Section 0.1 of the Society for the Prevention of Cru- elty to Animals Act,

chapter S-12 of the Revised Statutes, 1973, is amended by adding the following definition in alphabetical order: 1 L’article 0.1 de la

11.1(2) A person who violates or fails to comply with subsection (1) commits an offence punishable under

Part II of the Provincial Offences Procedure Act as a category D offence. 11.1(2) Quiconque contrevient ou omet de se conformer au paragraphe (1) commet une infraction punissable en vertu de la

Section 12 of the Act is amended by striking out “27, 28” and substituting “27, 27.1, 28”. 4 L’article 12 de la Loi est modifié par la suppression de « 27, 28 » et son remplacement par « 27, 27.1, 28 ». 5

Section 16 of the Act is amended 5 L’article 16 de la Loi est modifié (

a) in subsection (1) in the portion preceding para- graph (

a) by striking out “five days” and substituting “3 business days”;

section 27 the following: 6 La Loi est modifiée par l’adjonction après l’article 27 de ce qui suit : 27.1(1) Where an animal protection officer has, on rea- sonable and probable grounds, reason to believe that an animal is confined in a motor vehicle and is in distress or is deprived of reasonable protection from injurious heat or cold, the animal protection officer or a person authorized by the animal protection officer may enter the motor ve- hicle, using the force the animal protection officer consid- ers necessary, for the purposes of attending to the needs of the animal. 27.1(1) Lorsqu’un agent de la protection des animaux, sur la foi de motifs raisonnables et probables, a des raisons de croire qu’un animal est enfermé dans un véhicule à moteur et est en détresse ou privé de protection raisonnable contre la chaleur ou le froid excessifs, l’agent de la pro- tection des animaux ou toute personne qu’il autorise, peut pénétrer dans tout véhicule à moteur, en utilisant la force qu’il estime nécessaire, afin de subvenir aux besoins de l’animal. 27.1(2) An animal protection officer may seize an ani- mal referred to in subsection (1) if the seizure is necessary to attend to the immediate needs of the animal. 27.1(2) Un agent de la protection des animaux peut sai- sir un animal visé par le paragraphe (1), si la saisie est

d) Texte de la disposition actuelle : 16(4) Where the owner of a seized animal cannot be identified within five days after the seizure or where an owner does not reclaim the seized animal thirty days after the seizure and does not pay the costs incurred in respect of the care and treatment of the animal, the ownership of the animal vests in the society. 16(4) Lorsque le propriétaire d’un animal saisi ne peut être identifié dans un délai de cinq jours après la saisie ou lorsque le propriétaire ne réclame pas l’animal saisi dans un délai de trente jours après la saisie et qu’il n’acquitte pas les frais engagés pour les soins et le traitement de l’animal, la propriété de l’animal est dévolue à la Société. (
