Egg

Quality Program";

(ii) in clause (

c) by striking out "quota" wherever it

occurs and substituting "breeder quota".

Section 7 is amended by striking out "the quota allocated to

the holder" and substituting "the breeder quota allocated to the

quota holder".

Section 8(3)(

c) is amended by striking out "quota" and

substituting "breeder quota".

8 The heading preceding

section 13.1 is repealed and the

following is substituted:

Section 14(2) is amended

(

a) in clause (a)

(

i) by striking out "quota" wherever it occurs and

substituting "breeder quota";

(ii) by striking out "breeder hens" and substituting

"breeder hens and pullets".

b) to market the hatching eggs or broiler breeder chicks

produced by those breeder hens and pullets.

Section 15(

d) is amended by striking out "replacement".

Section 16 is amended

a) in subsection (1)(

substituting "breeder quota";

(

c) in subsection (4) by striking out "lease of quota" and

Section 17 is amended

(

a) in subsection (1) by striking out "that quota" and

substituting "that breeder quota";

Section 19 is amended

(

a) in subsection (1)

(

i) by striking out "quota" and substituting "breeder

quota";

(ii) by repealing clause (

b) and substituting the

b) be allocated to producers under the growth policy,

c) by adding "be" before "retained";

(

b) by repealing subsection (2).

Section 20 is amended by striking out "quota" wherever

it occurs and substituting "breeder quota".

Section 21(3) is amended by striking out "that quota" and

substituting "that breeder quota";

Section 23(1) is repealed.

Section 24 is amended

(

a) in subsection (1) by striking out "to lease breeder quota

to" and substituting "to lease up to 20% of the breeder

quota held by the quota holder to";

(

b) in subsections (2) and (4) by striking out "lease

quota" and substituting "lease breeder quota";

(

c) in subsection (6)

(

i) by striking out "lease of quota" and substituting

"lease of breeder quota";

(ii) in clause (

c) by striking out "replacement";

(

d) in subsection (8) by striking out "that quota"

Section 25(7) is amended by striking out "further quota"

and substituting "further breeder quota".

Section 27(1)(

a) and (

b) are amended by striking out "the

quota" and substituting "the breeder quota".

Section 28(2) and (6) are repealed.

21 The following is added after

section 28:

Suspension of breeder quota

28.1 The Board may, in accordance with the assurance of

production policy, suspend all or any portion of breeder quota held

by a quota holder if the quota holder fails to ensure production from

all of the quota holder's allocated breeder quota within 3 consecutive

placements of breeder pullets, unless the Board is satisfied that

extenuating circumstances exist that prevent the quota holder from

ensuring production.

Section 29 is amended

(

a) in subsection (1) by striking out "quota" and

substituting "breeder quota";

(

b) in subsection (2)

(

i) by striking out "any quota" and substituting "any

breeder quota";

(ii) in clauses (

a) and (

c) by striking out "the quota"

and substituting "the breeder quota".

Section 34(2)(

b) is amended by striking out "quota" and

substituting "breeder quota".

Section 35 is repealed and the following is substituted:

Marketing allocation

35(1) Where the Board wishes to reduce the production of hatching

eggs to accommodate an anticipated reduction in the demand for

hatching eggs, the Board may establish a marketing allocation for

each producer that is equivalent to multiplying the breeder quota

allocated to a producer by a number that is less than one quota unit.

(2) Where the Board establishes a marketing allocation under

subsection (1),

(

a) the marketing allocation must take effect at the start of an

Alberta pricing order period, and

(

b) the marketing allocation continues in effect until it is

changed by the Board.

(3) Where the Board establishes a marketing allocation under

subsection (1), a producer shall not produce or market hatching eggs

except in accordance with the marketing allocation.

Section 36 is amended

(

a) by repealing subsection (0.1) and substituting the

following:

Flock life

36(0.1) In this section, "designated flock life" means the period

of time, as determined by the Board, after which a flock is to be

removed from the production of hatching eggs.

(

b) in subsection (1) by striking out "may establish" and

substituting "shall establish";

(

c) by repealing subsections (3) and (3.1) and

substituting the following:

(3) A licensed hatchery may remove a flock from the production

of hatching eggs

(

a) no more than 7 days before the end of the designated

flock life, and

(

b) no more than 7 days after the end of the designated

flock life.

(

d) by repealing subsection (4.1) and substituting the

following:

(4.1) On application by a licensed hatchery, the Board may

extend the period of time referred to in subsection (3)(

b) if the

Board is satisfied that extenuating circumstances exist that

prevent the removal of the flock from production.

Section 37 is amended

(

a) in subsection (1) by striking out "the replacement

cycle" and substituting "the cycles";

(

b) by repealing subsection (2) and substituting the

following:

(2) A licensed producer may apply to the Board to amend that

producer's placement number.

(

c) by repealing subsection (3).

Section 38 is amended

(

a) in subsection (1)

(

i) by striking out "person's quota" and substituting

"person's breeder quota";

(ii) by striking out "the quota" and substituting "the

breeder quota";

(

b) in subsection (3) by striking out "a quota" and

substituting "a breeder quota";

(

c) in subsection (5)

(

i) by striking out "section 36(3.1)" and substituting

"section 36(3)(b)";

(ii) by striking out "$0.28" and substituting "$0.175";

(iii) by adding "after the end of the designated flock life"

after "from that flock".

Section 45 is amended by striking out "quota" and

Section 48, as extended by the Regulations Expiry Date

Regulation (AR 47/2020), is amended by striking out

"September 30, 2020" and substituting "September 30, 2025".

Provincial Parks Act

PROVINCIAL PARKS (GENERAL)

AMENDMENT REGULATION

1 The Provincial Parks (General) Regulation (AR 102/85) is

amended by this Regulation.

2 The following is added after

section 15:

Hunting with dogs - Cooking Lake-Blackfoot

15.1 Despite

section 15(1), a person may bring a dog into or allow

a dog to enter or remain in the Cooking Lake-Blackfoot Grazing,

Wildlife and Provincial Recreation Area without being in a cage or

restrained by a leash, chain or other device if

(

a) the person is hunting game birds with the dog in the

recreation area,

(

b) the person is authorized to hunt game birds with a dog under

the Wildlife Act, and

(

c) the person holds a permit under

section 46(1.1).

Consumer Protection Act

GENERAL LICENSING AND SECURITY

AMENDMENT REGULATION

1 The General Licensing and Security Regulation

(AR 187/99) is amended by this Regulation.

Section 5 is amended by adding the following after

subsection (2):

(3) The Director may prescribe requirements to request a refund of

the whole or part of any licence fees, which may include any or all of

the following:

(

a) the form that must be used to request the refund;

(

b) any information that must be submitted;

(

c) any documents that must accompany the request.

Section 12(d.1) is amended by striking out "or" at the end

of subclause (vi), by adding "or" at the end of subclause (vii)

and by adding the following after subclause (vii):

(viii) an individual who has made a payment to a collection agency

or debt repayment agency;

4 Sections 22(1)(

a) and 23(1)(

a) are amended by striking

out "$1000" and substituting "$10 000".

Section 38, as extended by the Regulations Expiry Date
