[section 80]. Regulation of the Superintendent of Real Estate, dated May 13, 2002.

Pursuant

section 80 of the Real Estate Act , the Superintendent of Real Estate

orders that the attached regulation is made. — W. A. CLARK, Superintendent

of Real Estate .

INDIVIDUAL EXEMPTION REGULATION

No. 129

Simon Fraser UniverCity Community Trust

1 An offer for sale or lease, the sale or lease and any assistance in the

selling or leasing of the subdivided land that comprises all or part of the land

described as

that portion of

Lot

1, District Lots 31, 101, 102, 141, 144, 147, 209, 210 and 211, Group 1, New Westminster

District, Plan LMP30518

which will be subdivided to

create Lots 2 to 11 and 14 within the hatched strip shown on the attached proposed

subdivision plan prepared by Gary Sundvick, B.C. Land Surveyor,

or on behalf of Simon Fraser UniverCity Community Trust, is exempt from

Part 2

of the Real Estate Act on condition that

(

a) at the time of the transfer of title to the purchaser, or in the case of a lease,

at the time of the commencement of the term of the lease, the subdivided lot has

no buildings intended for residential occupation,

(

b) Simon Fraser UniverCity Community Trust will keep all monies from purchasers

or lessees in the trust account of a solicitor or real estate agent until Simon

Fraser UniverCity Community Trust has complied with

section 940 of the Local

Government Act ,

(

c) Simon Fraser UniverCity Community

Trust will notify all purchasers or lessees at the time of an offer for sale or

lease that the offering is exempt from

Part 2 of the Real Estate Act and

that they will not receive a prospectus or a disclosure statement receipted under

the Real Estate Act and will not have the benefit of any rights or protections

afforded by

Part 2 of that Act, and

(

d) Simon Fraser

UniverCity Community Trust will notify all purchasers or lessees at the time of

an offer for sale or lease that the purchasers or lessees must comply with

Part

2 of the Real Estate Act if and when the purchasers or lessees are offering

strata lots to be constructed on the subdivided land for sale or lease to the

public.

Pursuant

section 6 of the Regulations Act , I hereby exempt from publication the

sketch attached to B.C. Reg. 97/2002.

This sketch May be

inspected at the offices of the Financial Institutions Commission, 1900, 1050
