On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective September 1, 2019, the Insurance (Vehicle) Regulation, B.C. Reg. 447/83, is amended as set out in the attached Schedule.

Schedule

Section 1 (1) of the Insurance (Vehicle) Regulation, B.C. Reg. 447/83, is amended by repealing the definition of “principal operator” .

Section 11 (1) is repealed.

3 The following

section is added:

Premiums triggered by accidents involving unlisted drivers

15.41

(1) The corporation may assess a premium against an applicant to whom an owner’s certificate has been issued, in addition to any premium assessed for the certificate before it was issued, if

(

a) the vehicle specified in the certificate is involved in an accident while the certificate is valid, and

(

b) at the time of the accident, the driver of the vehicle is not named on the certificate as a driver of the vehicle.

(2) A premium may be assessed under subsection (1) whether or not the certificate is valid when the premium is assessed.

(3) A person against whom a premium is assessed under subsection (1) must pay the amount of the premium by the date specified by the corporation and the amount is a debt due and owing to the corporation on that date.

Section 15.7 is amended

(

a) in subsection (2) (

a) by striking out “ any certificate ” and substituting “ an owner’s certificate ”, and

(

b) in subsection (3) (c) (ii) by striking out “ a certificate ” and substituting “ an owner’s certificate ”.

Section 15.9 is amended by striking out “ types of certificates ” and substituting “ classes of certificates ”.

6 Division 3 is repealed.
