2 and Food, SASKATCHEWAN, as represented by the Minister of Agriculture and Food, ALBERTA, as represented by the Minister of Agriculture, Food and Rural Development, BRITISH COLUMBIA, as represented by the Minister of Agriculture, Food and Fisheries, referred to as the "Provinces". Canada and the Provinces are referred to as the "parties".

WHEREAS all parties recognize the need for a timely program response to income disasters facing farmers;

WHEREAS all parties desire to respond to this need in an effective way that contributes to the health and stability of the Canadian primary agricultural sector;

WHEREAS all parties desire that income disaster assistance programming conforms to the basic requirements of the World Trade Organization Agreement on Agriculture, Annex 2, paragraphs 1, 6 and 7 related to non-actionable income safety net programs and that such programming be offered to all farmers in Canada on equitable terms;

WHEREAS a framework agreement between Canada and each of the Provinces has been concluded which provides a basis for federal-provincial negotiation and management of agricultural risk management programs which are eligible or count,d for federal-provincial cost-sharing; and Canadian Farm Income Program Agreement .../2

WHEREAS the framework agreement provides for an income disaster assistance component, defines the parties' responsibilities relative to this component, and provides for the development of agreements setting out the design parameters and operation of this component; THEREFORE, THE PARTIES agree as follows: 1.0

DEFINITIONS 1.1 "Administration" means the Federal or Provincial Administration that is responsible for the delivery of the Program under this Agreement. 1.2 "Agreement" means the Federal-Provincial Agreement Establishing the Canadian Farm Income Program and includes any Appendices and Provincial Annexes approved pursuant to the Agreement. 1.3 "AIDA Program" means the Agricultural Income Disaster Assistance Program. 1.4 "Claim Year" means the tax year for which an application for payment under the Program is submitted. 1.5 "Claim Year Margin" means the margin calculated for an applicant for a Claim Year and as further defined in this Agreement. 1.6 "Common Disaster Program Conditions" means the Program eligibility and payment calculation provisions which are common to Canadian Farm Income Program Agreement ...13

- 4 - Canada and all Provinces and under which federal-provincial cost-shared payments shall be made to farmers. 1.7 "Credited Program" means a overnment- funded program providing direct payments to farmers that Canada and a Province have agreed shall be credited towards the Province's share of Program costs when payments received by applicants reduce the amount of Program payments. 1.8 "Federal Compensation" means the payments issued in the name of Canada to eligible applicants under the Program. 1.9 "Federal Contribution" means the Federal Compensation plus the share of the administrative costs related to the Program that are payable by Canada. 1.10 "Federal Minister" means the federal Minister of Agriculture and Agri-Food.

"Framework Agreement" means the Framework Agreement on Agricultural Risk Managemmt implemented on a bilateral basis between Canada and each Province. 1.12 "Income Tax Act' . means the federal Income Tax Act. 1.13 "NISA Agreement" means the Federal- Provincial Agreement Establishing the Net Income Stabilization Account Program. - 5 - 1.14 "NISA Program" means the Net Income Stabilization Account Program. 1.15 "Program" means the Canadian Farm Income Proram (CFIP). 1.16 "Province-based Income Disaster Assistance Program" means the British Columbia Whole Farm Insurance Program, the Alberta Farm Income Disaster Program, the Ontario Whole Farm Relief Program, the Prince Edward Island Agricultural Disaster Insurance Program, or as any successor programs to these are so named. 1.17 "Provincial Annex" means an annex to the Agreement governing matters necessary to accommodate the delivery of the Program in a Province and providing for other matters between Canada and the Province where specifically provided for under the terms of the Agreement. 1.18 "Provincial Compensation" means the payments issued in the name of the Province to eligible applicants under the Program. 1.19 "Provincial Contribution" means the Provincial Compensation plus the share of the administrative costs related to the Program that are payable by the Province. 1.20 "Reference Period" means a period of three years preceding the Claim Year in reference to Canadian Farm Income Program Agreement . ./5

- 6 - which an applicant's payment for a Claim Year is calculated. 1.21 "Reference Period Margin" means the average margin calculated for an applicant for the Reference Period and as further defined in this Agreement. 1.22 "Signatories" means the Ministers for Canada and the Provinces or their delegated representatives. 1.23 "Supplemental Disaster Program Conditions" means the Program eligibility and payment calculation provisions which are not part of the Common Disaster Program Conditions unless otherwise specified in the Agreement. 2.0 PURPOSE 2.1 The purpose of this Agreement is to establish a program to assist farmers in Canada facing a serious decline in their Claim Year Margins for the 2000, 2001 and 2002 Claim Years due to circumstances beyond their control. 3.0 STRUCTURE OF AGREEMENT National 3.1 This Agreement outlines the terms and Agreement conditions for funding, management, and delivery of the Program that shall apply in all Provinces unless otherwise provided for in this Agreement.

-7 Provincial Annex Program Guidelines 3.2 Appendix A to this Agreement sets out the Common Disaster Program Conditions to be funded by all parties. 3.3 The Administration shall follow the verification and payment approval principles set out in Appendix B to this Agreement. 3.4 There shall be federal-provincial cost-sharing of expenses incurred by the Administration in the delivery of the Program in accordance with the principles set out in Appendix C, Administrative Cost-Sharing Principles. 3.5 Separate Provincial Annexes to this Agreement shall be agreed to by Canada and each Province.

The relevant annex shall form part of the Agreement between Canada and that Province. These annexes shall govern those matters necessary to accommodate provincial delivery of the Program and provide for other matters between Canada and a Province as provided for under the terms of this Agreement. 3.6 Program guidelines shall be established by the Administration to provide the details on Program eligibility and payment calculation and any other

interpretation or clarification required for the proper operation of the Program on a consistent basis with the Agreement and across Provinces. These guidelines shall be published following their approval through an exchange of letters between the Administration and the other Appendix A - Common Disaster Program Conditions Appendix B - Verification and Payment Approval Appendix C - Administrative Cost-Sharing Principles Canadian Farm Income Program Agreement .../7

- 8 - party for whom the Administration is delivering the Program. 4.0 BASIS OF PAYMENT TO APPLICANTS Claim Years Program Eligibility 4.1 An applicant may submit an application for payment under the Program for the 2000, 2001, and 2002 tax years. These years are known as the 2000, 2001, and 2002 Claim Years, respectively. 4.2 Applicants are eligible to apply for a payment under the Program if they meet the requirements of the Common Disaster Program Conditions set out in

section 1.0 of Appendix A or, if applicable, the Supplemental Disaster Program Conditions set out in subsection 4.6 of this Agreement. Calculation of Payment 4.3 The payment amount that may be issued to an eligible applicant shall be calculated, for each Claim Year, on the basis of farm income reported for tax purposes or, pursuant to subsection 4.6.2 of this Agreement, which would have otherwise been reported for income tax purposes, pursuant to the payment calculation provisions set out in

section 2.0 of Appendix A. The payment amount shall be reduced, if required, pursuant to subsection 5.5 of this Agreement. Initial payment 4.4 The Administration may issue an initial payment, calculated pursuant to subsection 4.3 or 4.5, prior to completing processing of all Canadian Farm Income Program Agreement .../8

- 9 - applications for the Claim Year, subject to subsection 7.6 of this Agreement. Interim payment 4.5 Notwithstanding subsection 4.3, Program guidelines ma? establish conditions under which applicants may receive an interim payment for the Claim Year. Applicants receiving a payment on this basis shall be required to submit a final application for the same Claim Year on the basis of their actual farm income for that year. Applicants shall repay any amounts received in excess of the payments calculated according to their final applications.

Applicants failing to submit a final application shall repay the interim payment within the time period set out in the Program guidelines. Supplemental Disaster 4.6 Subject to paragraph 7.4 (

a) of the Framework Program Conditions Agreement and notwithstanding any indication to the contrary in Appendix A, an applicant shall be eligible under the Program and shall receive Federal Compensation, and, unless indicated to the contrary in the applicable Provincial Annex, Provincial Compensation, pursuant to the following Supplemental Disaster Program Conditions. Canada agrees to accept any proposed amendment to a Provincial Annex which allows for the provision of such Supplemental Disaster Program Conditions. Canadian Farm Income Progr im Agreement .../9

-10- Production -share 4.6.1 Reported income may include income income earned under a production-share contract, to the extent that the receipt of this income was dependent on both production and price risk as further defined in the Program guidelines. Status Indians 4.6.2 Status Indians farming on a reserve, who meet the requirements of paragraphs 1.1 to 1.3 of Appendix A, may apply for a payment even if they have not reported their farm income for tax purposes.

Their applications shall be based on the farm income that they would have otherwise reported for tax purposes on the basis of the requirements of the Income Tax Act. Applications and 4.7 An applicant, in order to be eligible to receive deadlines a payment, shall submit a completed application for a Claim Year by the deadline established by the Administration and in a manner prescribed by the Administration. An application shall only be verified for payment once it is a completed application.

No entitlement to payment 4.8 No applicant is entitled to a payment under the Program by right, or by having applied for a payment under the Program. Payments to applicants shall be made on the basis of the Program eligibility and payment calculation provisions established under this Agreement, and any other adjustments or limitations as set out in this Agreement. Payments to applicants shall be made by the Administration where the Canadian Farm Income Program Agreement .../10

applicants' eligibility for payment has been confirmed and the amount of the payment has been calculated in accordance with the terms of this Agreement.

Obligation to demonstrate eligibility for payment Social Insurance Numbers and Business Numbers Verification and audit of applications False or misleading statements 4.9 The onus is on applicants to demonstrate, to the satisfaction of the Administration, that their farming operation is eligible to receive a payment under the terms of the Agreement. 4.10 The Administration shall require all individuals applying under the Program to provide their Social Insurance Numbers (SIN).

Entities applying under the Program shall be required to provide their Business Numbers (BN) as used for income tax filing purposes and the SIN of each corporate shareholder or co-operative member that is to be considered in the determination of their payments. 4.11 The Administration shall require in the application that the applicant consent to the verification of the information used to calculate their payments from all relevant sources, including, but not limited to, their income tax records and information collected under other federal and provincial programs. 4.12 Applicants who are found to have submitted false or misleading information for the purpose of receiving a payment may be ineligible to receive payments over the life of the Program, in accordance with the Program guidelines. 4.12.1 Notwithstanding subsection 4.12, Canadian Farm Income Program Agreement .../11

- 12 - where a Province is responsible for the administration of the Program and the Province has legislation that sets out penalties for submission of false or misleading information with the intent of receiving a payment, the Province's legislation shall apply. Repayment of 4.13 Applicants shall be required to repay the overpayments amount of any overpayment.

In addition, in Provinces where Canada is responsible for the administration of the Program, applicants shall be required to pay interest on the outstanding amount, at the previous month's average ninety (90) day Treasury Bill tender rates plus two (2) percent, adjusted quarterly.

Where a Province is responsible for the administration of the Program, interest shall be charged on any outstanding amounts in accordance with the Program guidelines. 5.0 FUNDING AND COST -SHARING Available federal 5.1 Canada's funding under the Program is funding subject to an appropriation of funding by subject to the deduction provided for in subsection 7.1 of the Framework Agreement. If, at any time during the duration of this Agreement, Parliament or a provincial legislature changes its funding, the parties agree to renegotiate this Agreement and their participation in the Program.

-13- estimates by province Available provincial funding of the Framework Agreement, Canada shall advise Provinces of the forecasted federal expenditures under the Program by Province no later than September 1 of the Claim Year to which the funding Npplies. For the 2000 Claim Year, Canada shall provide its expenditure estimate within thirty (30) days of the signing of this Agreement. 5.3 The Provincial Contribution shall be set on the basis of subsection 7.3 and paragraph 7.4 (

a) of the Framework Agreement, specifically: (1) the maximum Provincial Contribution shall be established as two-thirds (2/3) of the forecasted federal expenditures in the Province for the Common Disaster Program Conditions for each Claim Year plus the Supplemental Disaster Program Conditions unless otherwise indicated in the applicable Provincial Annex; or (2) the Provincial Contribution shall be established as two-thirds (2/3) of the actual federal expenditures in the Province for the Common Disaster Program Conditions for each Claim Year plus the Supplemental Disaster Program Conditions unless otherwise indicated in the applicable Provincial Annex. 5.3.1 The method by which the Canadian Farm Income Program Agreement .../13

- 14 - Provincial Contribution shall be set, and the establishment of the maximum Provincial Contribution, if applicable, may be identified in the applicable Provincial Annex or agreed to by Canada and the Province, through an exchange of letters, within thirty (30) days of Canada advising Provinces of the forecasted federal expenditures under the Program, but no later than October 1 of the Claim Year. 5.3.2 For the 2000 Claim Year, the method by which the Provincial Contribution shall be set, "and the establishment of the maximum Provincial Contribution, if applicable, may be identified in the applicable Provincial Annex or agreed upon, through an exchange of letters, within sixty (60) days of the signing of the Agreement.

Federal-provincial cost-sharing 5.4 Subject to subsection 5.5 and the funding and payment limits set out in the applicable Provincial Annex, Canada and each Province shall share, on the basis of a 60:40 ratio, the cost of payments to eligible applicants pursuant to the Common Disaster Program Conditions and the Supplemental Disaster Program Conditions, unless otherwise Canadian Farm Income Program Agreement .../14

- 15 - indicated in the applicable Provincial Annex, as well as the administrative costs related to issuing those payments in the Province. Canada shall pay its sixty (60) percent share of payments related to the Supplemental Disaster Program Conditions which are not cost-shared by the Province, as well as one hundred (100) percent of the incremental administrative costs related to issuing those payments in the Province, subject to subsection 5.5.

Proration of Federal 5.5 The Federal Compensation shall be prorated, and Provincial if necessary to keep within approved funding Compensation levels, on the same basis across Provinces for a Claim Year, subject to subsection 7.5 of the Framework Agreement. (

a) Where the Provincial Contribution is established pursuant to paragraph 5.3(a), the Provincial Compensation may be prorated if necessary to keep within the maximum Provincial Contribution. (

b) Where the Provincial Contribution is established pursuant to paragraph 5.3(b), the Provincial Compensation may be prorated, on the same basis as Canada for a Claim Year, subject to subsection 7.5 of the Framework Agreement. (

c) Notwithstanding subsection 7.5 of the Framework Agreement, for the Canadian Farm Income Program Agreement .../1 5

-16- purposes of this subsection, the Supplemental Disaster Program Conditions set out in paragraphs 4.6.1 and 4.6.2 shall be considered Common Disaster Program Conditions. Credited Programs 5.6 Credited Programs shall be identified in the applicable Provincial Annex. The Provincial Compensation shall be credited by the amount by which payments under Credited Programs reduce the Program payments to applicants. The amount of this reduction is the difference between the calculated Program payment and the amount that would have been paid if the payment under the Credited Program was not received by an applicant.

These credits shall be provided either at the time each Program payment is made or as part of the reconciliation of cost-sharing for all payments following the finalization of all payments for a Claim Year. The method chosen shall be approved through an exchange of letters between the Administration and the party for which the Administration is delivering the Program. - 17- 6.0 PROGRAM ADMINISTRATION Responsibility for 6.1 The Program shall be administered by administration Canada, unless otherwise agreed to by Canada and a Province in the applicable Provincial Annex. Delegation of administrative responsibility Delivery of payments under Supplemental Disaster Program Conditions Principle for data-sharing 6.2 Where a Province has assumed responsibility for the administration of the Program pursuant to subsection 6.1, the applicable Provincial Annex may identify an organization to which all or part of the responsibility for the administration of the Program shall be delegated.

The applicable Provincial Annex may also specify that the Federal Contribution be directed to that organization. 6.3 The Administration may deliver payments under Supplemental Disaster Program Conditions on behalf of another party to this Agreement, where mutually agreed in the applicable Provincial Annex, subject to the principles set out in Appendix C, Administrative Cost-Sharing Principles. 6.4 The Administration shall provide to the party that is not issuing payments all data collected in the administration of the Program in that Province where its provision does not contravene the rights of any applicant under those laws of Canada and the applicable Province respecting the privacy of personal information.

Specifically, the Administration shall, on a regular basis, provide the other party with an updated copy of applicant Canadian Farm Income Program Agreement .../17

- 18 - databases for the purposes of forecasting Program costs and analyzing the Program. 6.5 Canada shall, on a regular basis, provide each pikwincial Administration with data on the NISA and AIDA Programs for the purposes of processing and verifying applications under the Program, forecasting Program costs and analyzing the Program. 6.6 For the purposes of subsections 6.4 and 6.5, Canada and each Province commit to use the data only for the purposes of fulfilling the terms of the Agreement. Canada and a Province may agree to other uses of the data through an exchange of letters.

Access to 6.7 The party responsible for the administration of documentation the Program shall allow representatives of the other party to access any records, information, databases, and other documentation for the purpose of Program audit and evaluation, and for the verification of invoices with respect to payments to applicants and administrative costs. Both parties shall retain all documentation for a minimum of six (6) years after issuing the final payments under the Program.

Application 6.8 The Administration shall establish, in Review consultation with the other party, a process to hear requests from applicants for a review of their application information related to the application of the terms of the Agreement and Program guidelines. - 19- applicable Province shall each appoint an equal number of representatives to the review body established for this purpose in the Province. The review body will provide recommendations to the Administration based on its decisions. In the event that the Administration decides not to follow the recommendation of the review body, the Administration will consult with the other party prior to implementing its decision. The Administration shall inform the review body of its final determination on the reviews that have been conducted.

Federal -provincial 6.9 A committee shall be established to monitor committee the application of the terms of the Agreement and Program guidelines and to provide advice and guidance on administrative and policy issues related to the Program.

The structure, responsibilities and reporting requirements of this committee shall be set out through an exchange of letters by the Signatories to this Agreement within ninety (90) days of the signing of the Agreement. 7.0 FINANCIAL MANAGEMENT Advances and 7.1 The Administration shall invoice the other reconciliation party for its estimated share of payments based upon an agreed-to period. The invoiced party shall pay the invoiced amount within thirty (30) days of receipt of the invoice.

The advances shall be accounted for by the Administration on a basis consistent with the Canadiah Farm Income Program Agreement .../19

-20- invoicing period through a reconciliation of the amount advanced with actual payments (as documented by data shared in accordance with subsections 6.4 to 6.6) made to applicants. Upon termination of the Program by one of the parties, any outstanding amount identified on the final reconciliatiorkshall be paid or reimbursed to the appropriate party. 7.2 The Administration shall invoice the other party for its estimated share of administrative costs based upon an agreed-to administrative budget and invoicing period.

The party that is incurring the administrative costs shall provide an administrative budget for the fiscal year for the approval of the contributing party prior to payment of any invoices. The invoiced party shall pay the invoiced amount within thirty (30) days of receipt of the invoice. The advances shall be accounted for by the Administration on a bass consistent with the invoicing period through a reconciliation of the amount advanced with paid administrative costs eligible for cost- sharing.

Administrative costs eligible fol cost-sharing must be consistent with Appendix C, Administrative Cost-Sharing Principles and any other terms as agreed in an exchange of letters between the parties. Upon termination of the Program by one of the parties, any outstanding amount identified on the final reconciliation shall be paid or reimbursed to the appropriate party. -21 7.3 Interest on payments made under subsections 7.1 and 7.2 shall be calculated on balances advanced to the other party on the average daily closing balance of advances that remain outstanding (as evidenced by a reconciliation of amounts advanced to actual payments or administrative costs). The calculated interest shall be credited monthly to the account of the party that advanced the funds. The rate of interest shall be ninety (90) percent of the monthly average of the weekly three-month Treasury Bill tender rates for the month immediately preceding the month in respect of which interest is paid. (

a) Once the invoiced amount is accepted by the invoiced party, that party agrees to pay to the Administration interest on accepted invoiced amounts not paid within thirty (30) days. Repayment of 7.4 Pursuant to subsections 9.2 and 9.3, any advances amount owing by one party on account of advances made under subsections 7.1 and 7.2 shall be repaid within thirty (30) days of the receipt by both parties of the final audited reconciliation of payments made and administrative costs incurred.

Financial 7.5 The parties agree to share, on a timely basis, forecasting all information required to forecast their respective financial commitments under the Program and to allow for the establishment of Canadian Farm Income Program Agreement .../21

- 22 - initial and final payment levels and to determine whether the proration of payments will be necessary. Establishment of 7.6 Canada and each Province shall determine the initial payment level of initial payments provided for under levels subsection 4.4 as they relate to their respective shares of contributions under the Program. The Federal Minister shall establish the initial payment level for the Federal Compensation in all Provinces.

Collection of 7.7 The responsibility, on behalf of both overpayments contributing parties, for the collection of Program overpayments rests with the party responsible for the Administration, except in the situations outlined in subsections 10.9 and 10.10. Reporting on 7.8 The party responsible for the Administration overpayments shall provide the other party with detailed and timely reports regarding any overpayments to applicants.

Set-offs of 7.9 Outstanding overpayments under the Program overpayments or the AIDA Program shall be set off against any subsequent program payments under this Program; these set-offs shall be applied against overpayments by both parties in proportion to the cost-sharing related to that payment. Overpayments made under the Program may also be collected through set-offs against other federal or provincial programs as established through an exchange of letters by Signatories to the Agreement. -23- Set-offs of other Crown debts 7.10 Set-offs of other federal or provincial Crown debts against payments under the Program shall be addressed through an exchange of letters by Signatories to the Agreement. 8.0 COMMUNICATIONS Public information and communications Recognition of Canada's participation 8.1 All public information and communications activities for the Program shall fairly reflect the contributions of the parties to this Agreement. 8.2 Canada's participation shall be identified as follows: the Government of Canada wordmark prominently placed on all communications products, including, but not limited to, brochures, handbooks, cheques, and posters.

The size of the wordmark shall in no case be smaller than any provincial wordmark. Agriculture and Agri-Food Canada's participation in the Program shall be shown by the use of the departmental wordmark. The departmental wordmark shall be shown in both English and French and the predominate language in which the material is being written shall determine which language is presented first. 8.3 Copies of all communications materials for publication which are drafted by a Province shall be submitted t( Canada for review and comment before publication to ensure that the Canadian Farm Income Program Agreement .../23

- 24 - content is compatible with the terms of subsection 8.1 of this Agreement. 8.4 Announcements involving Canada's funding shall be publicized in a news release jointly approved by Canada and the applicable Province. All news releases shall list a federal contact. Recognition of 8.5 A Province's participation shall be identified Province's as follows: the provincial wordmark participation prominently placed on all communications products, including, but not limited to, brochures, handbooks, cheques, and posters. The size of the wordmark shall in no case be smaller than Canada's wordmark.

A provincial ministry's participation in the Program shall be shown by the use of the ministry wordmark. 8.6 Copies of all communications materials drafted by Canada related to a Province shall be submitted to the Province for review and comment before publication to ensure that the content is compatible with the terms of subsection 8.1 of this Agreement. 8.7 Announcements involving a Province's funding shall be publicized in a news release jointly approved by Canada and the applicable Province. - 25 - Language of 8.8 All publications and other materials shall be communications made available in both English and French. Service to the public under the Program shall be provided in an applicant's choice of either English or French. Canada shall assist the Provinces in meeting these requirements and pay for one hundred (100) percent of any resulting costs in Provinces where the provision of service in both English and French is not required under law. 9.0 EVALUATION AND AUDIT Program evaluation 9.1 An independent evaluation shall be conducted to assess the effectiveness of the Program.

Canada and the Provinces shall agree to the terms of reference for this evaluation by no later than March 31, 2001. This evaluation shall be completed by no later than March 31, 2003. Compliance Audit 9.2 Canada shall be responsible, at its expense, to ensure an independent audit is conducted to determine that the Program has been administered in accordance with the terms and conditions set out in this Agreement. Where practical and to avoid any duplication, Canada will coordinate this audit with any similar audit undertaken by a Province with respect to the Province's share of the Program.

This audit shall be completed by no later than twenty-one (21) months after each Claim Year. Canadian Farm Income Program Agreement .../25

-26- Annual audited reconciliation of payments and administrative costs 9.3 An annual independently audited reconciliation of payments and administrative costs under the Program for each Province shall be provided by the Administration to the parties for which it is\tdministering the Program no later than nine (9) months after the Administration's fiscal year end. 10.0 GENERAL PROVISIONS Link to the Framework Agreement Amendments - general Amendments to Provincial Annexes Coming into 10.1 Except as otherwise provided, this Agreement is subject to the terms of the Framework Agreement on Agricultural Risk Management signed by Canada and each of the Provinces. 10.2 This Agreement may be amended with the agreement of Canada and all Signatory Provinces. 10.3 Notwithstanding subsection 10.2, a Provincial Annex may be amended, or added, at any time with the agreement of Canada and the applicable Province. 10.4 This Agreement between Canada and any one force Province shall come into force on the date that the Minister(

s) for that Province add their signature(

s) to that of the Federal Minister on this Agreement and the Provincial Annex for that Province. Duration 10.5 Subject to subsection 10.6, following the coming into force of this Agreement in a Province, the Agreement shall continue to Canadian Farm Income Program Agreement .../26

-27- apply for the 2000 to 2002 Claim Years and remains in effect until all payments have been made to eligible applicants from the Province and the obligations of Canada and the Province under this Agreement have been fulfilled. Termination 10.6 Canada and a Province may agree to terminate the Agreement in respect of the Province. Such agreement must be reached prior to the issuance to applicants of payments funded by the party not responsible for the administration of the Program for the first Claim Year covered by the termination.

For greater certainty, the Agreement continues in respect of all Claim Years for which payments have been issued until all obligations under the Agreement are fulfilled for those Claim Years.

Indemnification of the Crown Representation by a party. 10.7 The Administration shall indemnify and save harmless the other party, its Minister, his or her officers, servants and agents against all claims, demands, losses, damages, actions and other proceedings made by any third party arising out of the administration of the Program. 10.8 Nothing in this Agreement is to be construed as authorizing one party to contract or incur any obligation on behalf of the other party, unless specifically authorized by this Agreement. -28 Eligibility of Members 10.9 of the House of Commons ) No Member of the House of Commons shall be allowed to derive any financial advantage resulting from Federal Compensation under this Agreement. Canada shall be fully responsible for paying any incremental costs related to the administration of this provision and for recovering any overpayments made as a result of its contravention by an applicant. Where a Province is responsible for the administration of the Program, Canada shall provide the Province with assistance to administer this provision.

Eligibility of current or former federal public office holders or public servants 10.10 Applicants who are not in compliance with the federal Conflict of Interest and Post- Employment Code for Public Office Holders or the federal Conflict of Interest and Post- Employment Code for the Public Service shall not derive a direct benefit from Federal Compensation under this Agreement. Canada shall be fully responsible for paying any incremental costs related to the administration of this provision and for recovering any overpayments made as a result of its contravention by an applicant.

-29- Registration of lobbyists 10.11 The Administration shall ensure that a person lobbying, as defined in the federal Lobbyists Registration Act, on behalf of an applicant in that Province is registered pursuant to the Act. For greater clarity, this Act excludes from registration, among others, members of the legislature of a province or territory or their staffs and employees of provincial and territorial governments. - 3 - Estates Partnership interests Provincial eligibility requirements limit. 1.9 An estate may apply on behalf of a deceased individual where that individual met the requirements of paragraphs 1.1 to 1.3 and reported farm income for tax purposes for the Claim Year or, where subsection 4.6.2 of this Agreement applies, would have otherwise reported farm income for tax purposes for the Claim Year. 1.10 The farm income derived from the interest of an individual, trust, or entity in a partnership shall be reported on the Program application by the individual, trust, or entity in the same way that it is reported for income tax purposes.

Further eligibility criteria that relate to a particular Province's legislative requirements for farm registration and the definition of farming activity may be established in the applicable Provincial Annex. 2.0 PAYMENT CALCULATION Basis of accounting 2.1 For the Claim Year Margin, applicants must use the basis of accounting used for their income tax records and as further defined in paragraphs 2.3 and 2.5. For the Reference Period Margin, applicants must use NISA records for any year in which they participated in NISA. For any year the Canadian Farm Income Program Agreement ...13 Appendix A

- 2 - under the Program if they have reported farm income for tax purposes for the Claim Year, if they meet the requirements of paragraphs 1.2 to 1.3 and if they can identify shareholders in the corpolation who meet the requirements of paragraph 2.15 or members of the co- operative that are actively, involved in the day- to-day farming operations of the entity. Publicly-funded institutions such as hospitals, research centres, universities, colleges and correctional institutions are not considered eligible entities for purposes of this Agreement.

Trusts 1.7 A trust is eligible to apply for a payment under the Program if the beneficiaries of the trust meet the requirements of paragraphs 1.1 to 1.3 and have reported farm income for tax purposes for the Claim Year or, where subsection 4.6.2 of this Agreement applies, world have otherwise reported farm income for tax purposes for the Claim Year. A trust shall be treated as one individual applicant regardless of the number of beneficiaries.

Communal 1.8 A communal organization is e igible to apply organizations for a payment under the Program if the organization has reported farm income for tax purposes for the Claim Year, if it meets the requirements of paragraphs 1.2 to 1.3 and if it can identify individuals in the organization that are actively involved in the day-to-day farming operations of the organization. APPENDIX A COMMON DISASTER PROGRAM CONDITIONS 1.0 ELIGIBILITY Active farming 1.1 Applicants must have been actively farming in the Claim Year in the Province from which they apply. Consecutive 1.2 Applicants must have completed a minimum farming of six consecutive months of farming activity activity in the Claim Year. Production 1.3 Applicants must have completed a production cycle cycle in the Claim Year.

Notwithstanding this, applicants who are unable to complete a production cycle in the Claim Year due to natural hazards beyond their control shall be deemed to have completed a production cycle, in accordance with the Program guidelines. Provincial Individuals 1.4 Applicants shall apply to the Province in application which they reported farm income for tax purposes for that Claim Year. 1.5 Individuals are eligible to apply for a payment under the Program if they meet the requirements of paragraphs 1.1 to 1.3 and have reported farm income for tax purposes for the Claim Year.

- 4 - applicant did not participate in NISA, income tax records shall be used. Applicants who use the accrual method of accounting for NISA or income tax purposes shall use the accrual method for calculating the Reference Period Margin. Applicants who use the cash method of accounting for NISA or income tax purposes shall usL e,th' the cash method or modified accrual method to calculate their Reference Period Margin.

Modified accrual accounting means adjusting for changes in inventory quantity and accrual accounts (e.g., accounts payable, accounts receivable and prepaid expenses) or including mandatory and optional inventory adjustments in cash-basis income and expenses as allowed under the Income Tax Act. The method that shall apply in a Province shall be established in the Program guidelines.

If the applicant changed the method of accounting used for NISA or income tax purposes during the Reference Period, the Administration, at its discretion, shall determine the method of accounting to be used for calculating the Reference Period Margin. 2.1.1 Notwithstanding paragraph 2.1, a Province may further specify in the applicable Provincial Annex the methods of accounting that may be used for calculating applicants' Claim Year and Reference Period Margins, while respecting the conditions of paragraph Canadian Farm Income Program Agreement ...14 Appendix A

- 5 - 2.5 on inventory valuation.

Payment formula Claim Year margin 2.2 An applicant's maximum payment shall be calculated as the amount by which the applicant's Claim Year Margin falls below seventy (70) percent of the applicant's Reference Period Margin., 2.3 An applicant's Claim Year Margin shall be calculated on a whole-farm basis, including modified accrual accounting adjustments, and shall include all revenue reported as farm income, including payments reported as farm income from other federal or provincial programs with the exception of payments made under this Program, the AIDA Program, and other Province-based Income Disaster Assistance Programs, minus all expenses reported as farming expenses, excluding expenses related to capital acquisition, non- farming activities, depreciation, and payments to family members not meeting the criteria set out in paragraph 2.4.

Family labour 2.4 In determining whether payments to family criteria members are deductible as farming expenses in the calculation of the Claim Year and Reference Period Margins, the Administration shall consider as a minimum the following criteria: (

a) whether changes of more than fifteen (15) percent in the amount of such payments in the Claim Year compared to the preceding year are justified in the Canadian Farm Income Program Agreement .../5 Appendix A

- 6 - farm operation, (

b) whether tax information slips (T4) are issued for all such payments, and (

c) whether such payments were made in the Reference Period.

Inventory 2.5 Applicants who report their farm income valuation for tax purposes using the accrual method of accounting shall value the inventory for Program purposes on the same basis as used for income tax purposes; all other applicants shall adjust for the change in inventory on the basis of the prices at the end of the Claim Year, with the exception of cases where, at the discretion of the Administration, an alternative method of valuing inventory change may be applied which improves the accuracy of the Claim Year Margin calculation and does not result in a higher payment than would otherwise be paid.

Prior to the issuance of payments for the 2001 and 2002 Claim Years, Signatories to the Agreement shall determine, through an exchange of letters, whether any modification to this approach shall be made. Any changes shall be communicated to producers prior to the filing of information for the Claim Year to which the changes shall apply. Canadian Farm Income Program Agreement .../6 Appendix A

-7 Reference Period 2.6 An applicant's Reference Period Margin shall Margin be calculated on the same basis as the Claim Year Margin as set out in paragraph 2.3, excluding payments reported as farm income from other federal or provincial direct income support, programs, with the exception of indemnity payments for a physical loss under another program and as further defined in the Program guidelines. Modified accrual accounting adjustments shall not be included unless the applicant has specifically chosen to make such adjustments applicable to the Reference Period.

Except as provided for below, the applicant shall choose from one of the following: 2.6.1 an average margin of the three years immediately preceding the Claim Year; or 2.6.2 an average margin of three of the five previous years immediately preceding the Claim Year, excluding the highest and lowest margin years. Beginning farmers and applicants using the modified accrual method of accounting must calculate their Reference Period Margin on the basis of subparagraph 2.6.1. Negative margin 2.7 For the purpose of calculating an applicant's in claim year Claim Year Margin, a negative margin is deemed to be zero.

Farm scale and 2.10 Where an applicant's farming operation has structural undergone an expansion or contraction that, in adjustment the opinion of the Administration, is greater than a normal fluctuation, the Administration shall make adjustments to the Refc..cnce Period Margin or Claim Year Margin to account for one hundred (100) percent of any fluctuation that is beyond a fifteen (15) percent expansion or contraction between the size of the operation in the Reference Period and the operation in the Claim Year.

NISA Program 2.11 To avoid duplicate support payments, linkage for the 2000 Claim Year, payments under the Program shall be reduced through a linkage to the NISA Program which shall be based on the actual government contributions for the year prior to the claim if no payment was made under the AIDA Program or a Province-based Income Disaster Assistance Program for 1999. - 9 - negative, the amount being deducted shall be reduced by the negative margin portion. If a payment was made under the AIDA Program or a Province-bised Income Disaster Assistance Progam for 1999, no NISA Program linkage shall, be applied for the 2000 Claim Year. Pending the NISA Review, for the 2001 and 2002 Claim Years, for those in the NISA Program, the linkage to NISA shall be based on up to three years of actual government contributions where no prior claim under this Program, the AIDA Program or a Province-based Income Disaster Assistance Program has been made.

Combining non-arm's length applicants 2.12 Any farming activity or involvement undertaken by an applicant with other persons or entities may be combined to determine eligibility and to calculate payments under the Program. All farming activities undertaken by any person as a shareholder of a corporation that has reported farm income for tax purposes for the Claim Year and as an individual that has reported farm income for tax purposes for the Claim Year may be combined by the Administration to determine eligibility and to calculate payments under the Program, in accordance with the Program guidelines.

Individual 2.13 An individual payment limit of between payment limit $100,000 and $175,000 shall apply to all payments for a Claim Year. This individual payment limit shall be applied such that no individual, whether as an individual or as attributed through an entity pursuant to Canadian Farm Income Program Agreement .../9 Appendix A

- 10 paragraph 2.16, can receive a payment in excess of the individual payment limit. The cost-sharing commitment of each party shall be determined on the basis of its choice of individual payment limit. The Federal Compensation to each individual applicant shall be no more than sixty (60) percent of the individual payment limit of $175,000. The individual payment limit used in calculating the Provincial Compensation shall be set out in the applicable Provincial Annex.

Entity 2.14 An entity shall be eligible to receive an payment limit amount not exceeding the individual payment limit for each eligible corporate shareholder or co-operative member whose eligibility is attributed through the application of the entity pursuant to paragraph 2.16, up to a maximum of five times the individual limit.

Minimum common shares 2.15 For the purposes of calculating the Federal Compensation and, if specified in the applicable Provincial Annex, the Provincial Compensation, an eligible corporate shareholder is a shareholder who holds at least ten (10) percent of the voting or non-voting common shares of the corporation and is actively participating in the corporation's day- to-day farming operations. To determine shareholdings, shares shall be traced to individuals through any intermediary corporation.

For all other Provinces, for the purposes of calculating the Provincial Compensation, Canadian Famt Income Program Agreement .../10 Appendix A

eligible corporate shareholders are all shareholders who hold voting or non-voting common shares and are actively participating in the corporation's day-to-day farming operations. Attr;:autiou of shares 2.16 In calculating an entity's payment under the Program, the Administration shall attribute to the entity each eligible corporate shareholder's or co-operative member's share of the entity's total claim, up to the individual limit, to the extent that it has not already been used under another claim.

Individual and entity 2.17 The individual payment limit in linkage paragraph 2.13 and the entity payment limit in paragraph 2.14 shall be administered in such a manner that no payment attributed to an individual through a payment to an entity in a Claim Year shall cause the individual payment limit for that individual to be exceeded in the Claim Year. APPENDIX B VERIFICATION AND PAYMENT APPROVAL PRINCIPLES Objectives for the Verification of Claims 1. Notwithstanding any verification processes that are put in place by the administrators of the Program, in all circumstances, the onus of proof for any information provided, or claim made, rests with the applicant. 2. To have in place a visible process to verify that applicants are eligible to receive a payment under the Program and that the amount of the payment issued to an eligible applicant is plausible under the circumstances.

This process must seek to minimize the risk of payment errors at a reasonable cost while treating all applicants in a consistent manner. 3. To ensure that administrators meet the legislative requirements for the expenditure of public monies as required under the federal Financial Administration Act for the Federal Contribution and similar provincial legislation for the Provincial Contribution. This includes verifying that there are sufficient funds available, either federal or provincial, before making payments to eligible applicants.

Standards for the Verification of Claims Pursuant to the objectives described in this Appendix: 4. There must be an appropriately-designed process in place to verify if applicants are eligible to receive a payment under the Program and that the amount of the payment issued to eligible applicants is plausible under the circumstances. As part of this process, verifiers must perform a detailed review and assessment of the plausibility of the amounts reported by applicants under the claim and contact the applicants to discuss any issues raised.

The administration may also find it necessary, under certain circumstances, to perform an on-farm verification if the verifiers are Agricultural Income Disaster Assistance Program Agreement .../1 Appendix B

- 2 - unable to satisfactorily resolve all of the issues raised with applicants or if there are indications of fraud. 5. The verification work should be performed by persons having appropriate training, knowledge of accounting and auditing, of Lrming operations and practices, and of the rules governing the Program., The work should also be performed by persons with due care and objectivity, 6. The verification work must be adequately documented describing the nature, scope, and results of the verification activities to support the payments to eligible applicants. APPENDIX C ADMINISTRATIVE COST-SHARING PRINCIPLES For the purposes of this Appetlx, the party requesting payment for administrative costs incurred pursuant to the Agreement is referred to as the "claimant" and the party providing the funding is referred to as the "payer". 1. Only "reasonable, verifiable, supportable and incurred" operating costs applicable to Program delivery activities shall be eligible for reimbursement. All operating costs applicable to policy development and federal-provincial negotiations will not be eligible for reimbursement.

Depreciation charges on "verifiable and supportable" capital outlays will only be eligible for reimbursement to the extent that they represent unused capital carry-forwards on eligible AIDA Program capital purchases or were incurred after April 1, 2000 and pertain to the delivery of benefits to applicants. 2. Only those costs incurred to deliver program benefits subsequent to April 1, 2000 (the program's mutually-accepted start-up date), or prior to its mutually-accepted termination date, are eligible for reimbursement. 3.

Legal costs incurred for services related to or arising out of the administration of the Program are eligible for reimbursement where such costs are verifiable and supportable. 4. Leasehold improvements, capital asset purchases, and claimant systems with a useful life greater than March 31, 2004 are not eligible for immediate reimbursement. This includes the ownership component of rental rates paid on claimant equipment and vehicles.

However, eligible capital purchases during the period covered by the claim (for which depreciation/amortization costs can be claimed) include computer and office equipment, telecommunications equipment, office accommodation, office furnishings, leasehold improvements, mutually-acceptable systems Canadian Farm Income Program Agreement .../1 Appendix C

- 2 - development charges, and vehicles whose ownership costs are not included as part of an in-house charge-out rate. 5. Depreciation/amortization charges for eligible capital purchases (reduced by any residual value estimates) shall be calculated on a straight-line basis over their useful lives. 6. Capital gains and/or losses on any capital asset disposals made prior to the expiration of the assets' estimated useful life and/or the termination of the program (whichever comes first) shall not be eligible for reimbursement. 7.

Prior to April 1 of each fiscal year or the initial claim, whichever comes later, the claimant shall prepare a written annual budget of administrative costs. This administrative expense budget will show expenditure projections for all categories of eligible costs. This budget shall be presented to the payer, who will review it and obtain any necessary clarification as to its contents. Once this has been completed, both parties to the process will agree to an administrative expense budget for the fiscal period in question. 8.

All submitted "year-to-date" administrative costs for any given cost category which exceed the "year-to-date" amount budgeted for that category by more than ten (10) percent shall not be eligible for reimbursement without adequate and acceptable documentation being provided to the payer by the claimant. 9. Distributions of salary and other costs common to other programs administered by a claimant must be verifiable and supported by appropriate tracking systems and adjusted to processed payments, if they are based upon a system of estimates. 10. All claimant submissions shall be prepared on a cash basis.

Commitments to pay, other accruals, cost estimates, and imputed costs shall not be eligible for reimbursement by the payer. Canadian Farm Income Program Agreement .../2 Appendix C

Costs transferred from, or paid to, a claimant's in-house service delivery partners shall only be eligible for reimbursement to the extent that they do not include any profits, mark-ups, contributions to departmental (or corporate) overhead, or administrative surcharges. 12. Billings and cost transfers from other claimant departments and/or special operating agencies, which do not detail the nature of the costs incurred or are based upon cost estimates and/or transfers of budgeted amounts, shall not be eligible for reimbursement. 13.

Where there is a disagreement between a payer and a claimant concerning contributions towards a claimant's administrative costs, payer contributions towards the portion of the costs in dispute may be withheld or denied until the issues related to their eligibility under the Agreement have been resolved. 14. Requests for reimbursement of services under subsection 8.8 of the Agreement for the provision of service in both English and French must be separately identified in all submissions. 15.

Payroll benefits (e.g., severance pay, holiday pay, or living allowances) for claimant staff pertaining to their service prior to the start-up of the Program, unfunded superannuation costs, and unfunded insurance plan costs shall not be eligible for reimbursement. 16. If access to a claimant's records is denied to a payer's staff or its appointed external auditors, all submitted amounts so affected by this denial shall not be eligible for reimbursement. 17.

Minimum evidentiary (e.g., policy and procedure manuals, electronic/paper client services and public accounts records, contracts and purchase orders, third-party invoices, negotiated cheques, applications for benefits, or application assessment forms) standards for third-party payments, and inter- or intra-departmental cost transfers must exist and be made available (upon request) to a payer for Program monitoring and Canadian Farm Income Program Agreement .../3 Appendix C

5 audit. 18. Federal and provincial taxes paid by a claimant which are not dealt with by reciprocal taxation agreements shall not be eligible for reimbursement. 19. All interim submissions must be certified by one of the claimant's senior officials (and any of its final annual submissions must be certified by the person to whom the individual signing the interim submissions reported to); otherwise they shall not be eligible for reimbursement. 20. Province-specific "Joint (claimant/payer) Issues Resolution Committees" may be established in order to resolve cost-sharing issues requiring

a) Swine Quality Improvement Program Enhancement. 2.0 PROGRAM ADMINISTRATION Responsibility for administration 2.1 Pursuant to subsection 6.1 of the Agreement, the Province shall be responsible for the administration of the Program in the Province unless otherwise agreed through an exchange of letters by Signatories to this Annex that the responsibility for administration should revert to Canada. In the latter case, subsections 2.2 and 2.3 of this Annex shall be of no effect after the date of transfer.

Delegation of 2.2 Pursuant to subsection 6.2 of the Agreement, administrative the Province delegates its responsibility for responsibility the administration of the Program to the Prince Edward Island Agricultural Insurance Corporation. Any costs incurred by the Province to administer those Conditions shall be cost-shared by Canada and the Province pursuant to the terms of this Agreement. 3.0 PAYMENT CALCULATION Basis of accounting 3.1 Pursuant to paragraph 2.1.1 of Appendix A, Common Program Disaster Conditions, for the purpose of calculating Canada's and Prince Edward Island's share of payments, the basis of accounting shall be as follows: 3.1.1 Applicants who use the accrual method of accounting when reporting farming income for tax purposes shall use the accrual method to calculate their Claim Year and Reference Period Margins. 3.1.2 Applicants who use the cash method of accounting for tax purposes will use the cash method to calculate their Reference Period Margin and the modified accrual method to calculate their Claim Year Margin.

applicant's share in the partnership. 2.0 PROGRAM ADMINISTRATION Responsibility for administration Delegation of administrative responsibility Delivery of payments under Supplemental Disaster Program Conditions Review of applications 2.1 Pursuant to subsection 6.1 of the Agreement, Quebec shall he responsible fQr the administration of the Program In Quebec. 2.2 Pursuant to subsection 6.2 of the Agreement, Quebec delegates its responsibility for the administration of the Program to la Regie des assurances agricoles du Quebec ("la Regie").

Quebec directs Canada to issue all advances for Program payments and administration to la Regie. 2.3 Pursuant to subsection 6.3 of the Agreement, Quebec agrees to administer the Supplemental Disaster Program Conditions provided for under paragraphs 4.6.1 and 4.6.2 of the Agreement. Any costs incurred by Quebec to administer those Conditions shall be cost-shared by Canada and Quebec pursuant to the terms of the Agreement. 2.4 Pursuant to subsection 6.8 of the Agreement, Quebec shall establish, in consultation with Canada, a process to handle any requests from applicants for a review of their applications.

3.0 ELIGIBILITY -3 Farm registration Eligible commodities 3.1 An applicant's farming operation must be registered as an agricultural operation in Que'bec in accordance with the provincial Regulation respecting the registration of agricultural operations and the reimbursement of real estate taxes and compensation to be eligible for Quebec's share of payments under the Program. 3.2 For Canada's and Quebec's shares of payments, the only farm income included under the Program is that generated from agricultural commodities covered under both the provincial Regulation respecting the registration of agricultural operations and the reimbursement of real estate taxes and compensation and the Program guidelines. 4.0 PAYMENT CALCULATION Basis of accounting 4.1 Pursuant to paragraph 2.1.1 of Appendix A, Common Disaster Program Conditions, for the purpose of calculating Canada's and Quebec's share of payments, the basis of accounting shall be as follows: 4.1.1 Applicants who use the accrual method of accounting when reporting farm income for tax purposes shall use the accrual method to calculate their Claim Year and Reference Period Margins. 4.1.2 Applicants who use the cash method of Canadian Farm Income Program Agreement .../3 Provincial Annex for Quebec

Any costs incurred by the Province to administer those Conditions shall be cost-shared by Canada and the Province pursuant to the terms of this Agreement. 2.0 ELIGIBILITY Farm Business 2.1 An applicant must have a valid Farm Business Registration Registration number issued by the Province, or Canadian Farm Income Program Agreement .../1 Provincial Annex for Ontario

Section 22(1) of the Farm Registration and Farm Organizations Funding Act 1993, to be eligible for Canada's and the Province's shares of payments under the Program. Differences for provincial share 2.2 Producers who operate fish farms in the Province are eligible for payments under the Program.

In cases where common shares of a corporation do not have equivalent voting rights and a structural change of the shareholdings of the corporation appears to have been made which affects the level of payment to which the applicant would be entitled had such a change not occurred, the Administration may make a determination which affects the applicant's eligibility or payment under the Program in accordance with the rules set out in the Program guidelines. - 2 - 3.0 PAYMENT CALCULATION Individual 3.1 Pursuant to paragraph 2.13 of Appendix A, payment limit Commoil Disaster Program Conditions, for the purpose of calculating the Provincial Compensation, the individual payment limit shall be $100,000. Prior to the issuance of payments for a Claim Year, Signatories to this Annex may, through an exchange of letters, change this individual payment limit to any amount between $100,000 and $175,000.

Entity payment 3.2 Pursuant to paragraph 2.13 of Appendix A, limit Common Disaster Program Conditions, for the purpose of calculating the Provincial Compensation, an entity shall be entitled to receive up to $100,000 for each eligible corporate shareholder or co-operative member whose application for payment is attributed through the application of the entity, up to a maximum of five times the individual limit. Prior to the issuance of payments for a Claim Year, Signatories to this Annex may, through an exchange of letters, change this individual payment limit to any amount between $100,000 and $175,000.
