B.C. Reg. 59/2012 , deposited March 30, 2012, pursuant to the ENVIRONMENTAL ASSESSMENT ACT [section 5]. Order in Council 176/2012, approved and ordered March 29, 2012.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that Table 11 of the Reviewable Projects Regulation, B.C. Reg. 370/2002, is amended

(

a) by repealing subsection (1) (

a) of Column 2 and substituting the following:

(

a) the facility is in a solid waste management plan submitted to the minister responsible for the administration of the Environmental Management Act for approval as part of the Regional Solid Waste Management Planning Process, or the board of a regional district has determined that the facility will be included in such a solid waste management plan or an amendment to such a solid waste management plan, and

(

b) in subsection (1) (b) (

i) of Column 2 by striking out " or " after " tonnes/year ",

(

c) by repealing subsection (1) (b) (ii) of Column 2 and substituting the following:

(ii) a device, other than a device referred to in subparagraph (iii), that, with or without energy recovery, destroys the waste using high temperatures and that has a design capacity of ≥ 225 tonnes/day, or

(iii) a device that, with or without energy recovery, destroys the waste using high temperatures and that is located in the Greater Vancouver Regional District or the Fraser Valley Regional District. , and

(

d) in subsection (1) (

b) of Column 3 by striking out " subsection (1) (b) (

i) or (ii) " in both places and substituting " subsection (1) (b) (i), (ii) or (iii) ".
