An Act to Amend the Legislative Assembly Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1 The Legislative Assembly Act,

chapter L-3 of the Re- vised Statutes, 1973, is amended by adding after

section the following: 8.1(1) The Legislative Assembly shall maintain at all times a set of rules and procedures, which shall be known as the Standing Rules of the Legislative Assembly of New Brunswick. 8.1(2) The Standing Rules of the Legislative Assembly of New Brunswick may not be altered without a consensus of all members of the Legislative Assembly. 8.1(3) Notwithstanding subsection (2), a simple major- ity of members of the Legislative Assembly may amend the Standing Rules of the Legislative Assembly of New Brunswick if the member of the Legislative Assembly sponsoring a motion to do the same is also a member of a political party having provided written notice of its inten- tion to make the proposed amendment prior to the preced- ing provincial election. 8.1(4) Notwithstanding subsections (2) and (3), the Legislative Assembly may not adopt any amendment to the Standing Rules of the Legislative Assembly of New PROJET DE LOI Loi modifiant la

chapitre L-3 des Lois révisées de 1973, est modifiée par l’adjonction après l’article de ce qui suit : 8.1(1) L’Assemblée législative maintiendra en tout temps une série de règles et de procédures, qui seront con- nues comme le Règlement de l’Assemblée législative du Nouveau-Brunswick. 8.1(2) Le Règlement de l’Assemblée législative du Nouveau-Brunswick ne pourra pas être modifié sans le consentement unanime de tous les membres de l’Assem- blée législative. 8.1(3) Nonobstant le paragraphe (2), une majorité sim- ple des membres de l’Assemblée législative peut modifier le Règlement de l’Assemblée législative du Nouveau- Brunswick si le membre de l’Assemblée législative qui parraine une motion pour faire la même chose est aussi membre d’un parti politique ayant avisé par écrit ses in- tentions de faire la modification proposée avant l’élection provinciale précédente. 8.1(4) Nonobstant les paragraphes (2) et (3), l’Assem- blée législative ne peut pas adopter une modification au Règlement de l’Assemblée législative du Nouveau- 2 Projet de loi Loi modifiant la

Loi sur l’Assemblée législative Brunswick which has the effect of diminishing, removing, or enhancing the relative voting power of any individual member of the Legislative Assembly or any caucus of members of the Legislative Assembly without the unani- mous consent of all the members of the Legislative As- sembly. 2 The Act is amended by adding after

section the following: 15.1(1) The Speaker shall not make, alter or reverse, nor offer to make, alter or reverse any

interpretation of the rules, traditions and conventions of the Legislative As- sembly in exchange for (

a) any decision of government to spend money on a given project or in a given locality; (

b) any advantage in gaining the nomination of a po- litical party in any riding; (

c) any decision of government in appointing a par- ticular individual to any position created under a pro- vincial statute. 15.1(2) In order to ensure transparency and consistency, the Speaker shall provide reasons for any ruling or inter- pretation of the rules, traditions and conventions of the Legislative Assembly when requested to do so by two members of the Assembly. a) toute décision du gouvernement d’investir de l’ar- gent dans un projet donné ou dans une localité donnée;

b) tout avantage dans l’obtention d’une nomination d’un parti politique dans une circonscription;

c) toute décision du gouvernement dans la nomina- tion d’un personne donnée à tout poste créé par une loi provinciale. 15.1(2) Afin de conserver la transparence et la conti- nuité, l’Orateur devra fournir les raisons pour toute déci- sion ou interprétation des règles, traditions ou conven- tions de l’Assemblée législative lorsqu’au moins deux députés de l’Assemblée lui ont demandé de le faire.
