B.C. Reg. 133/2011 , deposited July 21, 2011, pursuant to the FOREST ACT [sections 35.2, 44, 47.1, 47.6, 48, 49, 50, 54.3, 59.1, 75.1, 81, 84, 96, 123, 124, 125, 151, 151.4, 151.5 and 156] and the MISCELLANEOUS STATUTES AMENDMENT ACT (NO. 2), 2011 [section 137]. Order in Council 338/2011, approved and ordered July 21, 2011.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) sections 35 to 40, 42 to 51, 53 to 62, 64 to 70, 71 (a), 72 (a), 73 to 93, 94 (a), 95, 99, 100 and 106 of the Miscellaneous Statutes Amendment Act (No. 2), 2011 , S.B.C. 2011, c. 13, are brought into force, and

(

b) the following regulations are amended as set out in the attached Schedule:

(

i) Advertising, Deposits, Disposition and Extension Regulation, B.C. Reg. 55/2006;

(ii) Christmas Tree Regulation, B.C. Reg. 166/2000;

(iii) Cut Control Regulation, B.C. Reg. 578/2004;

(iv) Forestry Licence to Cut Regulation, B.C. Reg. 221/2006;

(

v) Free Use Permit Regulation, B.C. Reg. 335/99;

(vi) Innovative Forestry Practices Regulation, B.C. Reg. 197/97;

ADVERTISING, DEPOSITS, DISPOSITION AND EXTENSION REGULATION

Section 3 (c) (iii) of the Advertising, Deposits, Disposition and Extension Regulation, B.C. Reg. 55/2006, is amended by striking out " a name of a place in the forest region " and substituting " an address ".

2 Sections 4 (b) (ii), 5 (b) (ii) and 6 (b) (ii) are amended by striking out " the name of a place in the forest region or forest district " and substituting " an address ".

3 Sections 9 (1), 14 (1), 15 (1) and 15 (2) are amended by striking out " regional manager or district manager " wherever it appears and substituting " minister ".

Section 9 (1) (e) (iii) is amended by striking out " or (2.1) ".

Section 9 (2) is amended by striking out " regional manager or the district manager " and substituting " minister ".

Section 11.1 is amended by striking out " or (2.1) " and substituting " of the Act ".

Section 12 is amended by striking out " regional manager or district manager, as applicable, " and substituting " minister ".

Section 15 (3) is amended by striking out " or the minister's delegate ".

CHRISTMAS TREE REGULATION

Section 1 of the Christmas Tree Regulation, B.C. Reg. 166/2000, is amended by striking out " the district manager or regional manager in the form required by the regional manager " and substituting " the minister in the form required by the minister ".

Section 3 is amended in subsections (1) and (3) by striking out " regional manager, district manager or a forest officer authorized by either of them, " and substituting " minister ".

Section 4 is amended by striking out " regional manager or district manager " in both places and substituting " minister ".

CUT CONTROL REGULATION

Section 17 (6) (

c) of the Cut Control Regulation, B.C. Reg. 578/2004, is amended by striking out " the regional manager or district manager " and substituting " the minister ".

Section 18 is amended by striking out " The regional manager or district manager " and substituting " The minister ".

FORESTRY LICENCE TO CUT REGULATION

14 Sections 2 and 4 of the Forestry Licence to Cut Regulation, B.C. Reg. 221/2006, are amended by striking out " regional manager or district manager " wherever it appears and substituting " minister ".

FREE USE PERMIT REGULATION

Section 2 of the Free Use Permit Regulation, B.C. Reg. 335/99, is amended by striking out " a district manager or forest officer authorized by the district manager " and substituting " the minister " and by striking out " the district manager or forest officer " and substituting " the minister ".

INNOVATIVE FORESTRY PRACTICES REGULATION

Section 1 of the Innovative Forestry Practices Regulation, B.C. Reg. 197/97, is amended in the definition of " standard practices " by striking out " regional manager " and substituting " minister ".

Section 2 (

e) is amended by striking out " regional manager " and substituting " minister ".

LOG SALVAGE REGULATION FOR THE VANCOUVER LOG SALVAGE DISTRICT

Section 4 of the Log Salvage Regulation for the Vancouver Log Salvage District, B.C. Reg. 220/81, is amended

(

a) in subsections (1) and (3) by striking out " regional manager " and substituting " minister ", and

(

b) in subsection (2) by striking out " If a regional manager " and substituting " If the minister " and by striking out " the regional manager " and substituting " the minister ".

Section 9 is amended

(

a) in subsection (1) (

b) by striking out " regional manager " and substituting " minister ", and

(

b) in subsection (4) by striking out " the regional manager, or a forest officer authorized by him, " and substituting " the minister, ".

Section 15 (1) is amended by striking out " regional manager " and substituting " minister ".

Section 16 is amended in subsections (1) and (3) (

a) and (

b) by striking out " regional manager " wherever it appears and substituting " minister ".

22 Sections 17 and 18 (1) are amended by striking out " regional manager " and substituting " minister ".

Section 19 is amended

(

a) in subsection (1) by striking out " The regional manager, a forest officer authorized by him " and substituting " The minister ",

(

b) in subsection (2) by striking out " regional manager " and substituting " minister ", and

(

c) in subsection (2) (

a) by striking out " he " and substituting " the minister ".

PERFORMANCE BASED HARVESTING REGULATION

Section 2 (1) (

a) of the Performance Based Harvesting Regulation, B.C. Reg 175/95, is amended by striking out " (

i) to (iii) " and substituting " (ii) and (iii) ".

Section 3 (2) is amended by striking out " the regional manager or district manager " and substituting " the minister, timber sales manager or district manager ".

TIMBER HARVESTING CONTRACT AND SUBCONTRACT REGULATION

Section 1 of the Timber Harvesting Contract and Subcontract Regulation, B.C. Reg. 22/96, is amended in paragraph (

b) of the

definitions of " contractor clause " and " person under contract " by striking out " regional manager " and substituting " minister ".

Section 7 (3) is amended by striking out " regional manager " and substituting " minister ".

TIMBER MARKING AND TRANSPORTATION REGULATION

Section 2 of the Timber Marking and Transportation Regulation, B.C. Reg. 253/97, is amended

(

a) in subsection (2) by striking out " a regional manager, district manager or forest officer " and substituting " the minister " and by striking out " manager or officer " and substituting " minister ", and

(

b) in subsection (3) by striking out " regional manager, district manager or forest officer, in the form and manner required by the manager or officer " and substituting " minister, in the form and manner required by the minister ".

Section 3 (1) (b) (ii) is amended by striking out " regional manager, district manager, or a forest officer authorized by either one of them, " and substituting " minister ".

Section 10 (5) is amended by striking out " A regional manager, district manager or forest officer " and substituting " The minister ".

TREE FARM LICENCE MANAGEMENT PLAN REGULATION

Section 6 of the Tree Farm Licence Management Plan Regulation, B.C. Reg. 280/2009, is amended by striking out " regional manager " wherever it appears and substituting " minister ".

WOODLOT LICENCE REGULATION

Section 2 of the Woodlot Licence Regulation, B.C. Reg. 68/2006, is amended

(

a) by repealing subsection (1) (

a) and substituting the following:

(

a) be in the form specified by the minister that the minister considers appropriate for the invitation, , and

(

b) in subsection (1) (

c) by striking out " regional manager or district manager that he or she " and substituting " minister that the minister ".

Section 4 (3) is amended by striking out " regional manager or district manager, depending on which of them is conducting the evaluation, " and substituting " minister ".

Section 6 (1) is amended by striking out " a district manager or regional manager " and substituting " the minister ", and by striking out " the district manager or regional manager, depending on which of them is the decision maker, " and substituting " the minister ".

Section 7.1 is amended by striking out " a district manager or regional manager " and substituting " the minister " and by striking out " the district manager or regional manager, depending on which of them is the decision maker, " and substituting " the minister ".
