OIL SANDS CONSERVATION RULES

AMENDMENT REGULATION

section 20(1)(

r) of the Oil Sands Conservation Act.

1 The Oil Sands Conservation Rules (AR 76/88) are

amended by this Regulation.

Section 1(2) is amended by renumbering the 2nd clause

(d.13) as (d.14) and by adding the following after clause

(d.14):

(d.15) "Directive 087" means Directive 087: Well Integrity

Management;

Section 37(3) is repealed and the following is

substituted:

(3) An operator shall report a casing failure in accordance with

Directive 087.

AMENDMENT REGULATION

Conservation Act.

1 The Oil and Gas Conservation Rules (AR 151/71) are

amended by this Regulation.

Section 1.020(2) is amended by adding the following

after definition 5.7:

5.8. "Directive 087" means Directive 087: Well Integrity

Management;

Section 3.010(1)(

g) is repealed and the following is

substituted:

(

g) undertake remedial operations for the purposes of eliminating

a vent flow or gas migration in accordance with Directive

087;

(

h) undertake remedial operations for the purposes of eliminating

a leaking open-hole abandonment.

Section 6.100(4) is repealed and the following is

substituted:

(4) The Regulator may exempt a well from the requirements of this

section in accordance with Directive 087 where, in the opinion of the

Regulator, the circumstances warrant the exemption.

Section 6.120(2) is repealed and the following is

substituted:

(2) Where a well is equipped with a production packer as required

by subsection (1), the licensee must report test results in accordance

with Directive 087.

(3) If requested by the Regulator, the licensee shall submit

(

a) evidence to show, to the satisfaction of the Regulator, that the

liquid between the tubing and casing is isolated from the

fluid being injected, and

(

b) the data that substantiates the isolation.

6 The following is added after

section 6.130:

6.131 A licensee must test, report and repair packer isolation, vent

flows, gas migrations and casing failures in accordance with

Directive 087.

Section 7.050(3.1) is repealed and the following is

substituted:

(3.1) Where a well is equipped with a production packer, as required

by subsection (3), clause (b), the licensee must report test results in

accordance with Directive 087.

(3.2) If requested by the Regulator, the licensee shall submit

(

a) evidence to show, to the satisfaction of the Regulator, that the

liquid between the tubing and casing is isolated from the

fluid being injected, and

(

b) the data that substantiates the isolation.

Section 3(4) is amended by striking out "Agriculture and

Rural Development Grant Regulation (AR 58/98)" and substituting

Section 4(1) is amended

(

a) by repealing clause (a);

(

b) by adding the following after clause (e):

(e.1) Early Learning and Child Care Act;

Section 9(1) is amended by adding the following after

clause (j):

Section 10(1) is amended by adding the following after

clause (q):

(q.1) North Saskatchewan River Basin Water Authorization Act;

Section 11(1) is amended

a) by repealing clause (l);

(

b) by repealing clause (ii) and substituting the

following:

(ii) Tobacco, Smoking and Vaping Reduction Act.

(

c) by repealing clause (jj).

Section 14 is amended

(

a) in subsection (1) by repealing clause (eee);

(

b) in subsection (2)

(

i) by renumbering clause (

a) as (a.1) and adding

the following before clause (a.1):

(

a) Civil Forfeiture Act;

(ii) by repealing clause (d).

Section 15(1) is amended by adding the following after

clause (i):

Section 16 is amended

(

a) in subsection (1) by adding the following after

clause (h):

(h.1) Land and Property Rights Tribunal Act;

(

b) by adding the following after subsection (3):

(3.1) The Minister of Municipal Affairs is designated as the

Minister responsible for sections 2(1) and 3(1) of the

Emergency 911 Levy Regulation (AR 18/2014).

Section 19(1) is amended

(

a) by adding the following after clause (c):

(c.1) Financing Alberta's Strategic Transportation Act;

(

b) by adding the following after clause (g):

(g.1) Strategic Aviation Advisory Council Act;

Section 20 is amended

(

a) by repealing subsection (1)(a);

(

b) by adding the following after subsection (2.1):

(2.2) The President of Treasury Board and Minister of Finance

continues to have responsibility for the Emergency 911 Levy

Regulation (AR 18/2014), except sections 2(1) and 3(1).

(2.3) The responsibility for the Motor Vehicle Accident Claims

Act, except sections 2 and 3, is transferred to the President of

Treasury Board and Minister of Finance.

Alberta Corporate Tax Act

ALBERTA CORPORATE TAX

AMENDMENT REGULATION

1 The Alberta Corporate Tax Regulation (AR 119/2008) is

amended by this Regulation.

2 The following is added after

section 5.2:

Innovation employment grant

5.3(1) For the purpose of

section 26.95(1)(

g) of the Act, the

prescribed corporations are those that are subject to any of the

following regulations:

(

a) Payment in Lieu of Tax Regulation (AR 112/2003);

(

b) City of Medicine Hat Payment in Lieu of Tax Regulation

(AR 235/2003);

(

c) ABC Benefits Corporation Regulation (AR 272/96).

(2) For the purposes of

section 41(1.02) of the Act, the time after

which the Provincial Minister may determine the amount of the

innovation employment grant to which a corporation is entitled is the

later of

(

a) the date the Provincial Minister receives the corporation's

claim for the innovation employment grant for the taxation

year in the prescribed form, and

(

b) the earlier of

(

i) the date the federal Minister provides the Provincial

Minister with all information necessary for the

determination of the corporation's innovation

employment grant for the year, and

(ii) the date the Provincial Minister receives a copy of the

federal notice of assessment or notification, and all relevant

supporting documentation, that confirms all information

necessary for the determination of the corporation's

innovation employment grant for the year.

(3) This

section has effect on January 1, 2021.

1 In this Regulation, "Act" means the Heroes' Compensation Act.

Increase to total payments

2 Despite the amount prescribed in

section 6 of the Act, the total of

all payments made under

section 3(1) of the Act in the 2020-2021

fiscal year must not exceed $2 500 000.

Expiry

3 This Regulation expires on April 30, 2021.
