STATUTES CORRECTION REGULATION, 2006

Corrections to Ministry of Environment statutes

1 The following statutes are corrected as set out in the attached Schedule:

(

a) Drainage, Ditch and Dike Act ;

(

b) Environmental Assessment Act ;

(

c) Environmental Management Act ;

(

d) Integrated Pest Management Act ;

(

e) Protected Areas of British Columbia Act ;

(

f) Water Act ;

(

g) Wildlife Act .

Schedule

Drainage, Ditch and Dike Act

Section 168 of the Drainage, Ditch and Dike Act , R.S.B.C. 1996, c. 102, is amended by striking out "section 166" and substituting "section 166 (1)".

Environmental Assessment Act

Section 5 (3) of the Environmental Assessment Act , S.B.C. 2002, c. 43, is repealed.

Environmental Management Act

Section 138 (3) (

a) of the Environmental Management Act , S.B.C. 2003, c. 53, is amended by striking out "a person" and substituting "persons".

Integrated Pest Management Act

Section 7 (2) (c) (

i) of the Integrated Pest Management Act , S.B.C. 2003, c. 58, is amended by striking out "been prepared" and substituting "has been prepared".

Protected Areas of British Columbia Act

Schedule A of the Protected Areas of British Columbia Act , S.B.C. 2000, c. 17, is amended in the description of Clayhurst Ecological Reserve by striking out "section 4, Highway Act road" and substituting "section 42 Transportation Act highway".

Schedule C is amended

(

a) in the description of Juan de Fuca Park by striking out "Ninethly:" and substituting "Ninthly:",

(

b) in the description of Main Lake Park by striking out "Section 4 Road under the Highway Act " and substituting "section 42 Transportation Act highway",

(

c) in the description of St. Mary's Alpine Park by striking out "Mount Mowitka" and substituting "Nowitka Mountain", and

(

d) in the description of Sproat Lake Park by striking out "3.53 hectacres" and substituting "3.53 hectares".

Schedule D is amended in the description of Purcell Wilderness Conservancy Park by striking out "Mount Nowitka" and substituting "Nowitka Mountain".

Water Act

Section 92 (6) (

a) and (

b) of the Water Act , R.S.B.C. 1996, c. 483, is amended by striking out " Environment Management Act " and substituting " Environmental Management Act ".

Section 101 (4) (l) (ii) is amended by striking out "by that acquifer;" and substituting "by that aquifer;".

Wildlife Act

Section 97.6 (7) (

a) of the Wildlife Act , R.S.B.C. 1996, c. 488, is amended by striking out "subsection (2)" and substituting "subsection (3)".
