LOCAL AUTHORITIES PENSION PLAN

(2018) AMENDMENT REGULATION

on November 6, 2018 pursuant to

Schedule 1, sections 4 and 5 of the Public Sector

Pension Plans Act.

1 The Local Authorities Pension Plan (AR 366/93) is

amended by this Regulation.

Section 2 is amended

(

a) by repealing subsection (1)(ss.2) and substituting

the following:

(ss.2) "vested" means, in relation to a participant, having

(

i) completed a period of, or periods

aggregating, at least 2 years'

(

A) participation as a participant with any

probationary service that is pensionable

service included,

(

B) active membership referred to in

subsection (4), or

(

C) coverage under any combination of the

periods referred to in paragraphs (

A) and (B),

(i.1) accumulated at least 2 years' pensionable

service, or

(ii) attained the age of 65 years;

(

b) by adding the following after subsection (3):

(4) Completion of a period before December 10, 2018 of

active membership in either or both of the group registered

retirement savings plan and defined contribution registered

pension plan of Alberta Public Laboratories Ltd. (a business

corporation formerly known as Calgary Laboratory Services

Ltd.) (but with no duplication in the case of simultaneous

membership in both) counts for the purposes of subsection

(1)(ss.2)(

i) for a person who

(

a) held that active membership at any time prior to that

date,

(

b) was employed by Alberta Public Laboratories Ltd.

immediately prior to that date, and

(

c) became a participant on that date as a result of

section

10(

b) and the Local Authorities Pension Plan

(2018) Amendment Regulation.

Section 11(1) is amended

(

a) by striking out "or" at the end of clause (i);

(

b) by adding ", or" at the end of clause (j);

(

c) by adding the following after clause (j):

(

k) who, immediately prior to December 10, 2018,

(

i) was not a participant,

(ii) was an active member of Alberta Public

Laboratories Ltd.'s group registered retirement

savings plan or defined contribution registered

pension plan, and

(iii) had previously sent Alberta Public Laboratories

Ltd. a signed declaration in the form set by that

corporation opting not to become a participant on

December 10, 2018,

so long as that person remains continuously employed

by that corporation and continues to be an active

member of either of those plans.

Section 13(1) is amended

(

a) in clause (

a) by striking out "9.39%" and substituting

"8.39%";

(

b) in clause (

b) by striking out "13.84%" and

substituting "12.84%".

Section 15(1) is amended

(

a) in clause (

a) by striking out "10.39%" and

substituting "9.39%";

(

b) in clause (

b) by striking out "14.84%" and

substituting "13.84%".

Part 1 of

Schedule 2 is amended by adding the following

after "The Alberta Library":

Alberta Public Laboratories Ltd.

7 Sections 4 and 5 come into force on January 1, 2019.

Teachers' Pension Plans

1(1)

Schedule 1 to the Teachers' and Private School

Teachers' Pension Plans (AR 203/95) is amended by this

section.

(2) Section 1(1)(ii)(ii) is repealed and the following is

substituted:

(ii) subject to subclause (i), salary that is compensation within

the meaning of the tax rules, subject however to such

limitation as is necessary to ensure that the benefit accrual for

the calendar year, being the amount of benefit accrued in

respect of that year's pensionable service, as computed under

the tax rules, does not exceed the defined benefit limit fixed

by the tax rules for that year;

(3) The following is added after

section 48(7):

(8) To the extent that any pension amount or notional amount is

recalculated, with respect to a period before the commencement of

this subsection, after that commencement and as a result of

section

1(2) of the Teachers' Pension Plans and Legislative Provisions

(2018) Amendment Regulation, this

section is to be applied with

respect to the recalculation as if the amendment made by that clause

had been made on, and fully implemented since, January 1, 1992.

(4) Section 54(2) is repealed and the following is

substituted:

(2) A member who designates his or her estate as being entitled to

receive a benefit payable on death, or who makes a designation using

words indicative of the estate or of the representative capacity of a

personal representative, is deemed to have designated the personal

representative of the estate in the latter's representative capacity.

(5) The provisions of

Schedule 1 referred to in Column 1 of

the following Table are amended by striking out the terms

referred to in Column 2 wherever they occur and

substituting the terms in Column 3, if any:

Regulation (AR 204/95) is amended by this section.

Application and Coming into Force

Section 1(2) and (3) come into force on the first day (in

this

section referred to as "commencement") of the 2nd

calendar month following the calendar month in which this

Regulation is filed under the Regulations Act and,

notwithstanding anything in this Regulation, this

Regulation applies

(

a) with respect to pensions where pension

commencement occurred before commencement,

only to amounts for which the pension payment

dates, as provided for in

section 52(2) or (4) of

Schedule 1 and

section 52 of

Schedule 2 to the

Regulation being amended, occur after

commencement,

(

b) to pensions where pension commencement occurs

at or after commencement, and

(

c) to benefits other than pensions where the extant

notices under

section 44(1) of

Schedule 1 and

section 44 of

Schedule 2 to that Regulation are

given after commencement.
