Court Security Regulations 107/11 The Newfoundland and Labrador Gazette December 16, 2011 730 (a) "Act" means the Court Security Act, 2010; (b) "floroscope m achine" means a mechanical device which uses x-rays and a florescent screen to display images in real time; and (c) "metal detector" means a me chanical device for the detection of metal objects which may be hand-held or stationary. 3. The screening authorized under sections 5 and 6 of the Act may be accomplished by one or more of the following methods: (

a) by requiring a person to pass through a stationary metal de- tector; (

b) by passing a hand-held metal detector near or around a per- son's body; (

c) by using a fluoroscope machin e to examine the contents of a person's personal possessions or clothing; (

d) through a physical search of the contents of a person's per- sonal possessions or clothing by a security officer; or (

e) by a frisk search in the manner authorized under the Act. 4. Judges, court employees, security officers, wildlife officers, and other persons in the discretion of the High Sheriff are exempt from screening under the Act. 5. The following persons may possess a weapon in a court area: (

a) a security officer; (

b) a participant in a court proceeding who is (

a) the power of a judge at common law or otherwise to control the proceedings of the court; (

b) the power of a judge to give directions to a security officer incidental to the exercise of a contempt power; (

c) the right of the chief judge or a judge in the exercise of judi- cial functions; or (

Schedule 1. These regulations may be cited as the Court Areas and Re- stricted Zones Regulations. 2. In these regulations, "Act" means the Court Security Act, 2010.

(1) For the purpose of the Act, an area occupied or used by a court for conducting judicial business and administrative matters relat- ing to it is designated as a court area.

(2) An area referred to in subs ection (1) includes the entrance and exit ways associated with that area, and another area which may be part of the curtilage of that area.

(3) In addition to subsection (1), the areas listed in the

schedule are designated as court areas for the purpose of the Act. 4. The following parts of a court area are designated as restricted zones: (

a) judge's chambers and libraries; (

b) storage areas; (

c) prisoner detention areas; (

d) jury rooms; (

e) a part of a court area used exclusively by judges, court em- ployees or security officers; and (

f) an area, the entrance to whic h is marked with a restricted zone sign. 5. A restricted zone shall be identified by a sign which reads "Au- thorized Personnel Only". 6.

(1) Only the following persons may enter a restricted zone: (

a) a judge or court employees; (

b) a security officer; and (

c) another person authorized by a judge or security officer un- der the authority of

section 4 of the Act.

(2) Notwithstanding paragraphs (1)(

section 123 of the Workplace Health, Safety and Compensation Act , the Lieutenant-Governor in Council makes the following regulations. Dated at St. John’s, December 14, 2011. Section 28.1 of the W orkplace Health, Safety and Compensa- tion Regulations is repealed and the following substituted: 28.1

(1) Notwithstanding

section 28, an employer who (

a) meets the conditions set by the commission; CNLR 1025/96 as amended Deferred payment arrangement

b) enters into an arrangement to pay his or her assessment for the current year in equal instalments between April 1 and December 31; and (

c) makes the payments in the manner and at the time required by the arrangement referred to in paragraph (

b) is not liable to the penalty required by that section.

(2) Where, during the year, the assessment due and payable by an employer for the current year changes, the amount payable under the arrangement entered into by the employer with the commission under subsection (1) shall be adjusted as required and the employer shall pay the balance of the assessment for the year, as adjusted, in equal instal- ments beginning on the next scheduled payment date immediately fol- lowing the assessment adjustment and ending on the final scheduled payment date.

(3) Where an employer, who ha s entered into an arrangement with the commission under subsection (1), defaults in making a pay- ment, in the amount or manner or at the time required under his or her arrangement with the commission,
