B.C. Reg. 137/2014 , deposited June 30, 2014, under the EMPLOYMENT STANDARDS ACT [section 127 (2) (g)], the FOREST ACT [sections 151 (2.1), 151.1 and 161 (1) (

c) and (2)], the FOREST AND RANGE PRACTICES ACT [sections 141 (3) (a), 149 (1) (

f) and 160], the LAND ACT [section 3], the PLANT PROTECTION ACT [section 8 (2) (f)], the PRIVATE MANAGED FOREST LAND ACT [section 42 (5)], the RANGE ACT [section 78] and the WILDFIRE ACT [section 79]. Order in Council 429/2014, approved and ordered June 30, 2014.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) the Forest Regions and Districts Regulation, B.C. Reg. 123/2003, is repealed,

(

b) the Land Recording Districts Regulation, B.C. Reg. 345/2008, is repealed,

(

c) Division 5 of the Range Regulation, B.C. Reg. 116/2005, is repealed,

(

d) the Administrative Boundaries Regulation, as set out in the attached

Schedule 1, is made,

(

e) the range districts having the boundaries as described in sections 1 (4), 2 (4), 3 (4), 4 (4), 5 (4), 6 (4), 7 (4) and 8 (4) of the attached Administrative Boundaries Regulation are established,

(

f) the Balsam Woolly Adelgid Regulation, B.C. Reg. 414/92, is amended as set out in the attached

Schedule 2,

(

g) the Employment Standards Regulation, B.C. Reg. 396/95, is amended as set out in the attached

Schedule 3,

(

h) the Forest Planning and Practices Regulation, B.C. Reg. 14/2004, is amended as set out in the attached

Schedule 4,

(

i) the Private Managed Forest Land Council Matters Regulation, B.C. Reg. 372/2004, is amended as set out in the attached

Schedule 5,

(

j) the Timber Harvesting Contract and Subcontract Regulation, B.C. Reg. 22/96, is amended as set out in the attached

Schedule 6,

(

k) section 30 (b) (

i) of the Wildfire Regulation, B.C. Reg. 38/2005, is repealed, and

9 For the purposes of

section 45 (1) (b) (ii) of the Forest Act and

section 2.1 (2) (

1 Appendix A of the Balsam Woolly Adelgid Regulation, B.C. Reg. 414/92, is repealed and the following substituted:

Appendix A

Quarantine Areas

(section 1)

Quarantine areas

1 The following areas, as established under the Administrative Boundaries Regulation, constitute a quarantine area for the purposes of

section 8 (2) (

f) of the Plant Protection Act :

(

a) the Cascades Forest District;

(

b) the South Coast Forest Region;

(

c) the West Coast Forest Region, except that area comprising the Haida Gwaii Forest District.

Schedule 3

Section 37.7 (6) of the Employment Standards Regulation, B.C. Reg. 396/95, is amended by striking out “ Fort St. John and Fort Nelson Forest Districts under the Prince George Forest Region as established in the Forest Regions Regulation, B.C. Reg. 19/2000, ” and substituting “ the Northeast Forest Region as established under the Administrative Boundaries Regulation ”.

Schedule 4

Section 1 (1) of the Forest Planning and Practices Regulation, B.C. Reg. 14/2004, is amended by repealing the definition of “Coast” and substituting the following:

“Coast” means an area of British Columbia located in the South Coast Forest Region, West Coast Forest Region or the Coast Mountain Forest District, as established by the Administrative Boundaries Regulation; .

Section 64 (1) is repealed and the following substituted:

(1) If an agreement holder other than a holder of a minor tenure harvests timber in a cutblock, the holder must ensure that the size of the net area to be reforested for the cutblock does not exceed

(a) 40 hectares for areas located in the Kootenay Boundary Forest Region, South Coast Forest Region, Thompson Okanagan Forest Region or West Coast Forest Region, as established by the Administrative Boundaries Regulation, and

(b) 60 hectares for areas located in the Cariboo Forest Region, Northeast Forest Region, Omineca Forest Region or Skeena Forest Region, as established by the Administrative Boundaries Regulation.

Schedule 2 is amended in the column under the heading “Forest District”

(

a) opposite items 14 to 18 by striking out “ Headwaters ” and substituting “ Thompson Rivers ”,

(

b) opposite items 19 to 22 by striking out “ Kamloops ” and substituting “ Thompson Rivers ”,

(

c) opposite item 29 by striking out “ Central Cariboo ” and substituting “ Cariboo-Chilcotin ”, and

(

d) opposite items 39 and 40 by striking out “ Queen Charlotte Islands ” and substituting “ Haida Gwaii ”.

Schedule 5

Section 1 of the Private Managed Forest Land Council Matters Regulation, B.C. Reg. 372/2004, is amended in the definition of “Coast” by striking out “ as defined in the Forest Regions and Districts Regulation, B.C. Reg. 123/2003; ” and substituting “ as established by the Forest Regions and Districts Regulation, B.C. Reg. 123/2003, as that regulation read immediately before its repeal; ”.

Schedule 6

Section 1 (1) of the Timber Harvesting Contract and Subcontract Regulation, B.C. Reg. 22/96, is amended by repealing the definition of “coastal area” and substituting the following:

“coastal area” means the area within

(

a) one or more tree farm licences located in either or both of the South Coast Forest Region or the West Coast Forest Region, as established by the Administrative Boundaries Regulation,

(

b) Tree Farm Licence 41, or

(

c) one or more of the Arrowsmith Timber Supply Area, Fraser Timber Supply Area, Kingcome Timber Supply Area, Mid-Coast Timber Supply Area, North Coast Timber Supply Area, Queen Charlotte Timber Supply Area, Soo Timber Supply Area, Strathcona Timber Supply Area or Sunshine Coast Timber Supply Area; .

Schedule 2 of the Woodlot Licence Planning and Practices Regulation, B.C. Reg. 21/2004, is amended in the column under the heading “Forest District”

(

a) opposite items 14 to 18 by striking out “ Headwaters ” and substituting “ Thompson Rivers ”,

(
