When the Minister makes the desi gnation, the Niagara Escarpment Planning and Development Act is repealed.

Definitions 1. In this Act, Définitions 1.

Les définitions qui suivent s’appliquent à la présente loi. “development” means the construction, erection o r placing of one or more buildin gs or structures on land or the makin g of an addition or alteration to a buildin g or structure that has the effect of substantiall y increasing its size or usability; (“aménagement”) “Minister” means the Minister of Natural Resources; (“ministre”) “municipality” means a local, district or regional munici- pality; (“municipalité”) “Niagara Escarpment area” means the Niagara Escarp- ment and the surrounding wetlands. (1) The Minister shall make an order designating all or an y part of the Nia gara Escar pment area as a natural area. Désignation d’une zone naturelle 2.

(1) If the natural boundaries of the Nia gara Escarpment area change, the Minister ma y make an orde r altering, in whole or in part, the boundaries of the natural area. Modification des limites 3.

(2) The Minister shall not make an order under sub- section (1) unless each munici pality, whose lands are to be added to or removed from the natural area by the or- der, passes a resolution a pproving the addition of the lands to the natural area or the removal of the lands fro m the natural area. (1) No person shall use an y land desi gnated as a natural area for development purposes unless the devel- o pment is a pproved b y a resolution of the munici pality where the land is situated and b y a resolution of the Assembly. Interdiction 4.

(2) Every person who contravenes subsection (1) is guilty of an offence and on conviction is liable, Infraction

a) on a first conviction to a fine of not more tha n $25,000; and

b) on a subse quent conviction to a fine of not more than $10,000 for each da y or part thereof u pon which the contravention has continued after the day on which the person was first convicted.
