B.C. Reg. 237/2001, deposited October 12, 2001, pursuant to the MORTGAGE BROKERS ACT [Sections 9.1 and 23]. Order in Council 906/2001, approved and ordered October 11, 2001.
On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective March 1, 2002, the Mortgage Brokers Act Regulations, B.C. Reg. 100/73, is amended by adding the following section:
Cost of Consumer Credit Disclosure Act powers
8.2
(1) For the purposes of
section 9.1 (2) of the Mortgage Brokers Act, sections 6 to 8, 12 to 18, 19 and 20, 22 to 30, 32 to 36, 38 to 41, 48, 49 and 53 of the Cost of Consumer Credit Disclosure Act are prescribed.
(2) Without limiting any other rights and powers of the registrar under the Act, the registrar may, in relation to the provisions referred to in subsection (1), exercise the rights and powers referred to in sections 4 (
c) and 5 to 8.1 of the Mortgage Brokers Act and the rights and powers of the director under sections 63 to 67 and 71 (1) to (3) of the Consumer Protection Act.
(3) Sections 9, 10, 20 and 22 (1) (a), (
c) and (d), (2) and (4) to (8) of the Mortgage Brokers Act apply to the exercise by the registrar of any of the rights or powers referred to in subsection (2).
(4) Nothing in this
section precludes the application of sections 50 to 52 and 54 of the Cost of Consumer Credit Disclosure Act in relation to any matter in relation to which the registrar exercises any of the rights and powers referred to in subsection (2).
(5) Sections 68 to 70, 71 (4) and 72 to 74 of the Consumer Protection Act apply to the exercise by the registrar of any of the rights or powers referred to in subsection (2).
