Currently, subsection 14 (1) of the Act specifies the infor- mation tha t m ust be in cluded o n the assessment roll for ea ch municipality.

An amendment to th at subsectio n provides that the assessment roll m ust include such add itional information as may be prescribed by the Minister of Finance by regulation.

The en actment of subsection 1 9 (2.1.1) of th e Act a llows the Minister of Finance to prescribe b y regulation the assesse d value or th e manner of determining the assessed value of a n electricity generating station that is not an electri city generating station on land owned by a desi gnated electricity utility or mu- nicipal electricity utility.

Section 19.3 of the Act p rovides the day as of which land shall be classified for a tax ation year. The amendment changes that day from October 31 of the previous year to June 30 of the previous year.

Currently, subsection 25 (2) o f the Act provid es that on o r before October 1 of ever y year a pipe lin e company shall pro- vide the as sessment corporatio n with information on pipelines owned by it on September 1 of that year. The re-enactment of this subsection changes the first date to March 1 or such other day as the M inister of F inance may pres cribe a nd the s econd date to January 1.

Currently, subsection 30 (1) o f the Act provid es that on o r before July 1 of every year a railway company shall provide the assessment corporation with in formation on land owned by it. The s ubsec- tion is amended so that only changes for th e current or pr eced- ing year requ ire a new as sessment noti ce.

The enactm ent o f subsection 32 (3 ) of the Act requires the assessor to issue a no- tice of assessment and the municipality to refund overpaid taxes if the prop erty becomes exempt from taxation as a res ult of an amendment to t he Act or regu lations for the current year or fo r the preceding year.

The ena ctment of subsectio n 32 (4) of th e Act requires the assessor to issue a notice of assessment and the municipality to refund or levy the appropriate amount of taxes if the methodology for assessing a property is ch anged as a result of an amendment to th e Act or the r egulations for the current year or for the preceding year.

Currently, subsection 34 (2) o f the Act provid es that a sup- plementary assessment of a pr operty shall be made when a “change event”, within the meaning of subsection 34 (2.2) of the Act, occu rs during a year or the preced ing Novem ber or De- cember, a fter the cl assification date for th e year, and the “change even t” would result in the property ’s classificatio n changing. The subsection is ame nded to reflect the new classi- fication date of June 30 so that change events occurring after the preceding July 1 may give rise to a supplementary assessment.

SCHEDULE 26 AMENDMENTS TO THE MUNICIPAL ACT, 2001

ANNEXE 26 MODIFICATION DE LA LOI DE 2001 SUR LES MUNICIPALITÉS

Section 314 of the Municipal Act, 2001 currently a llows municipalities to apply graduated tax r ates to properties in the commercial and industrial prop erty classes. The

section is amended to clar ify tha t graduated tax r ates may b e applied as well to option al classes within the commercial and industrial classes.

Section 315 of the Act currently authorizes the Minister of Finance to make regulations pres cribing rates of tax for railway and power u tility rights-of-way in each geographic area set out in the section. The re-enactment of the definition of “Upper-tier commercial tax” in subsect ion 315 (3) of th e Act clarifies that only that portion of the com mercial tax l evied in the loca l mu- nicipality is in cluded in d etermining the upper- tier municipal- ity’s share of the tax for railway and power utility rights-of-way.

Subsection 315 (12) of the Act provides that until 2005 the Min- ister of Finance may prescribe different transitional tax rates for these lands if th e lands have been con tinuously owned b y th e same owner. The enactment of clause 315 (4) (a.1) of th e Act authorizes the Minister of F inance to pres cribe b y regul ation different tax rates for different railway or power utility rights-of- way for 2005 and subsequent years.

section 329 of the Act. The re-enactment o f paragraph 4 of s ubsection 330 (4) of the Act per mits the Minis- ter of Finance to prescribe a percentage that is different from the percentage otherwise applicable.

The amendment to clause 357 (1) (

e) of th e A ct p ermits applications for a refund on a mobile unit that is removed from a site even if the mobile unit remains in the same local municipal- ity after its removal.

Currently, subsections 365.1 (2) and (3) of the A ct permit a local municipality to pass a b y-law cancelling or freezing prop- erty taxes on eligible “brownfi elds” properties, on such condi- tions as the m unicipality m ay determine.

The enactm ent o f subsection 365.1 (3.1) of the Ac t permits the municipality to include in th e b y-law a provisi on that th e t axes will becom e payable only if the municipality determines that some or all o f the cond itions s et out in th e b y-law have not b een met as re- quired. The enactment of subs ection 365.1 (3 .2) of the Act provides for interest to be charged if the taxes b ecome payable as a result of a failure to meet the required conditions.

Section 474 of the Act curren tly provides that Parts XXII.1 and XXII.2 of the predecessor Act continue to apply with r e- spect to municipal taxes. The re-enactment of that

section pro- vides that

Part XXII.3 (Limitation on Taxes for Certain Property Classes Beginning in 2001) of the predecessor Act also contin- ues to apply and clarif ies that r egulations may continue to be made relating to taxes payable for years before 2003. Currently, subsection 18 (3) of the Act permits the Minister of Finance to as sess a person for tax payable under the Act, but only within four years after the tax becomes payable. Under the current Act, an exception to this four-year period is made where there has been neglect, carelessness, wilful def ault or fraud . Amendments to

section 18 of the Act permit a taxpayer to waive the four- year ti me lim it b y f iling a waiver wit h the Minister . Once filed, the waiver may be revoked by the taxpay er, but it continues to have effect for one year.

Similar am endments are m ade to

section 20 of the Act in respect of the assessment of penalties against vendors for failing to collect tax under the Act. The amendments to s ections 34 and 35 of the A ct provide an exception to the compound interest rules currently in the Act.

If the tax is imposed under secti on 3 of the Act in respect of a multijurisdictional vehicle, any interest imposed is calculated in accordance with the r ules for calculating interest payable under the Fuel Tax Act by Ontario-licensed interjurisdictional carriers who hold “IFTA” licences.
