B.C. Reg. 258/2010 , deposited September 10, 2010, pursuant to the FINANCE STATUTES AMENDMENT ACT, 2010 [Section 68] and the HOME OWNER GRANT ACT [Sections 18 (2) (d.1) and (d.2) and 18.2 (1)]. Order in Council 565/2010, approved and ordered September 9, 2010.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) sections 39 to 42 of the Finance Statutes Amendment Act, 2010 , S.B.C. 2010, c. 4, are brought into force, and

(

b) the Home Owner Grant Regulation, B.C. Reg. 100/2002, is amended as set out in the attached Schedule.

Schedule

1 Sections 2 and 4 of the Home Owner Grant Regulation, B.C. Reg. 100/2002, are repealed.

Section 3 (1) is amended by striking out " , in

Schedule 1 of this regulation, " and substituting " , in the form approved by the minister, ".

Section 5 (

a) is amended by striking out " both in Form A of

Schedule 2 of this regulation, " and substituting " both in the form approved by the minister, ".

Section 6 is amended

(

a) in subsection (1) (

b) by striking out " in Form B of

Schedule 2 to this regulation, " and substituting " in the form approved by the minister, ",

(

b) in subsection (1) (b) (

i) by striking out " the person named in Form B " and substituting " the person named in the certificate ", and

(

c) by repealing subsection (2) and substituting the following:

(2) An owner who

(

a) has filed a certificate under subsection (1) (b) (ii), and

(

b) has indicated in the certificate that the owner

(

i) is incurring costs for physical assistance in the principal residence that exceed the monthly amount set out in subsection (1) (a) (i), or

(ii) has incurred costs for structural modifications to the principal residence that exceed the amount set out in subsection (1) (a) (ii),

must retain, for 6 years from the date on which the certificate is filed, the original receipts and documentation setting out the actual expenditures made for physical assistance or structural modifications, as applicable.

5 Schedules 1 and 2 are repealed.
