An Act to Amend the Tobacco Tax Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1

Section of the Tobacco Tax Act,

chapter T-7 of the Revised Statutes, 1973, is amended (

a) by repealing paragraph (

a) and substitut- ing the following: (

a) from June 18, 2002, to December 10, 2002, both dates inclusive, 9.75 cents on each cigarette purchased, (

b) by adding after paragraph (

a) the follow- ing: (a.1) on and after December 11, 2002, 11.75 cents on each cigarette purchased, (

c) by repealing paragraph (

c) and substitut- ing the following: (

c) from June 18, 2002, to December 10, 2002, both dates inclusive, 7.45 cents on each tobacco stick purchased, (

d) by adding after paragraph (

c) the follow- ing: PROJET DE LOI Loi modifiant la Loi de la taxe sur le tabac Sa Majesté, sur l’avis et du consentement de l’Assemblée législative du Nouveau-Brunswick, décrète : 1 L’article de la Loi de la taxe sur le tabac, cha- pitre T-7 des Lois révisées de 1973, est modifié

a) par l’abrogation de l’alinéa a) et son rem- placement par ce qui suit :

a) à partir du juin jusqu’au décem- bre 2002, les deux dates étant incluses, 9,75 cents sur chaque cigarette achetée,

b) par l’adjonction, après l’alinéa a), de ce qui suit : a.1) le décembre et après cette date, 11,75 cents sur chaque cigarette achetée,

c) par l’abrogation de l’alinéa c) et son rem- placement par ce qui suit :

c) à partir du juin jusqu’au décem- bre 2002, les deux dates étant incluses, 7,45 cents sur chaque cylindre de tabac acheté,

d) par l’adjonction, après l’alinéa c), de ce qui suit : 2 Projet de loi Loi modifiant la Loi de la taxe sur le tabac (c.1) on and after December 11, 2002, 9.45 cents on each tobacco stick purchased, (

e) by repealing paragraph (

d) and substitut- ing the following: (

d) from June 18, 2002, to December 10, 2002, both dates inclusive, 6.49 cents on each gram or any portion of a gram of any tobacco purchased other than cigarettes, cigars or tobacco sticks, and (

f) by adding after paragraph (

d) the follow- ing: (

e) on and after December 11, 2002, 8.49 cents on each gram or any portion of a gram of any to- bacco purchased other than cigarettes, cigars or tobacco sticks. 2(1) Paragraphs 1(a), (

c) and (

e) of this Act shall be deemed to have come into force on June 18, 2002. 2(2) Paragraphs 1(b), (

d) and (

f) of this Act shall be deemed to have come into force on December 11, 2002. c.1) le décembre et après cette date, 9,45 cents sur chaque cylindre de tabac acheté,

c) et

e) de la présente loi sont réputés être entrés en vigueur le juin 2002. 2(2) Les alinéas 1b),

d) et

f) de la présente loi sont réputés être entrés en vigueur le décembre 2002. 3

An Act to Amend the Tobacco Tax Act Bill EXPLANATORY NOTES

Section 1 (

a) to (

f) The existing provision is as follows: 3 Every consumer of tobacco purchased at a retail sale in the Province, for the purpose of raising a revenue, shall pay to Her Majesty the Queen in right of the Province at the time of making the purchase a tax in respect of the consumption of the tobacco at the rate of (a) 7.25 cents on each cigarette purchased, (

b) fifty per cent of the normal retail price of each cigar purchased, (c) 4.95 cents on each tobacco stick purchased, and (d) 3.99 cents on each gram or any portion of a gram of any tobacco purchased other than cigarettes, cigars or tobacco sticks.

Article

a) à

f) La disposition actuelle se lit comme suit : 3 Tout consommateur de tabac acheté à une vente au détail dans la province doit, afin de lui procurer des fonds, payer à Sa Majesté la Reine du chef de la province au moment où il achète ce tabac, une taxe de consommation sur ce tabac aux taux de a) 7,25 cents sur chaque cigarette achetée,

b) cinquante pour cent du prix normal de vente au détail de chaque cigare acheté, c) 4,95 cents sur chaque cylindre de tabac acheté, et d) 3,99 cents par gramme ou fraction de gramme sur tout tabac acheté à l'exception des cigarettes, des cigares ou des cylindres de tabac.
