OIC Text: The Governor in Council on the report and recommendation of the Minister of Natural Resources dated February 18, 2010, and pursuant to
Section 7 of
Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, and
Section 6 of
Chapter 376 of the Revised Statutes of Nova Scotia, 1989, the Public Service Act, is pleased to authorize the Minister of Natural Resources to: (
a) acquire land located in the Counties of Cumberland, Colchester, Pictou, Halifax, Hants and Guysborough as shown on
Schedule "A" attached to and forming part of the report and recommendation, the exact size and location to be negotiated, from Northern Timber Nova Scotia Corporation, their trustees, approved successors and assigns, for a total purchase price not to exceed $16.5 million plus appraisal, survey and legal costs, subject to the condition that Northern Timber Nova Scotia Corporation, their trustees, approved successors and assigns, be able to certify title to the land in a manner deemed sufficient by the Department of Justice; (
b) acquire 20 metre wide rights of way over lands of Northern Timber Nova Scotia Corporation, their trustees, approved successors and assigns located in Colchester and Pictou Counties and shown in bold on the plan marked
Schedule "B" attached to and forming part of the report and recommendation, subject to the condition that title to the lands of Northern Timber Nova Scotia Corporation, their trustees, approved successors and assigns can be certified in a manner deemed sufficient by the Department of Justice; (
c) enter into an Agreement with Northern Timber Nova Scotia Corporation and Northern Pulp Nova Scotia Corporation, their trustees, approved successors and assigns, regarding matters ancillary to the acquisition of lands described in paragraphs (
a) and (b); and (
d) execute such documents as may be necessary to achieve the purposes of this Order.
