chapter I-12 of the Revised Statutes, 1973, is amended by adding after

section the following: 1 La

chapitre I-12 des Lois révisées de 1973, est modifiée par l’adjonction de ce qui suit après l’article 116 : RECOVERY BY INNOCENT PERSONS RECOUVREMENT PAR DES PERSONNES INNOCENTES 116.1(1) If a contract contains a term or condition ex- cluding coverage for loss or damage to property caused by a criminal or intentional act or omission of an insured or any other person, the exclusion applies only to the claim of a person 116.1(1) Si un contrat comporte des modalités ou des conditions qui excluent la garantie contre toute perte ou tout dommage causés par une omission ou un acte crimi- nels ou intentionnels de l’assuré ou de toute autre per- sonne, cette exclusion ne s’applique qu’à la demande de règlement que présente la personne qui : (

a) whose act or omission caused the loss or dam- age,

a) par son omission ou son acte a causé la perte ou le dommage; (

b) who abetted or colluded in the act or omission,

b) a encouragé l’omission ou l’acte ou y a participé; (

c) who

i) consented to the act or omission, and (

i) a consenti à l’omission ou à l’acte, (ii) knew or ought to have known that the act or omission would cause the loss or damage, or (ii) savait ou aurait dû savoir que l’omission ou l’acte causerait la perte ou le dommage; (

d) who is not a natural person.

a) cooperate with the insurer in respect of the in- vestigation of the loss, including by submitting to an examination under oath if requested by the insurer,

a) collabore avec l’assureur concernant l’enquête sur le sinistre, y compris en subissant, à sa demande, un interrogatoire sous serment; (

b) in addition to producing any documents required by the contract, produce for examination, at a reason- able place and time specified by the insurer, all docu- ments in the person’s possession or control that relate to the loss, and

c) comply with any other requirement prescribed by regulation.
