Section 1 of the Official Languages Act,

chapter O-0.5 of the Acts of New Brunswick, 2002, is amended 1(1) L’article 1 de la

a) in the English version in the definition “publi- cation and published” by striking out the period at the end of the definition and substituting a semicolon;

b) by adding the following definition in alphabeti- cal order:

Schedule of the Public Service Labour Relations Act that are prescribed by regulation. a) to ensure respect for English and French as the official languages of New Brunswick;

b) to ensure that English and French have equality of status and equal rights and privileges as to their use in all institutions of the Province; and

b) d’assurer l’égalité de statut et l’égalité de droits et de privilèges du français et de l’anglais quant à leur usage dans toutes les institutions de la province; (

c) to set out the powers and duties of the institutions of the Province with respect to the two official lan- guages.

section 5 the following: 1(3) La Loi est modifiée par l’adjonction de ce qui suit après l’article 5 : Implementation plan Plan de mise en application 5.1(1) The Province shall prepare a plan setting out how it will meet its obligations under this Act, and the plan shall include the following: 5.1(1) La province élabore un plan établissant les mo- dalités de respect des obligations que lui impose la pré- sente loi, lequel énonce notamment : (

a) goals and objectives with respect to its obligations under this Act;

a) les buts et les objectifs afférents à ses obligations; (

b) measures to ensure the equality of status of the two linguistic communities;

b) les mesures propres à assurer l’égalité de statut des deux communautés linguistiques; (

c) measures to ensure the equality of use of the En- glish and French language in the public service;

c) les mesures propres à assurer l’égalité d’usage du français et de l’anglais dans les services publics; (

d) measures to ensure that language of work is con- sidered when identifying work groups within the public service and when developing language profiles for po- sitions in the public service;

d) les mesures propres à assurer la prise en compte de la langue de travail dans la détermination des équipes de travail au sein des services publics et l’élaboration des profils linguistiques des postes dans les services publics; (

e) measures to improve the bilingual capacity of se- nior management in the public service;

e) les mesures propres à améliorer la capacité bilin- gue de la haute direction au sein des services publics; (

f) measures to provide for the review and the im- provement, when necessary, of the public signage pol- icies of the Province, which policies shall include con- sideration of the two linguistic communities and of the linguistic composition of a region; and

f) les mesures propres à prévoir la révision et l’amé- lioration, au besoin, de ses politiques en matière d’af- fichage public en tenant compte des deux communautés linguistiques et de la composition linguistique d’une région; (

g) performance measures for evaluating the effec- tiveness of the measures implemented under the plan and time frames within which they must be imple- mented.

Section 12 of the Act is amended by striking out “printed” and substituting “co-drafted, printed”. 1(4) L’article 12 de la Loi est modifié par la suppres- sion de « imprimées » et son remplacement par « coré- digées, imprimées ». 1(5)

Section 30 of the Act is repealed and the following is substituted: 1(5) L’article 30 de la Loi est abrogé et remplacé par ce qui suit : 30 When the Province or an institution engages a third party to provide a service on its behalf, the Province or the institution, as the case may be, is responsible for ensuring that its obligations under sections 27 to 29 are met by the third party. 30 Si elle fait appel à un tiers afin qu’il fournisse des services pour son compte, la province ou une institution, le cas échéant, est chargée de veiller à ce qu’il honore les obligations que lui imposent les articles 27 à 29. 1(6)

an Act of the Legislature has the power to admit, suspend, expel or direct persons in the practice of a profession or an occupation. 41.1(1) Dans le présent article, « association profession- nelle » s’entend d’une organisation de personnes qui, par loi provinciale, est habilitée à admettre, à suspendre, à ex- pulser ou à diriger des personnes dans l’exercice d’une profession. 41.1(2) A professional association shall provide the ser- vices prescribed by regulation to its members in both of- ficial languages. 41.1(2) L’association professionnelle fournit à ses membres dans les deux langues officielles les services ré- glementaires.

1(8) Subsection 42(1) of the Act is repealed and the following is substituted: 1(8) Le paragraphe 42(1) de la Loi est abrogé et rem- placé par ce qui suit : 42(1) The Premier shall initiate a review of this Act, and the review shall be completed no later than December 31, 2021. 42(1) Le premier ministre entreprend la révision de la présente loi, laquelle doit être terminée au plus tard le 31 décembre 2021. 1(9)

Section 43 of the Act is amended 1(9) L’article 43 de la Loi est modifié (

a) in subsection (2) of the English version by strik- ing out “The Commissioner” and substituting “Sub- ject to subsections (2.1) to (2.4), the Commissioner”;

section 43 the following: 1(10) La Loi est modifiée par l’adjonction de ce qui suit après l’article 43 : Protection from reprisal Protection contre les représailles 43.1 No person shall take a reprisal against a person or direct that one be taken against a person because the person has made a complaint in good faith to the Commissioner or cooperated in an investigation under this Act. 43.1 Il est interdit d’exercer des représailles contre un plaignant ou d’en ordonner l’exercice du fait qu’il a déposé de bonne foi une plainte auprès du commissaire ou colla- boré à l’enquête que prévoit la présente loi. Immunity Immunité 43.2 No proceedings lie against the Commissioner or against a person holding an office or appointment in the Office of the Commissioner for anything he or she may do, report or say in the course of the exercise or intended exercise of his or her functions under this Act regardless of whether that function was within his or her jurisdiction, unless it is shown the person acted in bad faith. 43.2 Le commissaire ou quiconque occupe un poste ou remplit des fonctions relevant de lui ne peut faire l’objet d’une instance du fait d’actes qu’il peut accomplir, de rap- ports qu’il peut présenter ou de propos qu’il peut tenir dans l’exercice effectif ou censé tel de l’une des fonctions que lui attribue la présente loi, que cette fonction ait relevé ou non de sa compétence, sauf preuve établissant que ce der- nier a agi de mauvaise foi. 1(11)

Section 45 of the Act is amended 1(11) L’article 45 de la Loi est modifié (

a) by adding after paragraph (

a) the following:

a) par l’adjonction de ce qui suit après l’alinéa a) : (a.1) prescribing portions or divisions of the Public Service for the purposes of the definition “public ser- vice” in

b) by adding after paragraph (

c) the following:

b) par l’adjonction de ce qui suit après l’alinéa c) : (c.1) prescribing the services that a professional as- sociation is required to provide to its members in both official languages, including imposing different re- quirements on professional associations based on cri- teria established by the regulations; c.1) précisant les services qu’une association profes- sionnelle est tenue de fournir à ses membres dans les deux langues officielles, imposant notamment aux as- sociations professionnelles diverses exigences fondées sur des critères réglementaires; (

c) by adding after paragraph (

e) the following:

section 43.1 or establishing a procedure for enforcing the prohibition in

section 43.1, including prescribing a violation of that

Loi sur les municipalités 3 Subsection 11(1) of the Municipalities Act,

chapter M-22 of the Revised Statutes, 1973, is amended by adding after paragraph (j.1) the following: 3 Le paragraphe 11(1) de la

Commencement Entrée en vigueur 4(1) Subject to subsection (2), this Act or any provision of it comes into force on a day or days to be fixed by proclamation. 4(1)
