On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective December 1, 2003, the Sierra Yoyo System of Charges Regulation, B.C. Reg. 403/98, is repealed and the Sierra Yoyo Desan System of Charges Regulation in

Schedule 1 is made. — J. REID, Minister of Transportation; R. NEUFELD, Minister of Energy and Mines; G. CAMPBELL, Presiding Member of the Executive Council.

Schedule 1

SIERRA YOYO DESAN SYSTEM OF CHARGES REGULATION

Definitions

1 In this regulation:

"authority" means the BC Transportation Financing Authority;

"system of charges" means the system of charges established by the authority for the Sierra Yoyo Desan Road and approved by the Lieutenant Governor in Council under

section 21 (2) of the Build BC Act .

System of charges to be published in the Gazette

2 The system of charges must be published in the Gazette as soon as practicable after approval is given by the Lieutenant Governor in Council to the system of charges.

Consultation with users

3 The authority must consult with industrial users

(

a) before making any changes to the charges under the system of charges, and

(

b) before adding any new categories of industrial users.
