Loi sur les services essentiels dans les foyers de soins Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et avec le consentement de l’As- semblée législative du Nouveau-Brunswick, édicte : 1

Section 12 of the Essential Services in Nursing Homes Act,

chapter E- 10.5 of the Acts of New Bruns- wick, 2009, is amended 1 L’article 12 de la

Loi sur les services essentiels dans les foyers de soins,

chapitre E-10.5 des Lois du Nouveau- Brunswick de 2009, est modifié (

a) by repealing subsection (1) and substituting the following:

a) par l’abrogation du paragraphe (1) et son rem- placement par ce qui suit : 12(1) If a notice referred to in

section 5 is given by an employer or an application referred to in

section 9 is made by an employer or a bargaining agent, no employee in the bargaining unit in respect of which the notice was given or the application was made shall strike or participate in a strike until 12(1) Si l’avis mentionné à l’article 5 est donné par l’employeur ou que la demande mentionnée à l’article 9 est présentée par l’employeur ou par un agent négociateur, il est interdit à l’employé de l’unité de négociation relati- vement à laquelle l’avis a été donné ou la demande a été présentée de faire grève ou d’y participer, avant que ne soient remplies les conditions suivantes : (

a) the employer and the bargaining agent have agreed upon, or the Board has determined, the positions in the bargaining unit to be designated positions and the employees in those positions have been informed by the Board; and

a) l’employeur et l’agent négociateur ont reconnu d’un commun accord ou la Commission a déterminé les postes de l’unité de négociation qui seront des postes désignés et les employés occupant ces postes en ont été informés par la Commission; (

b) at least seven days have elapsed after the bargain- ing agent for the employee’s bargaining unit informs the Board in writing of its intention to strike.

a) the employer and the bargaining agent have agreed upon, or the Board has determined, the positions in the bargaining unit to be designated positions and the employees in those positions have been informed by the Board; and

Section 18 of the Act is repealed and the following is substituted: 3 L‘article 18 de la Loi est abrogé et remplacé par ce qui suit : 18 The Board may make regulations 18 La Commission peut, par règlement : (

a) establishing rules of procedure in respect of hear- ings held under sections 8 and 9;

b) prescribing the manner in which and the time within which the employer shall, in respect of a bar- gaining unit, provide to the Board the names of the em- ployees in the bargaining unit who are employed in designated positions;

c) respecting the specification of the time within which and the persons to whom notices and other docu- ments are to be sent and when such notices are deemed to have been given and received; and

d) respecting such other matters and things as may be incidental or conducive to the objects and purposes of the Board, the exercise of its powers and the attain- ment of the objects of this Act.
