An Act to Amend the New Brunswick Income Tax Act Loi modifiant la Loi de l’impôt sur le revenu du Nouveau-Brunswick Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et avec le consentement de l’As- semblée législative du Nouveau-Brunswick, édicte : 1

Section 14 of the New Brunswick Income Tax Act,

chapter N-6.001 of the Acts of New Brunswick, 2000, is amended 1 L’article 14 de la Loi de l’impôt sur le revenu du Nouveau-Brunswick,

chapitre N- 6.001 des Lois du Nouveau-Brunswick de 2000, est modifié (

a) in subsection (3)

a) au paragraphe (3), (

i) in the portion preceding paragraph (

a) by striking out “for the 2011 taxation year” and sub- stituting “for the 2011 taxation year and subsequent taxation years”; (

i) au passage qui précède l’alinéa a), par la sup- pression de « pour l’année d’imposition 2011 » et son remplacement par « pour l’année d’imposition 2011 et les années d’imposition subséquentes »; (ii) in paragraph (

b) by repealing subsection (4);

c) in subsection (5) by striking out “subsection (2), (3) or (4)” wherever it appears and substituting “sub- section (2) or (3)”.

Section 52.1 of the Act is amended 2 L’article 52.1 de la Loi est modifié (

a) by adding after subsection (5.6) the following:

a) the individual resided in New Brunswick on De- cember 31, 2010, and has filed a return of income for the 2010 taxation year,

b) the individual’s total family income for the 2010 taxation year

i) ou bien était égal ou inférieur au montant pres- crit, (ii) was greater than the prescribed amount but the individual’s total family income for the 2011 taxa- tion year was the prescribed amount for the 2010 taxation year or less, (ii) ou bien était supérieur au montant prescrit, mais son revenu familial total pour l’année d’impo- sition 2011 était égal ou inférieur au montant prescrit pour l’année d’imposition 2010; (

c) the place where the individual lives is his or her principal place of residence,

c) le lieu où il vit est son lieu principal de résidence; (

d) on or before June 30, 2012, the individual has, either on his or her own behalf or through a represen- tative, filed an application on the form provided by the Minister of Finance of New Brunswick for a refund of the overpayment, and

e) the individual has, either on his or her own behalf or through a representative, provided all of the infor- mation required by the application form or the Minister of Finance of New Brunswick before the date required by that Minister.

a) in subsection (1.02) by striking out “the period commencing on January 1, 2007” and substituting “the period commencing on January 1, 2007, and end- ing on December 31, 2011”;

b) by adding after subsection (1.02) the following:
