BOILERS AND PRESSURE VESSELS EXEMPTION AMENDMENT ORDER

Made by the Minister of Municipal Affairs (M.O. P:004/04) on January 20, 2004
pursuant to
section 2(2) of the Safety Codes Act.
1 The Boilers and Pressure Vessels Exemption Order (AR
300/94) is amended by this Regulation.
Section 3.1 is amended by striking out "March 31, 2004"
and substituting "March 31, 2005".

INFORMATION SYSTEMS PROFESSIONAL AMENDMENT REGULATION

section 14 of the Professional and Occupational Associations Registration
Act and made by the Canadian Information Processing Society of Alberta on March
6, 2003.
1 The Information Systems Professional Regulation
(AR 39/97) is amended by this Regulation.
Section 1 is amended by adding the following after
clause (i):
(i.1) "information systems experience" means experience that is
acceptable to the Registration Committee in the practice of
information systems;
Section 3 is amended
(
a) in subsection (1) by adding "and" at the end of
clause (a), striking out ", and" at the end of clause
(
b) and repealing clause (c);
(
b) by repealing subsection (3).
Section 7 is amended by adding "or fees" after "pay the
fee".
Section 8(1) is amended
(
a) by repealing clause (
a) and substituting the
following:
(
a) providing evidence that the applicant obtained at least
1000 hours of information systems experience in the 12
months immediately preceding the application for
registration and that the applicant has
(
i) graduated from a 4-year degree program approved
by the Board and obtained at least 2 years of
information systems experience,
(ii) graduated from a 3-year degree program approved
by the Board and obtained at least 3 years of
information systems experience,
(iii) graduated from a 3-year technical program
approved by the Board and obtained at least 4
years of information systems experience,
(iv) graduated from a 2-year technical program
approved by the Board and obtained at least 5
years of information systems experience, or
(
v) obtained at least 5 years of information systems
experience and passed the examinations set by the
Institute for the Certification of Computer
Professionals required to qualify for the Certified
Computing Professional (CCP) designation or a
substantially equivalent designation approved by
the Board,
(a.1) providing evidence that the applicant obtained a
combination of academic qualifications and experience
that, in the opinion of the Registration Committee,
(
i) is substantially equivalent to the requirements
identified in clause (a)(i), (ii), (iii), (iv) or (v), and
(ii) was obtained in the sufficiently recent past,
(
b) in clause (b)
(
i) by striking out "and" at the end of subclause (i);
(ii) by striking out "experience acceptable to the
Registration Committee in the practice of information
systems" and substituting "information systems
experience, and";
(iii) by adding the following after subclause (ii):
(iii) has obtained at least 1000 hours of information
systems experience in the 12 months immediately
preceding the application for registration.
Section 9 is amended
(
a) in subsection (1)
(
i) by repealing clauses (
a) and (
b) and
substituting the following:
(
a) graduated from a degree program approved by the
Board,
(
b) graduated from a technical program for
information systems approved by the Board,
(ii) by repealing clause (
d) and substituting the
following:
(
d) passed the examinations set by the Institute for the
Certification of Computer Professionals required
to qualify for the Certified Computing Professional
(CCP) designation or an equivalent designation
approved by the Board.
(
b) by repealing subsection (3) and substituting the
following:
(3) Notwithstanding subsections (1) and (2), an individual may
remain on the register of candidate members for a maximum of
10 years.
Section 10(a)(
i) and (b)(
i) are amended by striking out
"experience acceptable to the Registration Committee in the practice of
information systems" and substituting "information systems
experience".
Section 17 is amended by adding the following after
subsection (2):
(3) An individual whose registration has been cancelled under
subsection (1) due only to non-payment of a fee is entitled to have
the registration renewed on application within the time period
following the due date for its payment that is prescribed by the
by-laws and on payment of all accrued fees payable and any late
renewal fee prescribed by the by-laws under
section 7.
9 Sections 13, 19 and 20 and Schedules 1 and 2 are
repealed.

Definitions
1 In this Regulation,
(a) "Association" means the Electrical Contractors Association
of Alberta;
(b) "Association's registrar" means the registrar for the
Association appointed under the bylaws;
(c) "Board" means the Board of Directors of the Association
established under the bylaws;
(d) "Discipline Committee" means the Discipline Committee
established pursuant to
section 15;
(e) "electrical contracting" means the business of erecting or
installing electrical installations or equipment or the business
of erecting, installing, repairing, servicing or maintaining
electrical installations and equipment;
(f) "Practice Review Committee" means the Practice Review
Committee established pursuant to
section 11;
(g) "professional education program" means a program in
electrical contracting approved by the Board;
(h) "professional electrical contractor" means a person who is
registered as a professional electrical contractor under this
Regulation and who holds an annual membership card under
this Regulation;
(i) "registered member" means a professional electrical
contractor or a student member;
(j) "Registration Committee" means the Registration Committee
established pursuant to
section 2;
(k) "student member" means a person who is registered as a
student member under this Regulation and who holds a
student annual membership card under this Regulation.
Registration Committee
2(1) The Registration Committee is established consisting of
(
a) one professional electrical contractor who is a member of the
Board, and
(
b) at least 2 professional electrical contractors who are not
members of the Board, one of whom must be appointed as
the chair.
(2) The members of the Registration Committee must be appointed by
the Board in accordance with the bylaws.
(3) The Registration Committee must meet at the call of its chair.
(4) A quorum at a meeting of the Registration Committee is a majority
of the members appointed.
Registers
3(1) The Association's registrar must maintain, in accordance with
this Regulation and the bylaws and subject to the direction of the
Board,
(
a) a register of professional electrical contractors, and
(
b) a register of student members.
(2) The Association's registrar must enter in the appropriate register
(
a) the name of an individual whose registration has been
approved by the Board or the Registration Committee, as the
case may be, and who has paid the fee prescribed by the
bylaws, and
(
b) the mailing address of that individual.
Powers and duties of Registration Committee
4(1) The Registration Committee must consider applications from
persons to become registered members of the Association in
accordance with this Regulation and may
(
a) approve the registration if the applicant meets the
requirements of
section 9 or 10,
(
b) refuse to approve the registration, or
(
c) defer approval until the applicant has satisfied the
requirements of
section 9 or 10.
(2) The Registration Committee must send a written notice of any
decision made by it to the applicant.
(3) If the decision made by the Registration Committee is to refuse the
registration of the applicant, the notice of the decision must include
reasons for that decision.
Application appeal
5(1) An applicant whose application for registration is refused by the
Registration Committee may, by written notice served on the
Association's registrar within 30 days of receiving a notice of refusal
and the reasons for it, appeal the refusal to the Board.
(2) The notice of appeal must set out the reasons why, in the
applicant's opinion, the application for registration should be
approved.
(3) An applicant who appeals a decision of the Registration
Committee under this
section
(
a) must be notified in writing by the Association's registrar of
the date, place and time that the Board is to hear the appeal,
and
(
b) is entitled to appear with counsel or an agent and make
representations to the Board when it hears the appeal.
(4) A member of the Registration committee who is also a member of
the Board may participate in the appeal but may not vote on a decision
of the Board under this
section and may not be counted for the
purposes of a quorum.
(5) On a hearing of an appeal under this section, the Board may make
any decision the Registration Committee may make, and must notify
the applicant of its decision.
Certificate of registration
6 On entering the name of a person in the appropriate register, the
Association's registrar must issue a certificate of registration to that
person.
Payment of fee
7(1) A registered member must pay the annual fee prescribed by the
bylaws to the Association's registrar or to any person authorized by the
Association's registrar to accept payment of the fee.
(2) A registered member who applies for renewal of registration after
the renewal date prescribed by the Board must pay the late renewal fee
prescribed by the bylaws to the Association's registrar or to any person
authorized by the Association's registrar to accept payment of the fee.
Annual membership card
8(1) The Association's registrar must issue an annual membership
card in accordance with the bylaws to a person
(
a) whose registration is not under suspension or cancelled, and
(
b) who has paid the annual fee.
(2) An annual membership card expires on the date prescribed in the
bylaws.
Registration as professional electrical contractor
9 An applicant who
(
a) produces documentation satisfactory to the Registration
Committee that shows that the applicant holds a master
electrician licence under the Safety Codes Act and takes out
electrical permits on behalf of a person engaged in electrical
contracting and
(
i) has successfully completed the course work and
examinations required by the professional education
program,
(ii) has satisfied the Registration Committee that the
applicant's qualifications are substantively equivalent to
the professional education program,
(iii) is registered in good standing with a profession in
another jurisdiction recognized by the Board as having
substantively equivalent competence and practice
requirements, or
(iv) has a combination of education, practice requirements,
examinations or other qualifications that demonstrate
the competence required for registration,
and
(
b) is of good character and reputation,
is entitled to be registered as a professional electrical contractor.
Registration as student member
10 An applicant who
(
a) holds a master electrician licence under the Safety Codes Act
and takes out electrical permits on behalf of a person engaged
in electrical contracting,
(
b) is working toward the requirements of
section 9(a)(i), and
(
c) is of good character and reputation,
is entitled to be registered as a student member.
Practice Review Committee
11(1) The Practice Review Committee is established consisting of
(
a) one professional electrical contractor who is a member of the
Board,
(
b) at least 2 professional electrical contractors who are not
members of the Board, one of whom must be appointed as
the chair, and
(
c) the Association's registrar.
(2) The members of the Practice Review Committee must be
appointed by the Board in accordance with the bylaws.
(3) The Practice Review Committee must meet at the call of its chair.
(4) A quorum at a meeting of the Practice Review Committee is a
majority of the members appointed.
Powers and duties of Practice Review Committee
12 The Practice Review Committee
(
a) may, on its own initiative, and must, at the request of the
Board, inquire into and report to and advise the Board in
respect of
(
i) the assessment and development of educational
standards and experience requirements required for
registration as a professional electrical contractor,
(ii) the evaluation of desirable standards of competence in
the practice of electrical contracting generally,
(iii) any other matter that the Board considers necessary or
appropriate in connection with the exercise of its
powers and the performance of its duties in relation to
competence in the practice of electrical contracting
under this Regulation, and
(iv) the practice of electrical contracting generally,
and
(
b) may, with the approval of the Board, conduct a review of the
practice of a registered member.
Notice of review
13 The Practice Review Committee must give reasonable notice to a
registered member of its intention to conduct a review of the practice
of the registered member.
Reports and recommendations
14 After each inquiry or review under
section 12, the Practice
Review Committee
(
a) must make a written report to the Board on the inquiry or
review and, where appropriate, on its decision,
(
b) may make recommendations, together with reasons, to the
Board regarding the matter inquired into or reviewed,
(
c) may make recommendations to a registered member as to
that member's conduct in the practice of electrical
contracting, and
(
d) must, if it is of the opinion that the conduct of a registered
member constitutes or may constitute either unskilled
practice of the profession or professional misconduct within
the meaning of
section 19 of the Act, forthwith refer the
matter relating to that conduct to the chair of the Discipline
Committee to be dealt with under
Part 3 of the Act and the
Discipline Committee must deal with it as if it were a
complaint.
Discipline Committee
15(1) The Discipline Committee is established consisting of
(
a) one professional electrical contractor who is a member of the
Board, and
(
b) at least 2 professional electrical contractors who are not
members of the Board.
(2) The members of the Discipline Committee must be appointed by
the Board in accordance with the bylaws.
(3) The Discipline Committee must meet at the call of its chair.
(4) A quorum at a meeting of the Discipline Committee is a majority
of the members appointed.
Costs
16(1) The Discipline Committee, with respect to hearings before it,
and the Board, with respect to reviews by it, may order the investigated
person to pay the following costs:
(
a) the fee payable to the counsel advising the Discipline
Committee or Board at the hearing or review and the fee
payable to the counsel acting in a prosecutory role at the
hearing or review;
(
b) the cost of recording the evidence and preparing transcripts;
(
c) the expenses of the members constituting the Discipline
Committee including, without limitation, the daily
allowances of those members;
(
d) any other expenses incurred by the Association that are
incidental to the hearing or review.
(2) If the Board determines under
section 22(3)(
a) of the Act that a
complaint is frivolous or vexatious, it may order the complainant to
pay the following costs:
(
a) the fee payable to the counsel advising the Board at any
hearing held by the Board;
(
b) any other expenses incurred by the Association that are
incidental to any hearing held by the Board.
Cancellation and suspension
17(1) The registration of a registered member is cancelled or
suspended when the decision to cancel or suspend the registration is
made in accordance with the Act or this Regulation.
(2) The Association's registrar must enter a memorandum of the
cancellation or suspension of the registration in the appropriate register
indicating
(
a) the date of the cancellation or suspension,
(
b) the period of the suspension, and
(
c) the nature of any finding under
Part 3 of the Act.
(3) If the registration of a registered member is cancelled, the person
whose registration is cancelled must, on request, surrender to the
Association's registrar all documents relating to the registration.
Cancellation on request
18 The Association's registrar must not cancel the registration of a
registered member at the request of the registered member unless the
request for cancellation is approved by the Board.
Non-payment of fees, etc.
19(1) The Board must direct the Association's registrar to suspend or
cancel the registration of a registered member who is in default of
payment of annual fees, penalties, costs or any other fees, dues or
levies payable under the Act, this Regulation or the bylaws after the
expiration of 30 days following the service on that person of a written
notice by the Board unless that person complies with the notice.
(2) The notice under subsection (1) must state that the Association's
registrar will suspend or cancel the registration unless the fees,
penalties, costs, dues or levies are paid as indicated in the notice.
Registration in error
20 The Board must direct the Association's registrar to cancel the
registration of any person that is entered in error in a register.
Code of Ethics
21 A registered member must
(
a) conduct himself or herself in a professional, ethical and
responsible manner,
(
b) act in accordance with all applicable legislation and other
laws,
(
c) maintain currency in the knowledge and skills necessary to
carry out the member's duties,
(
d) report any incompetent, illegal or unethical conduct of any
member to the appropriate authority,
(
e) take all reasonable steps to ensure that the working
conditions of those under the member's supervision are safe
and that electrical installations are designed and operated in a
safe manner,
(
f) act in the best interests of the client and provide professional
services with integrity, objectivity and independence,
(
g) hold in confidence all client information unless the member
is permitted by the client or is required by the Act or any
other enactment or by order of a court to disclose the
information,
(
h) continually seek further knowledge, innovation and advanced
technologies in new products, business procedures and all
other matters that enhance the reputation of the profession,
(
i) refrain from engaging in any business practices that detract
from the professional image of the Association or its
members, and
(
j) refrain from serving a client under any terms or conditions
that would impair the member's independence.
Use of title
22 A professional electrical contractor may use the title "Professional
Electrical Contractor" and the abbreviations "P.E.C." and "PEC".
Transitional
23 The Association's registrar must enter in the register of
professional electrical contractors or student members the name of a
person who, on the coming into force of this Regulation, is registered
as a professional electrical contractor or a student member under the
bylaws of the Association.
Repeal
24 The Professional Electrical Contractors Regulation (AR 148/93)
is repealed.

Definitions
1 In this Regulation,
(a) "Act" means the Professional and Occupational Associations
Registration Act;
(b) "Association" means the Association of School Business
Officials of Alberta;
(c) "Association Registrar" means the Registrar of the
Association appointed under the bylaws;
(d) "bylaws" means the bylaws of the Association;
(e) "certified school business official" means a person whose
name is entered in the register of certified school business
officials;
(f) "Discipline Committee" means the Discipline Committee
established pursuant to
section 14;
(g) "Executive" means the Executive of the Association
established under the bylaws;
(h) "fellow certified school business official" means a person
whose name is entered in the register of fellow certified
school business officials;
(i) "honorary member" means a person whose name is entered
in the register of honorary members;
(j) "life member" means a person whose name is entered in the
register of life members;
(k) "Practice Review Committee" means the Practice Review
Committee established pursuant to
section 10;
(l) "Registration Committee" means the Registration Committee
established pursuant to
section 2;
(m) "regular member" means a person whose name is entered in
the register of regular members;
(n) "regulated member" means a certified school business
official or a fellow certified school business official;
(o) "school business administration" means the provision of
corporate and business services to public or separate school
boards.
Registration Committee
2(1) The Registration Committee is established consisting of
(
a) one certified school business official who is a member of the
Executive, and
(
b) at least 2 other certified school business officials who are not
members of the Executive, one of whom must be appointed
as chair.
(2) The members of the Registration Committee must be appointed by
the Executive in accordance with the bylaws.
(3) The Registration Committee must meet at the call of the chair.
(4) A quorum at a meeting of the Registration Committee is a majority
of the members appointed.
Registers
3(1) The Association Registrar must maintain, in accordance with this
Regulation and the bylaws, and subject to the direction of the
Executive,
(
a) a register of certified school business officials,
(
b) a register of fellow certified school business officials,
(
c) a register of regular members,
(
d) a register of life members, and
(
e) a register of honorary members.
(2) The Association Registrar must enter in the appropriate register
(
a) the name of an individual who has paid the fee prescribed by
the bylaws and whose registration has been approved by the
Executive or the Registration Committee, and
(
b) the business address, if any, of that individual.
Powers and duties of Registration Committee
4(1) The Registration Committee must consider applications from
persons to be registered as certified school business officials in
accordance with this Regulation and may
(
a) approve the registration,
(
b) refuse to approve the registration, or
(
c) defer approval until the applicant has satisfied the
requirements of
section 8.
(2) The Registration Committee must send a written notice of any
decision made by it to the applicant.
(3) If the decision made by the Registration Committee is to refuse the
registration of the applicant, written reasons for the decision must be
sent to the applicant.
Review of application
5(1) An applicant whose application for registration under
section 4 is
refused by the Registration Committee may, by notice in writing
served on the Association Registrar within 30 days of receiving a
notice of refusal and the reasons for it, appeal the refusal to the
Executive.
(2) The notice of appeal must set out the reasons why, in the
applicant's opinion, the application for registration should be
approved.
(3) An applicant who appeals a decision of the Registration
Committee under this
section
(
a) must be notified in writing by the Association Registrar of
the date, place and time that the Executive is to hear the
appeal, and
(
b) is entitled to appear with counsel or an agent and make
representations to the Executive when it hears the appeal.
(4) A member of the Registration Committee who is also a member of
the Executive may participate in the appeal but may not vote on a
decision of the Executive or be counted for the purposes of a quorum
at a meeting of the Executive under this section.
(5) On hearing an appeal under this section, the Executive may make
any decision the Registration Committee may make, and must give
written notice of its decision to the applicant.
Certificate of registration
6 On entering the name of a person in the register of certified school
business officials or fellow certified school business officials, as the
case may be, the Association Registrar must issue a certificate of
registration to that person.
Payment of fees
7(1) A regulated member must pay the annual fee prescribed by the
bylaws to the Association Registrar or to any person authorized by the
Association Registrar to accept payment of the fee.
(2) A regulated member who applies for renewal of registration after
the annual renewal date prescribed by the Executive must pay the late
renewal fee prescribed by the bylaws to the Association Registrar or to
any person authorized by the Association Registrar to accept payment
of the fee.
Eligibility for registration
8(1) An applicant is eligible to be registered as a certified school
business official
(
a) if the applicant
(
i) is a regular member,
(ii) is of good character and reputation,
(iii) meets any one of the following requirements:
(
A) the applicant has acquired a Diploma in Business
Administration from either the Northern Alberta
Institute of Technology or the Southern Alberta
Institute of Technology;
(
B) the applicant is eligible to write the Certified
Management Accountants of Alberta Entrance
Examination;
(
C) the applicant has acquired the Local Government
Studies Certificate from the University of Alberta
prior to 2004;
(
D) the applicant has completed a program of studies
that in the Registration Committee's opinion is
substantively equivalent to the requirements
described in paragraphs (A), (
B) or (C),
(iv) has at least 3 years of experience satisfactory to the
Registration Committee in the practice of school
administration in Canada, and
(
v) has successfully completed a school law and school
administration course recognized by the Executive,
(
b) if the applicant is registered in good standing with a
profession in another jurisdiction that is recognized by the
Executive as having substantively equivalent competence and
practice requirements, or
(
c) if the applicant has a combination of education, practice
requirements, examinations and other requirements that in
the opinion of the Registration Committee demonstrates the
competence required for registration.
(2) The Association Registrar must register as a fellow certified school
business official a certified school business official who has
contributed outstanding service in the practice of school business
administration and whose nomination is approved by the Executive.
(3) The Association Registrar must, with the approval of the
Executive, register as a regular member an applicant who is employed
in the practice of school business administration by a school board in
Alberta or the Northwest Territories.
(4) The Association Registrar must register as a life member a person
(
a) who has been actively involved in the practice of school
business administration for at least 10 years,
(
b) who has rendered distinguished service to the Association,
but is retired or has resigned from the practice of school
business administration, and
(
c) whose nomination is approved by the Executive.
(5) The Association Registrar must register as an honorary member a
person who
(
a) is not actively involved in the practice of school business
administration,
(
b) has rendered distinguished service to the Association, and
(
c) has been nominated for registration as an honorary member
by the Executive and whose nomination has been approved
by a majority of members of the Association voting at an
annual meeting of the Association.
Renewal of registration
9(1) A regulated member who applies for an annual renewal of
registration is entitled to have the registration renewed if the applicant
provides evidence that in the 3 years immediately preceding the
application for an annual renewal of registration the applicant has
completed at least 100 hours of continuing education or professional
development activities acceptable to the Registration Committee in the
practice of school business administration.
(2) Notwithstanding subsection (1), if a regulated member who applies
for an annual renewal of registration does not meet the requirements
described in subsection (1), the Registration Committee may renew the
person's registration subject to any conditions that the Registration
Committee considers appropriate with respect to completing those
requirements.
Practice Review Committee
10(1) The Practice Review Committee is established consisting of
(
a) one certified school business official who is a member of the
Executive, and
(
b) at least 2 certified school business officials who are not
members of the Executive, one of whom must be appointed
as chair.
(2) The members of the Practice Review Committee must be
appointed by the Executive in accordance with the bylaws.
(3) The Practice Review Committee must meet at the call of the chair.
(4) A quorum at a meeting of the Practice Review Committee is a
majority of the members appointed.
Powers and duties of Practice Review Committee
11 The Practice Review Committee may, on its own initiative, and
must, at the request of the Executive, inquire into, report to and advise
the Executive in respect of
(
a) the assessment and development of educational standards and
experience requirements that are conditions precedent to
registration as a regulated member,
(
b) the evaluation of desirable standards of competence of
regulated members generally,
(
c) any other matter that the Executive from time to time
considers necessary or appropriate in connection with the
exercise of its powers and the performance of its duties in
relation to competence in the practice of school business
administration generally under this Regulation, and
(
d) the practice of school business administration generally.
Notice
12 The Practice Review Committee must give reasonable notice to a
regulated member of its intention to conduct a review of the practice of
the regulated member.
Reports and recommendations
13 After each inquiry or review under
section 11, the Practice
Review Committee
(
a) must make a written report to the Executive on the inquiry or
review and, where appropriate, on its decision,
(
b) may make recommendations to the Executive regarding the
matter inquired into or reviewed, together with reasons,
(
c) may make recommendations to a regulated member as to that
person's conduct in the practice assessment, and
(
d) must, if it is of the opinion that the conduct of a regulated
member constitutes or may constitute either unskilled
practice of the profession or professional misconduct within
the meaning of
section 19 of the Act, forthwith refer the
matter relating to that conduct to the chair of the Discipline
Committee to be dealt with under
Part 3 of the Act.
Discipline Committee
14(1) The Discipline Committee is established consisting of
(
a) one certified school business official who is a member of the
Executive, and
(
b) at least 2 certified school business officials who are not
members of the Executive, one of whom must be appointed
as chair.
(2) The members of the Discipline Committee must be appointed by
the Executive in accordance with the bylaws.
(3) The Discipline Committee must meet at the call of the chair.
(4) A quorum at a meeting of the Discipline Committee is a majority
of the members appointed.
Costs
15 The Discipline Committee, with respect to hearings before it, and
the Executive, with respect to reviews by it, may order the investigated
person to pay the following costs:
(
a) the fee payable to the counsel advising the Discipline
Committee or Executive at the hearing or review and the fee
payable to the counsel acting in a prosecutory role at the
hearing or review;
(
b) the cost of recording the evidence and preparing transcripts;
(
c) the expenses of the members constituting the Discipline
Committee, including, without limitation, the daily
allowances of those members;
(
d) any other expenses incurred by the Association that are
incidental to the hearing or review.
Cancellation and suspension
16(1) The registration of a regulated member of the Association is
cancelled or suspended when the decision to cancel or suspend the
registration is made in accordance with the Act or this Regulation.
(2) The Association Registrar must enter a memorandum of the
cancellation or suspension of the registration in the appropriate register
indicating
(
a) the date of the cancellation or suspension,
(
b) the period of the suspension, and
(
c) the nature of any finding under
Part 3 of the Act.
(3) If the registration of a member of the Association is cancelled, the
person whose registration is cancelled must, on request, surrender to
the Association Registrar all documents relating to the registration.
Cancellation on request
17 The Association Registrar must not cancel the registration of a
regulated member at the request of the regulated member unless the
request for cancellation is approved by the Executive.
Non-payment of fees, etc.
18(1) The Executive must direct the Association Registrar to cancel
or suspend the registration of a regulated member of the Association
who is in default of payment of annual fees, penalties, costs or any
other fees, dues or levies payable under the Act, this Regulation or the
bylaws after the expiration of 30 days following the service on that
person of a written notice by the Executive, unless that person
complies with the notice.
(2) The notice under subsection (1) must state that the Association
Registrar must cancel or suspend the registration unless the fees,
penalties, costs, dues or levies are paid as indicated in the notice.
Registration in error
19 The Executive must direct the Association Registrar to cancel the
registration of any person that is entered in error in a register.
Use of title
20(1) A certified school business official may use the title "Certified
School Business Official" and the abbreviations "C.S.B.O." and
"CSBO".
(2) A fellow certified school business official may use the title
"Fellow Certified School Business Official" and the abbreviations
"F.C.S.B.O." and "FCSBO".
Transitional
21(1) In this section, "previous Regulation" means the School
Business Officials Regulation (AR 149/93).
(2) The Association Registrar must enter in the register of certified
school business officials, fellow certified school business officials,
regular members, life members or honorary members, the name of a
person who, on the coming into force of this Regulation, was
registered as a certified school business official, fellow certified school
business official, regular member, life member or honorary member, as
the case may be, under the previous Regulation.
Repeal
22 The School Business Officials Regulation (AR 149/93) is
repealed.

1 The Modified Voting Procedure Regulation (AR 170/2000)
is amended by this Regulation.
Section 1 is amended by striking out "161(2)" and

3 The following is added after
section 1:
Delegation
1.1 Notwithstanding
section 54(2) of the Act, the returning
officer may delegate to a deputy returning officer the returning
officer's authority under that section.
Voting station
1.2 A reference to a voting substation in
section 77.1(4) of the
Act is deemed to be a reference to a voting station.
Special ballot voting register
1.3(1) Instead of entering the information referred to in
section
77.1(3)(
a) of the Act in the voting register, the information shall be
entered in the special ballot voter register.
(2) A reference in sections 77.1 and 77.2 of the Act to the voting
register is deemed to be a reference to the special ballot voter
register.
Earlier submission of special ballot applications
1.4 Notwithstanding
section 77.1(2) of the Act, an application for
a special ballot in a local jurisdiction may be made earlier than the
time set out in
section 77.1(2) of the Act if the elected authority for
that local jurisdiction has passed a resolution to provide for the
earlier submission of applications.
Special ballot process
1.5 Notwithstanding
section 77.2(5), (6) and (7) of the Act, a
returning officer may handle, collect and record the results of
special ballots in the same manner as an advance vote or
institutional vote and in so doing may use one special ballot box
for the local jurisdiction, ward or subdivision.
Delegation
1.6 Notwithstanding
section 77.2(6) of the Act, the returning
officer may delegate to a deputy the returning officer's authority
under
section 77.2(6).
Blind voter template
1.7 Notwithstanding
section 78(5) of the Act, the blind voter
template is not required to be prescribed under the Act.
Section 2 is amended
(
a) by striking out "80(1)(
a) and (2)" and substituting
"79(1) and (3)";
(
b) by striking out "161(2)" and substituting "160(2)".
5 The following is added after

Attendance at institutional vote

Marketing of Agricultural Products Act
ALBERTA CHICKEN PRODUCERS MARKETING
AMENDMENT REGULATION

1 The Alberta Chicken Producers Marketing Regulation
(AR 3/2000) is amended by this Regulation.
Section 28 is amended
(
a) in subsection (1) by adding the following after
clause (b):
(c) "processor specific offer" means an offer of new market
development quota made by the Board to authorized
producers where
(
i) the new market development quota is offered
pursuant to a request made to the Board by a
processor for a specific purpose, and
(ii) the producers to whom the offer is made have an
existing supply agreement with that processor.
(
b) by repealing subsection (2) and substituting the
following:
(2) A processor may apply to the Board to request that the
Board make
(
a) an offer of new market development quota to all
authorized producers, or
(
b) a processor specific offer to only those authorized
producers who have an existing supply agreement with
that processor.
(
c) by repealing subsection (7) and substituting the
following:
(7) Within the time specified by a resolution of the Board, all
authorized producers who are eligible to bid with respect to an
offer of new market development quota may file with the Board
a bid to lease new market development quota.
(7.1) Notwithstanding subsection (7), in the case of a processor
specific offer made in respect of a specific processor, only
authorized producers who have an existing supply agreement
with that processor are eligible to bid in respect of that offer.
(
d) in subsection (12) by adding "eligible" after "to each";
(
e) by adding the following after subsection (14):
(15) The Board may by resolution establish rules, procedures
and policies concerning the approval, operation and
administration of leases of new market development quota.
Section 31 is amended
(
a) in subsection (1) by striking out "1.25%" and
substituting "5%";
(
b) in subsection (2) by striking out "2.5%" and
substituting "10%";
(
c) in subsection (4) by striking out "2.5%" and
substituting "10%".

Provincial Parks Act
GENERAL AMENDMENT REGULATION

Made by the Minister of Community Development (M.O. 14-04) on February 28,
2004 pursuant to
section 12 of the Provincial Parks Act.
1 The General Regulation (AR 102/85) is amended by this
Regulation.
Section 1 is amended by adding the following after
clause (c):
(c.1) "campground" means a campground in a provincial park or
recreation area;
3 The following is added after
section 41:
41.1(1) In this section, "liquor" means liquor within the meaning of
the Gaming and Liquor Act.
(2) Where the Minister considers it necessary for the proper
management and control of a campground, the Minister may by order
prohibit
(
a) the possession or consumption of liquor in that campground,
(
b) the entry into or the presence in that campground of any
camping accommodation unit or motor vehicle containing
liquor,
in the terms and for the period or until the time specified in the order.
(3) When an order is made under subsection (2), the Minister shall
erect signs or post notices at the entrance to the campground to
which it relates generally indicating the prohibitions and their terms,
as set out in the order.
(4) A person shall not contravene an order made under subsection
(2).
(5) Orders under subsection (2) are to be treated as documents
incorporated by reference in this Regulation.
