LOI SUR LA DESTRUCTION DES MAUVAISES HERBES Honourable Mr. Kostyshyn M. le ministre Kostyshyn First Reading / Première lecture : Second Reading / Deuxième lecture : Committee / Comité : Concurrence and Third Reading / Approbation et troisième le cture : Royal Assent / Date de sanction :

EXPLANATORY NOTE NOTE EXPLICATIVE Currently The Noxious Weeds Act provides for only one class of noxious weeds and requires that noxious weeds be controlled by landowners and persons who occupy lan d. This Bill permits regulations to be made designatin g three classes of noxious weeds. A range of action, from c ontrol to destruction, is provided for depending on the cl ass and the size of the area of infestation.

The

Schedule of Noxious Weeds is repealed. All noxi ous weeds are to be designated by regulation. The regul ations are not limited to a predetermined list of eligible plants. Any plant, including a plant that is not known to be present in Manitoba, may be designated as a noxious weed if it constitutes a sufficient threat to Manitoba's econo my or environment or the well-being of residents of the province.

The basic concept of the Act is that it is enforced by municipalities. This Bill does not change that appr oach, but amends outdated wording in several provisions.

Regulations may be made prescribing the maximum amount that may be charged against land when a loca l government has to take action to destroy or control noxious weeds because of the landowner's failure to do so. A municipality that does not carry out its responsi bilities under the Act may be charged with an offence.

Fines for non-compliance with the Act are increased .
