An Act to Amend the Executive Council Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, en- acts as follows: 1 Subsection 2(1) of the Executive Council Act,

chapter E-12 of the Revised Statutes, 1973, is amended by striking out “a Minister of Public Safety” and substituting “a Minister of Public Safety who shall also be Solicitor General”.

Transitional Provisions 2 Where in any Act of the Legislature, other than this Act, or any Act of the Parliament of Canada or in any regulation, statutory instrument, rule, or- der, by-law, agreement or other instrument or doc- ument, reference is made to the Solicitor General, Deputy Solicitor General or the Department of the Solicitor General in relation to the Province of New Brunswick, it shall be read, unless the context otherwise requires, as a reference to the Minister of Public Safety in his or capacity as Solicitor Gen- eral, the Deputy Minister of Public Safety in his or her capacity as Deputy Solicitor General or the Department of Public Safety in its role as the De- partment of the Solicitor General.

Loi sur le Conseil exécutif,

chapitre E-12 des Lois révisées de 1973, est modifié par la suppre ssion de « un ministre de la Sécurité publique » et son remplacement par « un ministre de la Sécurité publique qui est égale- ment solliciteur général ».

Dispositions transitoires 2 Sauf indication contraire du contexte, les ren- vois au solliciteur général, au solliciteur général adjoint ou sous-solliciteur général ou au ministère du Solliciteur général relativement à la province du Nouveau-Brunswick dans une loi de la Législa- ture, autre que la présente loi, ou dans une loi du Parlement du Canada ou dans un règlement, un texte réglementaire, une règle, un décret, un ar- rêté, un accord ou un autre instrument ou docu- ment doivent s’entendre comme des renvois au mi- nistre de la Sécurité publique en sa qualité de solliciteur général, au sous-ministre de la Sécurité publique en sa qualité de solliciteur général ad- joint ou sous-solliciteur général, ou au ministère de la Sécurité publique dans son rôle de ministère du Solliciteur général.

Loi sur le Conseil exécutif 3(1) Any act or thing done from April 1, 2000, to the date of the enactment of this section, inclusive, by the Minister of Public Safety in his or her ca- pacity as Solicitor General and in the exercise or performance or intended exercise or performance of any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on him or her in that capacity with respect to any Act of the Legislature or the Parliament of Canada, or any particular matter or thing under his or her ad- ministration, supervision or control (

a) shall be deemed to have been done by a person validly appointed to perform the right, power, duty, function, responsibility or author- ity transferred to, vested in or imposed on the Minister of Public Safety in his or her capacity as Solicitor General, (

b) shall be deemed to constitute a valid exer- cise or performance of the right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the Minister of Pub- lic Safety in his or her capacity as Solicitor Gen- eral, and (

c) is confirmed and ratified. 3(2) Nothing in paragraphs (1)(

a) and (

b) shall be taken as providing any indication that any right, power, duty, function, responsibility or authority transferred to, vested in or imposed on the Minis- ter of Public Safety in his or her capacity as Solic- itor General was not validly exercised or per- formed by him or her. 4 No action, application or any other proceeding to question or in which is questioned the validity of the appointment of the Minister of Public Safety or his or authority to act in his or her capacity as So- licitor General, shall lie or be instituted against the Crown in right of the Province or the Minister of Public Safety with respect to any act or thing done from April 1, 2000, to the date of the enactment of this section, inclusive, by that Minister in the exer- cise or performance or intended exercise or per- formance of any right, power, duty, function, re- 3(1) Tout acte ou toute chose accompli entre le 1er avril 2000 et la date d’édiction du présent arti- cle inclusivement par le ministre de la Sécurité pu- blique en sa qualité de solliciteur général et dans l’exécution ou l’exercice réel ou présumé de tout droit, tout pouvoir, toute obligation, toute fonction, toute responsabilité ou toute autorité qui lui a été transmis, conféré ou imposé en cette qualité relati- vement à toute loi de la Législature ou du Parle- ment du Canada ou à toute matière ou chose par- ticulière sous son administration, sa surveillance ou son contrôle

b) est réputé constituer un exercice ou une exécution valide du droit, du pouvoir, de l’obli- gation, de la fonction, de la responsabilité ou de l’autorité transmis, conféré ou imposé au mi- nistre de la Sécurité publique en sa qualité de solliciteur général, et

c) est confirmé et ratifié. 3(2) Rien aux alinéas (1)

a) et

b) ne peut être in- terprété comme une indication qu’un droit, un pouvoir, une obligation, une fonction, une respon- sabilité ou une autorité qui a été transmis, conféré ou imposé au ministre de la Sécurité publique en sa qualité de solliciteur général n’a pas été exercé ou exécuté validement par lui. 4 Sont irrecevables les actions, requêtes ou autres instances mettant en question ou dans les- quelles sont contestées soit la validité de la nomi- nation du ministre de la Sécurité publique ou son autorité pour agir en qualité de solliciteur général, introduites contre la Couronne du chef de la pro- vince ou le ministre de la Sécurité publique, relati- vement à tout acte ou toute chose accompli par ce ministre entre le 1 er avril 2000 et la date d’édiction du présent

article inclusivement dans l’exécution ou l’exercice réel ou présumé de tout droit, tout

An Act to Amend the Executive Council Act Bill 71 sponsibility or authority transferred to, vested in or imposed on him or her in his or her capacity as So- licitor General with respect to any Act of the Leg- islature or the Parliament of Canada, or any par- ticular matter or thing under his or her administration, supervision or control if he or she acted in good faith in doing the act or thing. Deeming Provision 5 This Act shall be deemed to have come into force on April 1, 2000.

An Act to Amend the Executive Council Act Bill 71 EXPLANATORY NOTES

Section 1 The existing provision is as follows: 2(1) The Lieutenant-Governor may appoint, under the Great Seal of the Province, from among the members of the Executive Council the following Ministers who shall hold office during pleasure: a President of the Executive Council, an Attorney General who shall also be the Minister of Justice, a Minister of Public Safety, a Minister of Finance, a Minister of Supply and Services, a Minister of Transportation, a Minister of Natural Re- sources and Energy, a Minister of Agriculture, Fisheries and Aquaculture, a Minister of Health and Wellness, a Minister of Family and Community Services, a Minister of Training and Employment Development, a Minister of Education, a Minister of the Environment and Local Government, a Minister of Busi- ness New Brunswick, a Minister of Tourism and Parks and a Minister of Intergovernmental and International Relations.

Sections 2 to 4 Transitional provisions.

Section 5 Deeming provision.

Article 1 La disposition actuelle se lit comme suit : 2(1) Le lieutenant-gouverneur peut nommer parmi les mem- bres du Conseil exécutif, sous le grand sceau de la province, les ministres suivants qui exercent leurs fonctions à

titre amovible : un président du Conseil exécutif, un procureur général qui est également ministre de la Justice, un ministre de la Sécurité pu- blique, un ministre des Finances, un ministre de l’Approvision- nement et des Services, un ministre des Transports, un ministre des Ressources naturelles et de l’Énergie, un ministre de l’Agri- culture, des Pêches et de l’Aquaculture, un ministre de la Santé et du Mieux-être, un ministre des Services familiaux et commu- nautaires, un ministre de la Formation et du Développement de l’emploi, un ministre de l’Éducation, un ministre de l’Environ- nement et des Gouvernements locaux, un ministre des Entrepri- ses Nouveau-Brunswick, un ministre du Tourisme et des Parcs et un ministre des Relations intergouvernementales et internatio- nales.
