B.C. Reg. 297/2006, deposited November 15, 2006, pursuant to the ENVIRONMENTAL MANAGEMENT ACT [Section 138]. Order in Council 791/2006, approved and ordered November 14, 2006.
On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Recycling Regulation, B.C. Reg. 449/2004, is amended as set out in the attached Schedule.

Schedule
1 The definition of "producer" in
section 1 of the Recycling Regulation, B.C. Reg. 449/2004, is amended
(
a) by adding the following paragraph:
(a.1) in respect of the producer of a product within the tire product category, a person who
(
i) sells, offers for sale or distributes a new tire product in British Columbia,
(ii) is the owner or licensee of a trademark under which a tire product is sold or distributed in British Columbia, whether or not the trademark is registered, or
(iii) imports the tire product into British Columbia for sale or distribution, or
, and
(
b) in paragraph (
b) by adding "or the tire product category" after "beverage container product category".
2 The
definitions of "recapped tire" and "retreaded tire" in
section 1 are repealed.
Section 3.2 is repealed.
Section 16 is amended by striking out "3.2,".
Section 18 is repealed.
Transitional
(1) Sections 1 to 5 of this regulation come into force on August 7, 2007.
(2) Despite
(
a) the effective date set out in subsection (1), and
(
b) section 3 of the Recycling Regulation, B.C. Reg. 449/2004,
sections 4, 5 and 7 of that regulation apply from March 12, 2007 to a person referred to in paragraph (a.1) of the definition of "producer".
