An Act to Amend the Fisheries Development Act Loi modifiant la

Loi sur le développement des pêches Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et du consentement de l’Assem- blée législative du Nouveau-Brunswick, décrète : 1

Section 5 of the Fisheries Development Act,

chapter F-15.1 of the Acts of New Brunswick , 1977, is amended 1 L’article 5 de la

Loi sur le développement des pêches,

chapitre F-15.1 des Lois du Nouveau-Brunswick de 1977, est modifié (

a) by repealing subsection (1) and substituting the following:

a) par l’abrogation du paragraphe (1) et son rem- placement par ce qui suit : 5(1) The Minister shall not act under the authority of subsection 3(1) unless an application has been made to the Board, and 5(1) Le Ministre ne doit pas intervenir en vertu du pa- ragraphe 3(1) avant qu’une demande n’ait été présentée au Conseil et (

a) the Board has referred the application to the Min- ister in accordance with subsection (3.1), or

a) que le Conseil ne lui ait remis une demande aux termes du paragraphe (3.1), ou (

b) the Board, after duly considering the application, has transmitted its recommendation to the Minister.

b) in subsection (3), in the portion preceding para- graph (

a) by striking out “The Board shall consider all applications” and substituting “The Board shall consider all applications for financial assistance for more than twenty-five thousand dollars”;

c) by adding after subsection (3) the following:

5(3.1) The Board shall refer to the Minister all applica- tions for financial assistance for twenty-five thousand dollars or less made to it. 5(3.1) Le Conseil doit remettre au Ministre toute de- mande d’aide financière de vingt-cinq mille dollars ou moins qui lui sont adressées. 5(3.2) The Board is not required to make a recommen- dation with respect to an application referred to the Min- ister under subsection (3.1). 5(3.2) Une demande remise au Ministre aux termes du paragraphe (3.1) n’exige pas une recommandation du Con- seil. 2

Section 7 of the Act is amended 2 L’article 7 de la Loi est modifié (

a) by renumbering the

section as subsection 7(1);

b) by repealing paragraph (1)(

n) and substituting the following:

n) prescribing annual charges and the terms and con- ditions applicable to annual charges;

c) by adding after subsection (1) the following:

n) may be retroactive to February 15, 2003, or to any date after Feb- ruary 15, 2003. 7(2) Un règlement établi en vertu de l’alinéa

Section 9 of the Act is amended 3 L’article 9 de la Loi est modifié (

a) by repealing subsection (1) and substituting the following:

a) par l’abrogation du paragraphe (1) et son rem- placement par ce qui suit : 9(1) Any person who receives financial assistance under this Act shall pay to the Minister an annual charge in ac- cordance with the terms and conditions prescribed by regulation. 9(1) Toute personne qui reçoit une aide financière en application de la présente loi doit verser au Ministre une somme au

titre de charges annuelles selon les modalités et conditions fixées par règlement. (

b) in subsection (2) by striking out “service fees” and substituting “annual charges”.

b) au paragraphe (2), par la suppression de « de frais de service » et son remplacement par « de charges annuelles ». TRANSITIONAL PROVISION DISPOSITION TRANSITOIRE 4 Any reference to “service fee” in any agreement or other instrument or document that was valid and of full force and effect immediately before the commencement of this

section shall be deemed to be a reference to “an- nual charge”. 4 Un renvoi à « frais de service » dans tout accord ou autre instrument ou document qui était en vigueur, était valide et avait plein effet immédiatement avant l’entrée en vigueur du présent
