OIC Text: The Governor in Council on the report and recommendation of the Minister of Public Works dated June 17, 2022, and pursuant to
Section 18 of
Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act , and
Section 11 of
Chapter 452 of the Revised Statutes of Nova Scotia, 1989, the Surplus Crown Property Disposal Act , is pleased to: (
a) extinguish the right of the public to use that portion of the public highway, identified as Lot AR-1, containing an area of 1,906 square metres (0.47 acres), more or less, located at or near Elmsdale, Halifax County, more particularly described in
Schedule "A" and as shown on
Schedule "B" which are attached to and form part of the Report and Recommendation; (
b) authorize the conveyance of the parcel of surplus land, Lot AR-1, to Frank and Lolo Doane both of Halifax, Halifax County, Nova Scotia, for the consideration of $1,850.00 plus HST of $277.50 for a total purchase price of $2,127.50; (
c) authorize the Minister of Public Works to make and execute a Deed of Conveyance in such form as the Minister determines to effect the conveyance of the land herein above described; and (
d) authorize the Minister of Public Works to execute such documents as may be necessary to achieve the purpose of this Order.
